Zimmerman Woman Pleads Guilty to Disability FraudRead the Press Release
United States Attorney Erica H. MacDonald today announced the guilty plea of ANNAMARIE GREEN, 60, to one count of disability fraud. GREEN, who was indicted on January 8, 2020, entered her guilty plea this afternoon before Judge Nancy E. Brasel in U.S. District Court in Minneapolis, Minnesota.
According to GREEN’s guilty plea and documents filed with the court, in October of 2014, GREEN applied for disability benefits from the Social Security Administration (SSA), which approved her application in August of 2015. On multiple occasions from August 2015 through 2018, GREEN intentionally failed to disclose her work activities to the SSA, because she knew these activities would impact her eligibility to receive SSA benefits. Specifically she failed to disclose that she engaged in substantial work activities for Select Home Care, Inc., a company which GREEN owned and operated. As a result, GREEN received at least $40,000 in social security disability benefits that she knew she was not entitled to receive. As part of the plea agreement, GREEN agreed to pay restitution of the benefits she wrongfully received.
This case is the result of an investigation conducted by the Social Security Administration Office of the Inspector General.
Special Assistant U.S. Attorney Lindsey E. Middlecamp and Assistant United States Attorney Jordan L. Sing are prosecuting the case.
Defendant Information:
ANNAMARIE GREEN, 60
Zimmerman, Minn.

Minneapolis Man Pleads Guilty to CyberstalkingRead the Press Release
United States Attorney Erica H. MacDonald today announced the guilty plea of JEFFREY COLIN PURDY, 28, to cyberstalking. PURDY entered his guilty plea this afternoon before Judge Susan Richard Nelson in U.S. District Court in St. Paul, Minnesota.
According to PURDY’s guilty plea and documents filed with the court, between August 30, 2017, and February 29, 2020, PURDY used various means of interstate commerce to communicate threats to injure and kidnap. Specifically, on September 15, 2017, the Mankato Department of Public Safety received a complaint from an individual stating that she had been receiving harassing emails from PURDY, a former classmate from Minnesota State University, Mankato (“Mankato State”). While attending Mankato State, the victim declined repeated romantic advances from PURDY and eventually blocked PURDY from her cellular telephone and social media accounts. From August 30, 2017, through February 21, 2020, PURDY used Mankato State’s Silent Witness Report, an anonymous incident reporting tool, to make frequent, violent threats against the victim. An IP address used to make one of the Silent Witness Reports was traced back to PURDY. On February 29, 2020, during an interview at the Mankato Department of Public Safety, PURDY admitted to sending all the Silent Witness Reports.
This case is the result of an investigation conducted by the FBI and the Mankato Department of Public Safety, with assistance from the Blue Earth County Attorney’s Office.

International Sex Trafficker Sentenced to More Than 17 Years in PrisonRead the Press Release
United States Attorney Erica H. MacDonald today announced the sentencing of MICHAEL MORRIS 66, to 208 months in prison for his role in operating a massive international sex trafficking organization that was responsible for coercing hundreds of Thai women to engage in commercial sex acts across the United States. MORRIS was sentenced by Senior Judge Donovan Frank in U.S. District Court in St. Paul, Minnesota.
Following a six-week trial, on December 12, 2018, a federal jury convicted MORRIS and four other defendants for their roles in operating the sex trafficking enterprise. Thirty-one defendants pleaded guilty prior to the 2018 trial. To date, 29 defendants have been sentenced.
“Sex trafficking continues to be a repugnant local, national, and international crime that preys on vulnerable populations,” said United States Attorney Erica H. MacDonald. “This case demonstrates the dedication and relentlessness of law enforcement across multiple jurisdictions to bring those who commit these crimes to justice.”
As proven at trial, the sex trafficking organization coerced hundreds of women from Bangkok, Thailand, to engage in commercial sex acts in various cities across the United States, including Minneapolis, Los Angeles, Chicago, Atlanta, Phoenix, Washington, D.C., Las Vegas, Houston, Dallas, Seattle, and Austin. The trafficking victims were forced to participate in the criminal scheme through misleading promises of a better life in the United States and the ability to provide money to their families in Thailand. Once in the United States, the victims were sent to houses of prostitution, including the three that MORRIS ran in southern California, where they were forced to have sex with strangers – every day –having sex with up to ten men a day. The victims were isolated from the outside world, and their families in Thailand were threatened.
As proven at trial, the organization also engaged in widespread visa fraud to facilitate the international transportation of the victims and engaged in rampant and sophisticated money laundering in order to promote and conceal illegal profits. During the extensive investigation, law enforcement traced tens of millions of dollars to the organization.
Multiple agencies assisted in this investigation over the past five years including: Homeland Security Investigations; the Criminal Investigation Division of the IRS; the Department of Justice’s Criminal Division’s Money Laundering and Asset Recovery Section; the Department of Justice’s Civil Rights Division’s Human Trafficking Prosecution Unit; the St. Paul Police Department; the Bureau of Criminal Apprehension’s Minnesota Human Trafficking Investigators Task Force; the Anoka County Sheriff’s Office; the Cook County (Illinois) Sheriff’s Office; the State Department Diplomatic Security Service; and the International Organized Crime Intelligence and Operations Center (IOC-2). United States Attorney MacDonald also thanks the Thai Community Development Center for the support and advocacy they have done on behalf of the victims of this sex trafficking organization.
Assistant United States Attorneys Melinda Williams, Laura Provinzino, and Craig Baune are prosecuting the case.
This case is filed as United States v. Michael Morris, et al., 17-cr-107 (DWF/TNL) and United States v. Sumalee Intarathong, et al., 16-cr-257 (DWF/TNL).

St. Paul Man Charged with COVID-Relief Fraud, Money LaunderingRead the Press Release
United States Attorney Erica H. MacDonald today announced the unsealing of a federal indictment charging KYLE WILLIAM BRENIZER, 32, with fraudulently obtaining $841,000 in Paycheck Protection Program (PPP) loans intended to provide relief for small businesses affected by COVID-19.[1] The indictment, which was returned under seal on August 19, 2020, charges BRENIZER with two counts of wire fraud and two counts of money laundering. BRENIZER, who was taken into custody earlier today, made his initial appearance before Magistrate Judge Becky R. Thorson in U.S. District Court in St. Paul, Minnesota. BRENIZER was ordered to remain in custody pending a formal detention and arraignment hearing, which is scheduled for Wednesday, August 26.
According to the allegations in the indictment, BRENIZER was the owner and manager of True-Cut Construction LLC (“True-Cut”), a contracting and construction company located in Brooklyn Park, Minnesota. In August 2018, True-Cut and BRENIZER were ordered by the Minnesota Department of Labor and Industry to cease and desist from doing business and in December 2019, True-Cut’s contractor license expired and was never renewed.
According to the allegations in the indictment, on May 1, 2020, BRENIZER submitted a false and misleading PPP application in the name of True-Cut seeking approximately $841,000, but the application was denied. On May 12, 2020, BRENIZER again submitted a false and misleading PPP application in the name of True-Cut seeking approximately $841,000 in PPP funds. This time, in order to conceal his involvement, BRENIZER submitted the application under the name of another individual whom BRENIZER falsely claimed was the 90 percent owner of True-Cut. BRENIZER falsely stated that True-Cut’s average monthly payroll was $336,400 for approximately 30 employees. In support of both loan applications, BRENIZER caused to be submitted to the lender fraudulent supporting documentation, such as falsified bank statements and IRS documents. In addition, BRENIZER falsely certified that he was not subject to any pending criminal charges even though he was allegedly named in multiple felony charges pending in the State of Minnesota for such charges as check forgery, identify theft, and theft by swindle. Due to these various misrepresentations and omissions, on May 13, 2020, BRENIZER’s second application was approved, and he received $841,000 in PPP funds.
According to the allegations in the indictment, instead of using the PPP funds for permissible business expenses, BRENIZER transferred approximately $650,000 to a bank account unrelated to True-Cut and made a $29,000 payment to purchase a Harley-Davidson motorcycle, spent over $1,000 on golf expenses, among other retail and entertainment expenditures for his personal benefit.
The CARES Act is a federal law enacted on March 29, 2020, designed to provide emergency financial assistance to the millions of Americans who are suffering the economic effects caused by the COVID-19 pandemic. One source of relief provided by the CARES Act was the authorization of up to $349 billion in forgivable loans to small businesses for job retention and certain other expenses, through the PPP. In April 2020, Congress authorized over $300 billion in additional PPP funding.
The PPP allows qualifying small-businesses and other organizations to receive loans with a maturity of two years and an interest rate of one percent. PPP loan proceeds must be used by businesses on payroll costs, interest on mortgages, rent, and utilities. The PPP allows the interest and principal on the PPP loan to be forgiven if the business spends the loan proceeds on these expense items within a designated period of time after receiving the proceeds and uses at least a certain percentage of the PPP loan proceeds on payroll expenses.

Registered Sex Offender Sentenced to 35 Years in Prison for “Sextorting” More Than 40 MinorsRead the Press Release
United States Attorney Erica H. MacDonald today announced the sentencing of DYLAN MATTHEW DELING, a/k/a “Jason Keens,” a/k/a “Dylan Nash,” 21, to 420 months in prison for producing child pornography and extortion. DELING, who pleaded guilty on July 18, 2019, was sentenced today before Judge Wilhelmina M. Wright in U.S. District Court in St. Paul, Minnesota.
“This defendant’s victimization went beyond sexual exploitation; his ultimate goal was to instill fear and humiliation. This type of depraved criminal behavior will not be tolerated,” said U.S. Attorney Erica MacDonald. It is my hope that today’s sentence represents justice and closure for the victims and their families.”
“The sentence of this defendant demonstrates the FBI’s never-ending commitment to apprehending sexual offenders who prey on innocent children," said Aubree M. Schwartz, Acting Special Agent in Charge of the FBI's Minneapolis field office. "No sentence can wipe away the scars and irreparable harm those heinous actions leave on child victims. This should send a strong message to anyone considering exploiting our most vulnerable citizens.”
According to the defendant’s guilty plea and documents filed in court, between October 2017 and August 2, 2018, DELING used multiple social media and chat platforms, including Snapchat, Facebook, Instagram, Kik, and Skype, as well as text messages to carry out his sextortion scheme. Sextortion is the act of extorting sexually explicit images and videos from a victim by threatening to reveal a victim’s sexually explicit chats, images, or videos, or through threats of harm to the victim or the victim’s loved ones. In the course of his scheme, DELING sextorted more than 40 minor girls whom he knew to be or believed were between 11 and 17 years old.
According to the defendant’s guilty plea and documents filed in court, DELING, using multiple usernames and accounts, employed several different techniques to attempt to and to obtain child pornography from minor girls. One technique DELING used was offering compliments and expressions of affection to the minor girls to persuade them into creating sexually explicit images of themselves. In many instances, DELING threatened to and actually did disseminate sexually explicit images of the girls to their friends and family if the girls refused to provide him with sexually explicit images. In other instances, DELING threatened to send his associates to rape, kidnap, injure, or kill the girls or their loved ones. To underscore his threats, DELING sent screenshots of maps of the girls’ residences, family members’ contact information, and other identifying information to the girls, as well as posting the information online. In at least one instance, DELING obtained sexually explicit images through a friend of one of the girls.
This case was the result of an investigation conducted by the FBI, in coordination with multiple state and local law enforcement agencies inside and outside of Minnesota.
This case was prosecuted by Assistant U.S. Attorney Miranda E Dugi.

Three Nigerian Nationals Indicted for International Cyber Fraud ConspiracyRead the Press Release
United States Attorney Erica H. MacDonald today announced the unsealing of three separate indictments against OLUFEMI OLUWASEUN BANJO, a/k/a “Femi Banjo,” 37, FRANCIS NWABUEZE IWUOHA, 38, and OLUWADAMILARE GBENGA MACAULAY, 32, charging them with wire fraud, aggravated identity theft, and conspiracy. The defendants are at large and believed to be in Nigeria.
According to the allegations in the indictments, from approximately March 2016, through approximately February 2018, BANJO, IWUOHA, and MACAULAY, all citizens of Nigeria, gained unauthorized access to internet accounts of thousands of individual victims to steal Personal Identifying Information (PII) and IRS W-2 Forms, which they used to file false tax returns in the names of the individual victims seeking fraudulent refunds.
As part of the scheme, BANJO, IWUOHA, MACAULAY, and others gained unauthorized access to approximately 1,200 individuals’ accounts maintained by a Minnesota-based company that provides human resource and payroll services to numerous businesses. The accounts were registered with a web-based program that allowed employees to download a copy of their IRS Form W-2 from an internet portal. After fraudulently obtaining PII and tax information from the accounts, BANJO, IWUOHA, MACAULAY, and others used the information to prepare and electronically file fraudulent tax returns with the IRS.
As part of the scheme, BANJO, IWUOHA, MACAULAY, and others also gained unauthorized access to individuals’ accounts maintained by the Department of Education by exploiting an online tool that facilitates the transfer of individuals’ PII and tax information from the IRS website to the Department of Education. The defendants used the stolen information to prepare and electronically file fraudulent tax returns with the IRS. As a result of the scheme, BANJO, IWUOHA, MACAULAY, and others attempted to claim a total of approximately $16.4 million in fraudulent tax refunds.
These cases are the result of an investigation conducted by the Internal Revenue Service’s Criminal Investigation Division, the U.S. Department of Education, Office of Inspector General, and the FBI.
Assistant U.S. Attorneys Julie E. Allyn and Angela M. Munoz are prosecuting the cases.

Update on Twin Cities Violent Crime Task ForceRead the Press Release
On July 8, 2020, United States Attorney Erica H. MacDonald announced the formation of a new Twin Cities Violent Crime Task Force (Task Force) in response to an extraordinary spike in gun violence and violent crime across the Twin Cities. The Task Force brought together additional federal and state resources to assist local law enforcement to investigate, arrest, and prosecute individuals responsible for gun violence in our communities. Over the last 30 days, as a result of the joint efforts of the Task Force, a total of 94 illegal firearms have been taken off the streets and 15 individuals have been charged with federal firearms violations. After evaluating the rate of violence, the resources utilized, and the effectiveness of those resources, U.S. Attorney MacDonald has determined the Task Force will remain operational for an additional 30 days. Beyond that, there will be a continued assessment of the need for a centralized command center to remain in place.
The public may report tips by calling 1-800-CALLFBI (800-225-5324) or submit pictures and/or videos at www.fbi.gov/violence.

Owner of Illegal Massage Parlor Sentenced to 400 Months in Prison for Sex TraffickingRead the Press Release
United States Attorney Erica H. MacDonald today announced the sentencing of OMAR KASHAKA TAYLOR a/k/a “Shaka,” 46, to 400 months in prison for sex trafficking two victims, including one minor victim. TAYLOR, who was convicted on all counts by a federal jury on February 5, 2019, was sentenced today before Senior Judge Donovan W. Frank in U.S. District Court in St. Paul, Minnesota.
“Omar Taylor is a coercive sex trafficker who pursued and exploited vulnerable victims for his own financial profit,” said United States Attorney Erica MacDonald. “The 400-month sentence handed down today is appropriate in light of the trauma Mr. Taylor inflicted upon his victims.”
“Today’s sentencing will hopefully close a painful chapter in the lives of the survivors of Mr. Taylor’s heinous actions,” said Tracy J. Cormier, HSI St. Paul special agent in charge. “We’re confident that this significant sentencing will empower others, who are facing similar circumstances to come forward, knowing that they will be fully supported and that their captors will face justice.”
As proven at trial, from August 2017 through March 2018, TAYLOR, a registered sex offender, operated an illegal massage business out of his northeast Minneapolis residence. TAYLOR recruited several young women and girls, at times targeting Native American and First Nation women and girls, to work in his illicit massage business and then, through force, threats of force, fraud, and coercion, caused them to perform commercial sex acts in exchange for money for his own financial benefit. TAYLOR used Backpage.com to solicit prospective clients by posting advertisements with photos of the victims, offering massage services that would include commercial sex acts.
This case was the result of an investigation conducted by Homeland Security Investigations, the Minnesota Bureau of Criminal Apprehension, the Minnesota Human Trafficking Investigators Task Force, and the Beltrami County Sheriff’s Office.
Assistant United States Attorneys Manda M. Sertich and Michelle E. Jones prosecuted the case.

Minneapolis Man Charged with Illegally Possessing A FirearmRead the Press Release
United States Attorney Erica H. MacDonald today announced a criminal complaint charging DESHAWN TYRONE BRAZIEL, 35, with one count of possession of a firearm by a felon. A preliminary and detention hearing on this charge is scheduled for August 10, before Magistrate Judge Elizabeth Cowan Wright, in U.S. District Court in St. Paul, Minnesota.
According to the allegations in the criminal complaint and affidavit, on May 21, 2020, law enforcement received information that BRAZIEL was seen at a store that has an upper apartment unit accessible from the inside of the store. BRAZIEL had two outstanding warrants for his arrest and was a suspect in a shooting that occurred in Minneapolis on April 16, 2020. Law enforcement officers conducting physical surveillance observed BRAZIEL exit the property and enter the driver's side of a BMW that was parked nearby. Law enforcement officers approached BRAZIEL and placed him under arrest. At the time of his arrest, BRAZIEL was wearing a backpack. Law enforcement located a loaded, Springfield XD 9mm pistol, 94 ecstasy pills, BRAZIEL’s credit card, and other items including a digital scale in the backpack. Because BRAZIEL has prior felony convictions, including a previous conviction for a drive-by shooting in 2006, he is prohibited under federal law from possessing firearms or ammunition.
This case is the result of an investigation conducted by the Bureau of Alcohol, Tobacco, Firearms and Explosives, the Federal Bureau of Investigation, and the Minneapolis Police Department.
This case was brought as part of the Twin Cities Violent Crime Task Force, a multi-agency effort that brings together additional federal and state resources to assist local law enforcement to investigate, arrest, and prosecute individuals responsible for gun violence in the Twin Cities. Victims of Tom Petters Ponzi Scheme Receive Additional Distribution of More Than $22 Million in Forfeited FundsRead the Press Release
The Department of Justice announced today that an additional distribution of $ 22,394,690.03 has been issued to victim investors of the THOMAS PETTERS fraud scheme. These funds, forfeited to the United States through criminal and civil forfeiture proceedings prosecuted in the District of Minnesota, will be sent to approximately 364 victims worldwide.
On December 1, 2008, THOMAS JOSEPH PETTERS, of Wayzata, Minnesota, was indicted on multiple counts of mail fraud, wire fraud, money laundering, and conspiracy for orchestrating a $2.1 billion Ponzi scheme. On December 2, 2009, a federal jury found PETTERS guilty of all 20 counts against him and was later sentenced by U.S. District Judge Richard H. Kyle to 50 years in federal prison. Other defendants were convicted in related criminal proceedings. As part of their sentencing judgments, PETTERS and other defendants were ordered to forfeit assets obtained through their criminal activity, including real estate, bank and investment accounts, vehicles and other assets. Under federal law, the Department of Justice has the authority to distribute the proceeds of forfeited assets through the remission process to victim investors who lost money in connection with the scheme. The proceeds of all forfeited assets are being distributed to victim investors.
This distribution follows the 2018 initial distribution of over $16 million, bringing the total to more than $38 million.
The forfeiture proceedings were part of a coordinated effort to compensate victim investors. In October 2008, the United States obtained an injunction against the fraud in a separate civil case, and the Court appointed a receiver to assist in the recovery of assets. Thereafter, multiple bankruptcy proceedings were filed in Minnesota and other states. In September 2010, the U.S. District Court and the U.S. Bankruptcy Court approved a Coordination Agreement governing the asset recovery efforts of the United States, the bankruptcy trustees, and the Court appointed receiver. In addition to the funds distributed via remission payments, additional payments are being made to victim investors and creditors through these ongoing bankruptcy and receivership proceedings in various states including Minnesota, Illinois and Florida.
The Petters’ remission payments would not have been possible without the efforts of the U.S. Department of Justice Criminal Division’s Money Laundering and Asset Recovery Section, the U.S. Attorney’s Office for the District of Minnesota, the FBI, IRS Criminal Investigation, and the U.S. Postal Inspection Service in the prosecution of these crimes and the recovery of assets supporting the forfeiture in this case.

U.S. Attorney Erica H. MacDonald Announces Nearly $1.5 Million in Funds to Support Victims of Human Trafficking in MinnesotaRead the Press Release
U.S. Attorney Erica MacDonald today announced that the state of Minnesota received nearly $1.5 million from the Department of Justice’s Office of Justice Programs (OJP) and its component, the Office for Victims of Crime (OVC), to provide safe, stable housing and appropriate services to victims of human trafficking.
“Human trafficking is a barbaric criminal enterprise that subjects its victims to unspeakable cruelty and deprives them of the most basic of human needs, none more essential than a safe place to live,” said Attorney General William P. Barr. “Throughout this Administration, the Department of Justice has fought aggressively to bring human traffickers to justice and to deliver critical aid to trafficking survivors. These new resources, announced today, expand on our efforts to offer those who have suffered the shelter and support they need to begin a new and better life.”
“Safe and stable housing is an integral step in the healing process and the path towards independence and a future free from exploitation,” said United States Attorney Erica MacDonald. “These grants awarded today will provide much needed funding for housing and related expenses for victims of all forms of human trafficking throughout Minnesota.”
The grants, awarded to the Link, Face to Face Health and Counseling Service Inc., and to Lutheran Social Services of Minnesota, will provide six to 24 months of transitional or short-term housing assistance for all forms of human trafficking victims, including rental, utilities or related expenses, such as security deposits and relocation costs. Funds will also provide for support needed to help victims locate permanent housing, secure employment, as well as occupational training and counseling. These recipients are among 73 organizations receiving more than $35 million in OVC grants to support housing services for human trafficking survivors.

$500,000
Face to Face Health and Counseling Service, Inc.

“Human traffickers dangle the threat of homelessness over those they have entrapped, playing a ruthless game of psychological manipulation that victims are never in a position to win,” said OJP Principal Deputy Assistant Attorney General Katharine T. Sullivan. “These grants will empower survivors on their path to independence and a life of self-sufficiency and hope.”
Human trafficking offenses are among the most difficult crimes to identify, and the scope of human trafficking victimization may be much greater than the limited data reflect. A new report issued by the National Institute of Justice, another component of OJP, found that the number of human trafficking cases captured in police reports may represent only a fraction of all such cases. Expanding housing and other services to trafficking victims remains a top Justice Department priority.
OVC, for example, hosted listening sessions and roundtable discussions with stakeholders in the field in 2018 and launched the Human Trafficking Capacity Building Center. From July 2018 through June 2019, 118 OVC human trafficking grantees reported serving 8,375 total clients including confirmed trafficking victims and individuals showing strong indicators of trafficking victimization.

Rochester Armed Career Criminal Sentenced to 180 Months in Prison for Illegal Possession of A FirearmRead the Press Release
United States Attorney Erica H. MacDonald today announced the sentencing of CHARLES ANTONIO GAYLES, 38, to 180 months in prison for illegally possessing a firearm. GAYLES, who pleaded guilty on November 20, 2019, was sentenced earlier today before Senior Judge Michael J. Davis in U.S. District Court in Minneapolis, Minnesota.
“The U.S. Attorney’s Office is focusing our efforts on taking armed criminals off the streets, in the Twin Cities and in greater Minnesota, said United States Attorney Erica MacDonald. “Mr. Gayles’s long and violent criminal history in Olmstead County warranted this significant sentence and I applaud our federal and local law enforcement partners for their work in bringing him to justice.”
“As an armed career criminal, this individual’s criminal conduct has plagued the Rochester community for far too long,” said ATF Special Agent in Charge William Henderson, of the St. Paul Field Division. “We are pleased to see that justice has been served. We appreciate the hard work from Rochester Police Department in this case.”
According to the defendant’s guilty plea and documents filed in court, on May 7, 2019, an officer with the Rochester Police Department initiated a traffic stop on a black Audi A6 for expired registration and unlawful tint. As the officer approached the vehicle he could smell marijuana and observed a sandwich bag containing just over eight grams of marijuana in the center console area. GAYLES, who was driving the vehicle, gave the bag of marijuana to the officer. When the officer asked GAYLES to turn off the vehicle, GAYLES sped off but shortly thereafter crashed the vehicle and then continued to flee on foot. The two passengers who were in the vehicle told the officer that GAYLES pulled out a black handgun from under the driver’s seat before fleeing on foot. Another officer saw GAYLES toss a black firearm into a nearby bush. Officers recovered from the bush a loaded Sig Sauer, model P320, 9-millimeter semiautomatic pistol. After a search of the area, officers located GAYLES a few blocks away hiding inside a trashcan; the keys for the Audi A6 were located in his pocket. After conducting a search of the vehicle GAYLES was driving, officers recovered an additional 27.34 grams of marijuana, two loaded 9mm handgun magazines, one a large-capacity 32-round magazine, and a Sig Sauer 9mm holster. Because he has multiple prior felony convictions, GAYLES is prohibited under federal law from possessing a firearm at any time.
This case is the result of an investigation conducted by the Bureau of Alcohol, Tobacco, Firearms, and Explosives and the Rochester Police Department. This case was brought as part of Project Safe Neighborhoods (PSN), an initiative that brings together federal, state, and local law enforcement to combat violent crime. This case is also part of Project Guardian, the Department of Justice’s signature initiative to reduce gun violence and enforce federal firearms laws.
Assistant U.S. Attorney Benjamin Bejar prosecuted the case.

CEO of Chaska Telemarketing Company Pleads Guilty to Mail FraudRead the Press Release
United States Attorney Erica H. MacDonald today announced the guilty plea of WAYNE ROBERT DAHL, JR., 51, to one count of mail fraud. DAHL entered his guilty plea today before Chief Judge John R. Tunheim in U.S. District Court in Minneapolis, Minn.
“Fraudulent and deceptive sales tactics designed to trick consumers into buying expensive magazine subscriptions was the foundation of Wayne Dahl’s business model. This nationwide fraud scheme impacted more than 13,000 people across the United States, many of them elderly,” said U.S. Attorney Erica H. MacDonald. “Bringing to justice those who target vulnerable individuals for their own financial profit is a top priority of the Department of Justice and my office.”
According to DAHL’s guilty plea and documents filed with the court, DAHL was the owner and Chief Executive Officer of Your Magazine Service, Inc., a fraudulent telemarketing company that operated a call center in Chaska, Minnesota. DAHL and his company defrauded mostly elderly consumers by tricking them into signing up for costly magazine subscriptions through false and fraudulent representations and sales tactics. DAHL purchased lists of consumers who had active magazine subscriptions through other companies. DAHL directed his sales employees to cold-call the people on these lists and fraudulently sign them up for expensive magazine subscription packages. DAHL required his employees call these consumers and falsely claim they were calling to offer the consumers a $150 reduction on their existing account balance. In reality, as DAHL knew, the consumers did not have an existing magazine subscription with his company. During the calls, DAHL directed his employees to obtain consumers’ credit card information by falsely claiming that the company was conducting a survey on credit card and banking usage. DAHL then directed his employees to use this information to trick consumers into signing up for expensive magazine subscription packages that they did not want nor realize they were purchasing. These new subscription packages resulted in DAHL’s company billing his victim-consumers 20 monthly payments of $49.90, for a total cost of $998.
According to DAHL’s guilty plea and documents filed with the court, DAHL also gave his employees a “rebuttal script” for use in responding to consumers’ questions. The rebuttal scripts provided false and fraudulent responses to consumers’ potential questions. For example, if a consumer stated that he or she did not want more magazines, DAHL’s script directed employees to falsely state “Oh, this isn’t for any more. This is for what you’re already getting.”
DAHL’s company used these fraudulent sales tactics to sell magazine packages to more than 13,000 people across the United States. DAHL and his company received more than $11 million from their victim-customers for the magazine subscription packages.
This case is the result of an investigation conducted by the United States Postal Inspection Service and the Federal Bureau of Investigation. United States Attorney MacDonald would also like to thank the Minnesota Office of the Attorney General for its assistance in this matter.
This case was prosecuted by Assistant United Assistant U.S. Attorneys Joseph H. Thompson, Harry M. Jacobs, and Melinda A. Williams are prosecuting the case.
Defendant Information:
WAYNE ROBERT DAHL, JR., 51
Fridley, Minn.
Convicted:
- Mail fraud, 1 count

Two Individuals Charged with Armed Robbery of A Brooklyn Center HotelRead the Press Release
United States Attorney Erica H. MacDonald today announced a criminal complaint charging KEANU DEWONE ROSS, 28, and ANTOINETTE DENIECE MAE DOBYNE, 28, for their roles in the armed robbery of a Super 8 Hotel. ROSS and DOBYNE made their initial appearances before Magistrate Judge Katherine M. Menendez in U.S. District Court. ROSS was ordered to remain in custody pending a formal detention hearing, which is scheduled for Monday, July 20, 2020.
According to the allegations in the criminal complaint and law enforcement affidavit, on February 14, 2020, at approximately 2:30 a.m., officers with the Brooklyn Center Police Department (BCPD) responded to a report of an armed robbery at the Super 8 Hotel in Brooklyn Center, Minnesota. A hotel employee told BCPD officers that two men, both carrying firearms, ordered him to the ground at gunpoint and took his cell phone, car keys, and cash from the business, and then told him to run from the scene. As the employee fled on foot, he heard multiple gunshots. Officers recovered a discharged cartridge casing at the scene of the robbery. Surveillance camera footage showed two men committing the robbery as described by the employee. The footage also showed the two men running from the hotel toward an SUV and then fleeing on foot after the SUV got stuck in a snowbank. BCPD officers located DOBYNE in the SUV. Later that same day, ROSS called a BCPD detective to ask about the release of the SUV, identifying himself as the boyfriend of the SUV’s driver. ROSS also told the detective that his wallet and ID were in the middle glovebox of the SUV. During a subsequent search of the SUV, law enforcement discovered a wallet containing identification for ROSS.
According to the allegations in the criminal complaint and law enforcement affidavit, on February 14, 2020, at approximately 1:30 p.m., ROSS was detained during a traffic stop by officers with the Minneapolis Police Department. Officers confiscated a Taurus Model PT738 .380-caliber semiautomatic pistol that was found on ROSS’s person. Subsequent forensic analysis using the discharged cartridge casing recovered at the scene of the robbery revealed that the confiscated firearm was the same one that was fired at the Super 8 Hotel. Because ROSS has prior felony convictions, he is prohibited under federal law from possessing firearms or ammunition at any time.
This case was the result of an investigation conducted by the Federal Bureau of Investigation, the Bureau of Criminal Apprehension, the Brooklyn Center Police Department, and the Minneapolis Police Department. This case was brought as part of Project Safe Neighborhoods (PSN), an initiative that brings together federal, state, and local law enforcement to combat violent crime. Two Men Charged with Illegally Possessing FirearmsRead the Press Release
United States Attorney Erica H. MacDonald today announced a criminal complaint charging JARVAE JOSIAH SOMERVILLE, 27, and RONALD DONTE FINLEY, JR., 25, with one count each of possession of a firearm by a felon. SOMERVILLE and FINLEY made their initial appearances earlier today before Magistrate Judge Katherine M. Menendez in U.S. District Court in Minneapolis, Minnesota. The defendants were ordered to remain in custody pending a formal detention hearing, which is scheduled for Tuesday, July 14, 2020.
According to the allegations in the criminal complaint and law enforcement affidavit, investigators with the Minneapolis Police Department (MPD) determined that SOMERVILLE and FINLEY were suspects in a shooting that occurred on May 19, 2020, in North Minneapolis. While conducting surveillance on SOMERVILLE, MPD officers observed SOMERVILLE and FINLEY at a restaurant on Lake Street in Minneapolis. SOMERVILLE was inside the restaurant and FINLEY was outside near an Infinity sedan that the men were driving. Officers moved in to make an arrest. When officers approached FINLEY, FINLEY ran from the Infinity sedan but was apprehended and arrested. Inside the Infiniti sedan, officers found a Sig Sauer 9mm semi-automatic pistol. When officers entered the restaurant and attempted to arrest SOMERVILLE, SOMERVILLE ran inside a private bathroom in the back of the restaurant. An officer chasing SOMERVILLE followed SOMERVILLE inside, and SOMERVILLE reached into his waistband. Concerned that SOMERVILLE was reaching for a firearm, the officer grabbed SOMERVILLE’s hand, and the two men struggled until other officers arrived to assist. After SOMERVILLE was handcuffed and taken into custody, officers recovered from the floor of the bathroom a Glock, .45 caliber semi-automatic handgun with an extended magazine.
According to the allegations in the criminal complaint and law enforcement affidavit, later that day, officers executed a search warrant at SOMERVILLE’s residence and found a box of .45 caliber ammunition and a gun cleaning kit. On July 9, 2020, investigators confirmed that FINLEY’s fingerprints were present on the magazine of the 9mm pistol found in the Infiniti sedan. Because SOMERVILLE has prior felony convictions in Hennepin County and FINLEY has prior felony convictions in Cook County, Illinois, they are prohibited under federal law from possessing firearms or ammunition at any time.

Recent Federal Tax Prosecutions in Minnesota Serve as Reminder to File and Pay Taxes by July 15 DeadlineRead the Press Release
The U.S. Attorney’s Office and the Internal Revenue Service’s Criminal Investigation Division reminds all Minnesotans that this year’s deadline for filing federal income tax returns is Wednesday, July 15. Due to COVID-19, the original filing deadline and tax payment due date was postponed from April 15 to July 15. For people facing hardships, including those affected by COVID-19, who cannot pay in full, the IRS has several options available on IRS.gov/payments. IRS Criminal Investigation also encourages Minnesotans to be cautious of scam artists who are looking for ways to steal money and personal information. Stay alert! The IRS will not contact you by phone, email, or social media to ask for personal information.
“Although we are living through unprecedented times, Americans must still meet their tax obligations by filing returns accurately and timely,” stated U.S. Attorney Erica MacDonald. “Minnesotans must also be aware of wrongdoers who are looking for ways to exploit individuals, steal money, and cheat the system. Those individuals will be held accountable.”
“As the tax filing deadline quickly approaches, I am asking all citizens to file correct and accurate tax returns and to pay their share of taxes,” states Kathy A. Enstrom, Special Agent in Charge of the IRS Criminal Investigation Division who oversees the state of Minnesota. “We all pay when others cheat the government. IRS Criminal Investigation, together with the U.S. Attorney’s Office, works year-round to make certain that those who willfully defy the tax laws will be investigated and criminally prosecuted. Taxpayers are encouraged to visit the IRS.gov website for tips on filing a tax return accurately and searching for a reputable return preparer.”
As the tax filing season winds down next week, the U.S. Attorney’s Office and IRS Criminal Investigation encourage taxpayers to think before filing a false or fraudulent tax return and to be wary of any schemes that falsify income or deductions. The following court actions have occurred in the District of Minnesota over the last nine months.
In October 2019, LESSIE BEATRICE LINDSEY was sentenced to a year and a day in federal prison for filing a false claim and ordered to pay $995,966 in restitution to the IRS. From 2013 to 2016, LINDSEY submitted approximately 192 false and fraudulent income tax returns acting as a knowledgeable tax preparer and illegally demanding a share of the tax refunds from her clients. Over $200,000 of her false tax refunds were designed to benefit herself, her boyfriend, or her relatives. This case was prosecuted by Assistant U.S. Attorney Matthew S. Ebert.
In December 2019, RICHARD PETER HENTGES was sentenced on charges of aiding and assisting in the filing of a false tax return and ordered to pay $55,634 in restitution to the IRS. While employed as the Chief Financial Officer of a business located in Chaska, Minnesota, HENTGES was responsible for all aspects of operations and finances, including filing and paying payroll taxes. During 2013 and 2014, HENTGES failed to pay over the payroll taxes for some of the employees resulting in a $72,672.01 tax loss to the United States. This case was prosecuted by Assistant U.S. Attorney Amber M. Brennan.
In January 2020, WORAPHAK VANG was sentenced to 18 months in prison for tax evasion and was ordered to pay $1,351,985.05 in restitution to the IRS. While operating her temporary staffing agency that provided temporary workers to companies in the manufacturing field in and around Saint Paul, VANG committed payroll and income tax fraud totaling $1,351,985.05 over a period of four years. VANG failed to collect and pay over payroll taxes from her employees and underreported her own income on her personal tax returns. This case was prosecuted by Assistant U.S. Attorney Robert M. Lewis.
In January 2020, RANDAL SCOT BRINKMAN was sentenced to 46 months in prison and was ordered to pay $945,316 in restitution to the IRS. On July 25, 2019, following a four-day jury trial, BRINKMAN was found guilty on six counts of tax evasion. From 1999 through 2018, BRINKMAN, owner of a Roseville construction company, took steps to hide his income and actively evade the assessment of taxes, including using sham businesses, closing his personal bank accounts, using money orders and cash to pay for daily expenses, and creating a fake religious organization in order to hide his income and assets. This case was prosecuted by Assistant U.S. Attorneys Joseph H. Thompson and Alexander D. Chiquione.
In February 2020 and March 2020, MUHUMED ALI and FAYSAL SAYID each pleaded guilty to one count of income tax evasion. SAYID and ALI were co-owners of a company that provided adult day care services to individuals enrolled in the Minnesota Medicaid program. Between 2012 and 2014, SAYID and ALI removed approximately $1.3 million from the company’s operating accounts and used those funds to pay for personal, non-business expenses, such as clothing, rent for personal residences, vehicles, funds transfers to other parties, and international wire transfers. SAYID and ALI willfully attempted to evade and defeat income taxes due and owing on that money for tax years 2012, 2013, and 2014. SAYID and ALI are awaiting sentencing. This case is being prosecuted by Assistant U.S. Attorney Matthew S. Ebert.
In May 2020, RUSLAN FURMAN was sentenced to two years in prison for aggravated identity theft and ordered to pay $298,644 in restitution to the IRS. From 2013 through 2016, FURMAN, a salesperson at a vehicle dealership, conspired with VLADIMIR CHEVTAYEV, THOMAS POPLAR, and others to defraud financial institutions out of money through an elaborate auto-financing scheme. FURMAN and others committed the fraud by applying for financing using deceased buyer’s names, stolen identities, or by paying people for the use of their information to buy luxury vehicles. After receiving the loan proceeds, the conspirators laundered the funds through an auto financing company to make the transactions appear legitimate. Co-conspirators CHEVTAYEV and POPLAR have pleaded guilty and are awaiting sentencing. This case is being prosecuted by Assistant U.S. Attorney Julie E. Allyn.

United States Attorney Announces New Twin Cities Violent Crime Task ForceRead the Press Release
United States Attorney Erica H. MacDonald today announced the formation of a new Twin Cities Violent Crime Task Force (Task Force) in response to the extraordinary spike in gun violence and violent crime across the Twin Cities. The Task Force brings together additional federal and state resources to assist local law enforcement to investigate, arrest, and prosecute individuals responsible for gun violence in our communities.
The Task Force will serve as a coordination hub for intelligence and law enforcement operations focused on violent crime in the Twin Cities. Law enforcement partners will utilize the Task Force to maximize intelligence gathering and information sharing capabilities to ensure swift and precise identification of those individuals who are perpetrating violence.
“This increase in violence, particularly the shootings, is unacceptable and it must end – that is why I am launching a new Twin Cities Violent Crime Task Force to help turn the tide,” said U.S. Attorney Erica MacDonald. “The goal of this Task Force is not to flood our communities with law enforcement, but rather to leverage law enforcement’s collective resources to allow for focused and effective enforcement actions. Bringing safety and security back to our cities requires collaboration, and we need law enforcement, city leaders and community members all working together toward the common goal of bringing an end to this violence.”
The Task Force operates from a multi-agency command center and is comprised of federal agents and analysts from the FBI, Bureau of Alcohol, Tobacco, Firearms and Explosives, United States Secret Service, United States Marshals Service, Drug Enforcement Administration, the Minnesota Bureau of Criminal Apprehension, police officers from the Minneapolis and St. Paul Police Departments and deputies from the Hennepin, Ramsey and Dakota counties Sheriff’s Offices, as well as federal and state prosecutors.

Founder and CEO of Iranian Financial Services Firm Pleads Guilty to Conspiracy to Violate U.S. SanctionsRead the Press Release
Assistant Attorney General for National Security John C. Demers and U.S. Attorney Erica H. MacDonald today announced the guilty plea of Seyed Sajjad Shahidian, 33, for his role in conducting financial transactions in violation of U.S. sanctions against Iran. Shahidian, who was indicted on Dec.18, 2018, entered his guilty plea today to one count of conspiracy to commit offenses against and to defraud the United States before Judge Patrick J. Schiltz in U.S. District Court in Minneapolis, Minnesota.
Shahidian, a citizen of Iran, was arrested in London, England on Nov. 11, 2018. On May 15, 2020, Shahidian was extradited to the United States and had his initial appearance in the District of Minnesota on May 18, 2020.
According to the defendant’s guilty plea and documents filed in court, Payment24 was an internet-based financial services company with approximately 40 employees and offices in Tehran, Shiraz, and Isfahan, Iran. The primary business of Payment24 was helping Iranian citizens conduct prohibited financial transactions with businesses based in the United States, including the unlawful purchase and exportation of computer software, software licenses, and computer servers from United States companies. According to Payment24’s website, the company charged a fee to circumvent “American sanctions,” and claimed to have brought in millions of dollars of foreign currency into Iran.
According to the defendant’s guilty plea and documents filed in court, Shahidian, the founder and former Chief Executive Officer of Payment24, co-conspirator Vahid Vali, and other individuals violated the restrictions on trade and exports from the United States to Iran. On its website, Payment24 sold a package to assist its Iranian clients with making online purchases from United States-based businesses, which included a PayPal account, a fraudulent “ID card and address receipt,” a remote IP address from the United Arab Emirates, and a Visa gift card. The Payment24 website also offered its clients advice on how to create accounts with a foreign identity and how to avoid restrictions on foreign websites, including advising clients to “never attempt to log into those sites with an Iranian IP address.”
According to the defendant’s guilty plea and documents filed in court, Shahidian admitted to making material misrepresentations and omissions to United States-based businesses regarding the destination of the United States-origin goods. In order to accomplish the transactions, Shahidian obtained payment processing accounts from United States-based companies like PayPal using fraudulent passports and other false residency documentation to falsely represent that his customers resided outside of Iran. Shahidian admitted to opening hundreds of PayPal accounts on behalf of his Payment24 customers who resided in Iran and to unlawfully bringing millions of U.S. dollars into the economy of Iran.
Pursuant to the International Emergency Economic Powers Act (IEEPA), unauthorized exports of goods, technology or services to Iran, directly or indirectly from the United States or by a United States person are prohibited.
This case is the result of an investigation conducted by the Minneapolis Division of the FBI. The U.S. Attorney’s Office for the District of Minnesota, the U.S. Department of Justice, and the FBI are particularly grateful for the substantial assistance provided by law enforcement authorities in the United Kingdom, including the National Crime Agency and London Metropolitan Police, in connection with the arrest and extradition in this matter.
