Ross announced today that Wilfredo Sanchez, 25, of Rochester, NY, who was convicted of possession with intent to distribute 10 grams or more of a fentanyl analogue and possession of a firearm and ammunition by a convicted felon, was sentenced to serve 168 months in prison by U.S. District Judge Charles J. Siragusa.
Assistant U.S. Attorney Charles Moynihan, who handled the case, stated that Sanchez was arrested on March 23, 2021, following a search of his Saranac Street residence, during which investigators seized over 88 grams of para-flourofentanyl, an analogue of fentanyl, and over 64 grams of cocaine. A loaded 9mm semiautomatic pistol, ammunition, digital scales, and drug packaging material were also recovered. At the time of his arrest, Sanchez was on supervised release after serving five years in prison following a March 2017 federal conviction for possessing a firearm in furtherance of drug trafficking.
The matter was brought by the United States Attorney’s Office as part of its Project Safe Neighborhoods (PSN) initiative. PSN is the centerpiece of the Department of Justice’s violent crime reduction efforts. PSN is an evidence-based program proven to be effective at reducing violent crime. Through PSN, a broad spectrum of stakeholders work together to identify the most pressing violent crime problems in the community and develop comprehensive solutions to address them. As part of this strategy, PSN focuses enforcement efforts on the most violent offenders and partners with locally based prevention and reentry programs for lasting reductions in crime.The sentencing was the result of an investigation by the Rochester Police Department, under the direction of Chief David Smith and the Bureau of Alcohol, Tobacco, Firearms, and Explosives, New York Field Division, under the direction of Special Agent-in-Charge John B. Federal Grand Jury Indicts Accused Tops Shooter on Federal Hate Crimes and Firearms Charges in Buffalo, New YorkRead the Press Release
A federal grand jury today returned a 27-count indictment charging Payton Gendron, 19, of Conklin, New York, with 14 violations of the Matthew Shepard and James Byrd Jr. Hate Crimes Prevention Act (Shepard-Byrd Act) and 13 firearms offenses in connection with the mass shooting at the Tops grocery store on Jefferson Avenue in Buffalo, New York. The announcement was made by Attorney General Merrick B. Garland, Assistant Attorney General Kristen Clarke for the Justice Department's Civil Rights Division, U.S. Attorney Trini E. Ross for the Western District of New York, and Special Agent-in-Charge Stephen Belongia of the FBI Buffalo Field Office.
The indictment alleges that on or about May 14, Gendron opened fire with a Bushmaster XM rifle and shot multiple individuals in and around the Tops grocery store, which resulted in the deaths of 10 Black people, as well as injury to three others. The indictment charges that Gendron violated the Shepard-Byrd Act by willfully causing the death of the victims because of their actual and perceived race and color.
In total, the 27-count indictment charges Gendron with 10 counts of hate crimes resulting in death, three counts of hate crimes involving an attempt to kill three injured individuals, and one hate crimes count alleging that Gendron attempted to kill additional Black people in and around the Tops grocery store. The indictment also charges Gendron with 13 counts of using, carrying, or discharging a firearm in relation to the hate crimes, and seeks forfeiture of items, including the weapon used in the shooting. The indictment further includes special findings alleging, among other things, that Gendron committed the offense after substantial planning and premeditation to commit an act of terrorism.
“Today, a grand jury has indicted Payton Gendron with hate crime and firearms offenses following the horrific attack on the Black community of Buffalo that killed 10 people and injured three others on May 14, 2022,” said Attorney General Garland. “The Justice Department fully recognizes the threat that white supremacist violence poses to the safety of the American people and American democracy. We will continue to be relentless in our efforts to combat hate crimes, to support the communities terrorized by them, and to hold accountable those who perpetrate them.”
Upon conviction, the charges in the indictment carry a maximum penalty of life imprisonment or the death penalty. The Attorney General will decide whether to seek the death penalty at a later time. Should the Attorney General determine that the circumstances of the offense are such that a sentence of death is justified, the law requires that notice be filed with the court at a reasonable time before trial. Gendron is currently in state custody pending state criminal charges.

Man Arrested, Charged with Assaulting an FBI AgentRead the Press Release

FAX #: (716) 551-3051BUFFALO, N.Y. - U.S. Attorney Trini E. Ross announced today that Tyler Collins, 27, of Buffalo, NY, was arrested and charged by criminal complaint with assaulting a federal officer. The charge carries a maximum penalty of eight years in prison.
Assistant U.S. Attorney Franz M. Wright, who is handling the case, stated that according to the complaint, on July 12, 2022, at approximately 4:00 p.m., Collins attempted to enter the FBI-Buffalo Division main office but was denied entry by the security guards inside of the front door. At the time, three federal agents were walking back to the main office and encountered Collins, who they observed was yelling into the intercom system. Collins was heard yelling “You are screwing with me! The FBI is screwing with me!” One of the federal agents approached Collins and attempted to calm him down, at which time Collins punched the federal agent, physically assaulting him. One of the other federal agents discharged pepper spray, in an attempt to subdue Collins, who then fled on Elmwood Avenue. Approximately an hour later, Collins was taken into custody as he was walking on Delaware Avenue.
The criminal complaint is the result of an investigation by the Federal Bureau of Investigation, under the direction of Special Agent-in-Charge Stephen Belongia, and the Buffalo Police Department, under the direction of Commissioner Joseph Gramaglia.
The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty.

Jamestown Man Going to Prison for Selling FentanylRead the Press Release

Ross announced today that Alfredo Diaz a/k/a Dindo, 59, of Jamestown, NY, who was convicted of possession with intent to distribute, and to distribute, fentanyl, was sentenced to serve 70 months in prison by U.S. District Judge Lawrence J. Vilardo.
Assistant U.S. Attorneys Michael J. Adler and Evan K. Glaberson, who handled the case, stated that in April 2020, investigators conducted three controlled purchases of fentanyl from Diaz. On May 13, 2020, searches were conducted of both Diaz’s residence as well as a storage unit he used. In the residence, investigators located approximately $8,000 in U.S. currency as well as drug distribution paraphernalia, including glassine bags and a digital scale. In the storage unit, a black 2016 Cadillac SRX sport utility vehicle registered to Diaz, as well as approximately $44,075 U.S. currency, was seized. The vehicle also contained a digital scale and packaging material.

Four Time Convicted Felon Going to Prison for Gun PossessionRead the Press Release

FAX #: (716) 551-3051ROCHESTER, N.Y.-U.S. Attorney Trini E. Ross announced today that Roosevelt E. Collins, III, 40, of Rochester, NY, who was convicted of being a felon in possession of a firearm and ammunition, was sentenced to serve 18 months in prison by U.S. District Judge Charles J. Siragusa.
Assistant U.S. Attorney Cassie Kocher, who handled the case, stated that Collins was previously convicted on felony charges in 2001, 2005, 2010, and 2015, in Monroe County Court, and is legally prohibited from possessing a firearm. On July 26, 2021, members of the U.S. Marshals Task Force were surveilling Collins, who was wanted in connection with an alleged shooting incident on July 2, 2021. Officers took Collins into custody while he was sitting in a vehicle parked in a driveway on Magee Avenue. During the arrest, officers observed a loaded 9mm semiautomatic pistol in plain view on the floor of the front passenger seat. Collins also had a magazine loaded with 12 additional rounds of ammunition on his person.

Buffalo Man Pleads Guilty to Narcotics ConspiracyRead the Press Release

Ross announced today that Steven Gonzalez a/k/a Steven Hernandez, a/k/a Steve, a/k/a Stevie, a/k/a Unc, 46, of Buffalo, NY, pleaded guilty before U.S. District Judge Richard J. Arcara to narcotics conspiracy. The charge carries a maximum penalty of 20 years in prison and a fine of $1,000,000.
Assistant U.S. Attorneys Joshua A. Violanti, Misha A. Coulson, and Joseph M. Tripi, who are handling the case stated that between June 2019, and September 2019, Gonzalez conspired with others to sell heroin, fentanyl, and acetyl fentanyl. During the conspiracy, Gonzalez sold quantities of heroin and fentanyl for profit, with the assistance of a known co-conspirator identified CC-1. CC-1 arranged drug deals and drove Gonzalez to drug deals, and Gonzalez provided CC-1 with heroin/fentanyl for CC-1’s personal use. On July 17, 2019, CC-1 made a controlled call to Gonzalez regarding CC-1’s sworn testimony related to the overdose of a person identified as L.K. CC-1 told Gonzalez that CC-1 believed that investigators did not believe CC-1’s false story accusing a source of supply named “Freddy.” Gonzelez told CC-1 to “stick to the same story that you’ve been telling them.”
On September 24, 2019, investigators executed a search warrant at West Avenue residence, during which they recovered approximately 19 grams of heroin from Gonzalez’s possession. Gonzalez utilized the West Avenue residence to facilitate his drug trafficking activities.
In April 2022, Gonzalez was indicted by a federal grand jury on charges of conspiracy to commit sex trafficking, sex trafficking of a minor, sex trafficking by coercion, and drug distribution charges. Those charges remain pending.
The plea is the result of an investigation by the Drug Enforcement Administration, under the direction of Special Agent-in-Charge Frank A. Tarentino III, New York Field Division, the New York State Police, under the direction of Major Eugene Staniszewski, and the Buffalo Police Department, under the direction of Commissioner Joseph Gramaglia.
Sentencing will be scheduled at a later date.

Buffalo Man Pleads Guilty to Bank RobberyRead the Press Release

FAX #: (716) 551-3051BUFFALO, N.Y.-U.S. Attorney Trini E. Ross announced today that Anthony Wilson, 34, of Buffalo, NY, pleaded guilty before U.S. District Judge Richard J. Arcara to aggravated bank robbery and possession of a firearm in furtherance of a crime of violence. The charges carry a mandatory minimum penalty of five years in prison, a maximum penalty of life and a $250,000.
Assistant U.S. Attorney Joshua A. Violanti, who is handling the case, stated that on the morning of October 26, 2017, Wilson and co-defendants Adrian D. Applewhite and Khalil Holland, traveled to Angola, NY to rob the Lakeshore Federal Credit Union on Erie Road. Defendant Holland entered the Lakeshore Federal Credit Union wearing a mask and brandishing a semi-automatic pistol given to him by Wilson, while Wilson waited in a car nearby. Holland approached the teller and demanded money; however, the alarm was activated, and Holland left without taking any money. Holland fled on foot and was arrested shortly thereafter. During the pursuit, Holland discarded the pistol.
Defendant Applewhite was previously convicted in federal court and is awaiting sentencing. Defendant Holland was previously convicted and sentenced in New York State Court.
The plea is the result of an investigation by the New York State Police, under the direction of Major Eugene Staniszewski; the Federal Bureau of Investigation, under the direction of Special Agent-in-Charge Stephen Belongia; the Lackawanna Police Department, under the direction of Chief Mark Packard; the Evans Police Department, under the direction of Chief Douglas J. Czora; the Tonawanda Police Department, under the direction of Chief James P. Stauffiger; and the Erie County District Attorney’s Office, under the direction of District Attorney John Flynn.
Sentencing is scheduled for November 23, 2022, before Judge Arcara.

Spencerport Man Who Attempted to Have Sex with A Minor Going to Prison for 10 YearsRead the Press Release

Ross announced today that Dale Trimmer, 47, of Spencerport, NY, who was convicted of attempted receipt of child pornography, was sentenced to serve 121 months in prison and 10 years supervised release by U.S. District Judge Frank P. Geraci, Jr.
Assistant U.S. Attorney Kyle P. Rossi, who handled the case, stated that beginning in December 2020, Trimmer used a chat application to attempt to communicate with minors online, including a person he believed was a 13-year-old girl, but was actually an undercover law enforcement officer. Trimmer was repeatedly informed that the child was only 13 and lived with her mother. Despite this, he engaged in sexually explicit conversations with the child, told her that he wanted to have sex with her, and attempted to solicit sexually explicit photographs. At one point, Trimmer attempted to conduct a live video chat with the child and sent the child a sexually explicit video of himself. Trimmer also sent the child photographs of gifts that he bought for the child. As the conversations continued, Trimmer discussed meeting the child for sex as well as plans for how they could carry on a sexual relationship. Trimmer was arrested on February 17, 2021.
During the investigation, investigators learned that in 2006, Trimmer was convicted in New York State Court of Disseminating Indecent Material to Minors and sentenced to serve six months in the Monroe County Jail followed by five years’ probation. Trimmer subsequently violated the terms of probation and was re-sentenced to serve one to three years in prison. In that case, Trimmer also used an online chat application to engage in sexually explicit online conversations with a person he believed was a 14-year-old female but was actually an undercover Monroe County Sheriff’s Office investigator. During those chats, Trimmer told the undercover investigator that he previously had sex with at least two minors in the past, and that he wanted to meet the minor for sex. The defendant was arrested after attempting to meet the minor in person.
The sentencing is the result of an investigation by the Federal Bureau of Investigation Child Exploitation Task Force, under the direction of Special Agent-in-Charge Stephen Belongia and the Monroe County Sheriff’s Office, under the direction of Sheriff Todd Baxter.

Rochester Man Pleads Guilty to Rioting During Rochester Civil Unrest in May 2020Read the Press Release

FAX #: (716) 551-3051ROCHESTER, N.Y. - U.S. Attorney Trini E. Ross announced today that Marquis Frasier, 29, of Rochester, NY, pleaded guilty before U.S. District Judge Charles J. Siragusa to rioting, which carries a maximum penalty of five years in prison, and a $250,000 fine.
Assistant U.S. Attorney Cassie M. Kocher, who is handling the case, stated that on May 30, 2020, Frasier participated with others in a public protest near the Public Safety Building on Exchange Street in Rochester, which turned violent and resulted in vandalism, damaged property, looting, and fires. During the course of the protest, Frasier and others set fire to a mobile office located across the street from the Public Safety Building. Frasier assisted in lighting the mobile office on fire by throwing a bottle containing an accelerant and a rag into the mobile office. The burning of the mobile office was broadcast and recorded on Facebook Live, which streamed the burning of the mobile office online in real time. The mobile office was completely destroyed by fire.

Rochester Man Going to Prison for More Than 15 Years for His Role in Drug ConspiracyRead the Press Release

Ross announced today that Jonathan Torres aka Joey aka Joey Crack, 42, of Rochester, NY, who was convicted of conspiracy to possess with intent to distribute more than 40 grams of fentanyl, was sentenced to serve 188 months in prison by U.S. District Judge David G. Larimer.
Assistant U.S. Attorney Cassie Kocher, who handled the case, stated that between April and November 28, 2018, Torres conspired with others to sell fentanyl and cocaine in the Wilkins Street area in Rochester. Torres supplied fentanyl and cocaine to individuals who would then distribute the drugs to customers. Torres also acted as a supervisor by monitoring the quantities of fentanyl and cocaine sold, directing the sales by others, re-supplying street-level workers, and supervising street-level workers who sold the drugs. At least one of the street-level workers was less than 18 years old. Torres used his Raines Park residence to store, package, and manufacture the fentanyl and cocaine for sale.

Ross announced today that Jesus Santiago, 32, of Rochester, NY, was arrested and charged by criminal complaint with possession with intent to distribute marijuana, being a felon in possession of a firearm and ammunition, and possession of a firearm in furtherance of a drug trafficking crime. The charges carry a maximum penalty of life in prison and a $1,000,000 fine.
Assistant U.S. Attorney Cassie Kocher, who is handling the case, stated that on June 23, 2022, U.S. Probation Officers searched Santiago’s residence on Glide Street in Rochester, during which they recovered a loaded semi-automatic handgun, ammunition, a quantity of marijuana, and drug packaging materials. Santiago was previously convicted in 2016 in Erie County Court and in 2019 in the Western District of New York on firearms charges and is legally prohibited from possessing a firearm and ammunition.
Santiago made an initial appearance this morning before U.S. Magistrate Judge Mark W. Pedersen and was detained.
The criminal complaint is the result of an investigation by U.S. Marshal’s Task Force, under the direction of Marshal Charles Salina, the U.S. Probation Department, under the director of Chief Probation Officer Timothy Englert, and the Bureau of Alcohol, Tobacco, Firearms, and Explosives, under the direction of Special Agent-in-Charge John DeVito, New York Field Division.

Hartford, who handled the case, stated that over the course of four days in August 2019, Tyo robbed a bank in Brighton, NY; a bank in Buffalo, NY; and attempted to rob a third bank in Niagara Falls, NY:• On August 24, 2019, Tyo robbed the Citizens Bank inside the Tops Market on South Clinton Avenue in Brighton. Tyo gave the bank teller a detailed note that said, “if I even glimpse a dye-pack I will not hesitate to elevate the situation and you will be the first casualty.” The bank teller complied with Tyo’s demands and gave him U.S. currency, which Tyo took and fled the bank.
• On August 27, 2019, Tyo robbed a second Citizens Bank inside the Tops Market on South Park Avenue in Buffalo. He gave the bank teller a note demanding $50 and $100 bills and threatened the use of violence, stating in the note that he would use his gun if the teller did not cooperate. The teller complied and gave the defendant U.S. currency, which Tyo took and fled the bank.
• Also on August 27, 2019, Tyo attempted to rob a third bank, the Key Bank on Niagara Falls Boulevard in Niagara Falls. However, when he gave the teller a demand note, the teller said that they were dealing with a computer issue, and Tyo did not succeed in obtaining any money.The sentencing is the result of an investigation by the Brighton Police Department, under the direction of Chief Dave Catholdi, and the Federal Bureau of Investigation, under the direction of Special Agent-in-Charge Stephen Belongia.

Ross announced today that Eric Iwu aka James, 32, a Nigerian citizen currently residing in Buffalo, NY, pleaded guilty to structuring transactions to evade reporting requirements before U.S. District Judge Lawrence J. Vilardo. The charge carries a maximum penalty of five years in prison and a $250,000 fine.
Assistant U.S. Attorney Charles M. Kruly, who is handling the case, stated that in June 2019, a company called Reliancee Industry LLC was registered with the New York State Division of Corporations. One day later, with Iwu’s assistance, a KeyBank account was opened in the name of Reliancee Industry LLC. In August 2019, three separate deposits of $58,019.76, $54,522.28, and $51,989.54 were made into the account. After each deposit was made, multiple cash withdrawals were then made on different dates, all under $10,000, by an individual being directed by Iwu. Iwu directed the individual to withdraw the sums of cash on different dates knowing that KeyBank was legally obligated to report currency transactions in excess of $10,000. Iwu did so with the intent to evade that reporting requirement.
Iwu also admitted his role in opening bank accounts that received fraud proceeds from four victim companies located in the United Arab Emirates, United Kingdom, Singapore, and California, totaling approximately $760,000.
The plea is the result of an investigation by Homeland Security Investigations, under the direction of Acting Special Agent-in-Charge Matthew Scarpino.
Sentencing is scheduled for October 19, 2022, before Judge Vilardo.

Sinatra, Jr. to transportation and attempted transportation of a minor with the intent to engage in criminal sexual activity. The charge carries a mandatory minimum penalty of 10 years in prison, a maximum of life, and a $250,000 fine.
Assistant U.S. Attorneys Maeve E. Huggins, Paul E. Bonanno, and Jonathan P. Cantil, who are handling the case, stated that beginning in 2012, and for several years after, Turnquist sexually abused a minor female victim (Victim) who was known to Turnquist. The sexual abuse occurred in New York State and in other states, including Pennsylvania, and in Canada. For example, on December 23, 2014, Turnquist transported the Victim, a then 16-year-old minor female, from New York to Pennsylvania, to engage in sexual activity.

Assistant U.S. Attorney Michael J. Adler, who is handling the case, stated that according to the indictment, on December 30, 2021, Robbins stole quantities of oxycodone and hydrocodone, both Schedule II controlled substances, from the Rite Aid on Genesee Street in Buffalo.
Robbins, a former associate of the Schuele Boys Gang, was convicted of conspiracy to distribute cocaine and sentenced to serve 24 months in prison in 2017.
The defendant was arraigned before U.S. Magistrate Judge Jeremiah J. McCarthy and released on conditions.

The charges carry a mandatory minimum penalty of 30 years in prison, a maximum of life, and a 1,000,000 fine.
Assistant U.S. Attorneys Misha A. Coulson and Michael J. Adler, who are handling the case, stated that according to the indictment, on August 30, 2018, Medina sold acetyl fentanyl which resulted in the death of an individual identified as J.H. On September 9, 2018, Medina sold heroin, acetyl fentanyl, and fentanyl, which resulted in the death of an individual identified as J.T.
The indictment further states that:
• Medina conspired with others to sell heroin, fentanyl and cocaine;
• Used a residence on Euclid Avenue in Jamestown to conduct his drug trafficking activities; and
• Possessed firearms while conducting drug trafficking activities. In May 2015, Medina was convicted on a gun charge in Chautauqua County Court and is legally prohibited from possession firearms and ammunition.
Medina was arraigned today before U.S. Magistrate Judge H. Kenneth Schroeder, Jr. and was detained.

Buffalo Man Pleads Guilty to Multiple Drug, Gun and COVID-19 Fraud CrimesRead the Press Release

Ross announced today that Joseph Bella, 49, of Buffalo, NY, pleaded guilty to possession with intent to distribute cocaine, being a drug user in possession of a firearm, and wire fraud before U.S. District Judge Richard J. Arcara. The charges carry a maximum penalty of 20 years in prison, and a fine of $1,000,000.
Assistant U.S. Attorneys David J. Rudroff and Nicholas T. Cooper, who are handling the case, stated that on April 23, 2020, investigators executed a search warrant at Bella’s residence and recovered drug paraphernalia and quantities of cocaine, MDMA, and marijuana. Investigators also recovered a 12-gauge shotgun and ammunition. At that time, Bella was an unlawful user of controlled substances, including marijuana and cocaine.
In addition, Bella defrauded a Salt Lake City, Utah, corporation (Victim) that developed and manufactured COVID-19 test kits, by falsely representing that his company, Medcor Staffing, Inc., was laboratory certified to perform high-complexity molecular testing, that Medcor was an “end-user” of the tests, and that Medcor would not attempt to resell them. As a result, the Victim sold Bella 5,000 COVID-19 tests that he could not safely and accurately process, could not provide end-user support for, and, in fact, intended to re-sell at a substantial mark-up.
In March 2020, Bella advertised on his personal Facebook account that he was selling “FDA approved COVID-19 Test Kits.” In April 2020, Bella communicated with an undercover federal agent by telephone, text message, and email, falsely telling the agent that he had 50,000 COVID-19 tests for sale; that the COVID-19 tests were being stored in a warehouse in San Diego, California at -20 degrees Celsius; that Medcor was an “exclusive licensed reseller” of the tests; and that Medcor employed doctors and scientists to answer customers' questions. Bella attempted to sell the tests to the agent for $30 per test, or more, after fraudulently obtaining the tests for only $8 apiece.
Bella also fraudulently obtained a loan from the Small Business Association under the Economic Injury Disaster Loan (EIDL) Program, which is designed to provide low-interest loans to qualifying small businesses to help them meet financial obligations and operating expenses in the event of a disaster. At Bella’s direction, a subordinate submitted a falsified application for a loan under the EIDL Program for another business Bella owns called BuyMyCard, a purchaser and re-seller of gift cards. The application grossly inflated BuyMyCard’s annual revenue, grossly underreported BuyMyCard’s annual expenses, and falsely stated that Bella was not subject to formal criminal charges at the time of the application. As a result of the falsified application, the SBA approved and funded a $149,900 loan to BuyMyCard under the EIDL Program.

Sinatra, Jr. to receipt of child pornography. The charge carries a mandatory minimum penalty of five years in prison, a maximum of 20 years in prison and a $250,000 fine.
Assistant U.S. Attorney Laura A. Higgins, who is handling the case, stated that in August 2020, a parent filed a report with the Town of Tonawanda Police Department, alleging that Rubel had been texting his daughter, who recently turned 16 years-old (Victim), and that some of the texts he observed were sexual in nature. The parent observed inappropriate images on his daughter’s cell phone within a text thread between the Victim and Rubel. With the consent of the Victim’s father, an investigator searched the cell phone and observed the text messages, some of which included sexual images. Investigators also searched Rubel’s cell phone and recovered sexual images, including two videos, that were also found on the Victim’s cell phone, within the string of text messages between Ruble and the Victim.
The plea is the result of an investigation by the Town of Tonawanda Police Department, under the direction of Chief James Stauffiger and the Federal Bureau of Investigation, under the direction of Special Agent-in-Charge Stephen Belongia.

Ross announced today that Vanessa Rondeau, 27, of Montreal, Quebec, who was convicted of trafficking in protected wildlife, was sentenced to time served and one year supervise release by U.S. District Judge Lawrence J. Vilardo. Rondeau was also ordered to pay restitution totaling $1,364 to the United States Fish and Wildlife Service and a $40,000 criminal fine.
Assistant U.S. Attorney Aaron J. Mango, who handling the case, stated that on January 13, 2020, during online communications with an undercover U.S. Fish and Wildlife Service (FWS) Special Agent, Rondeau agreed to sell a polar bear skull to the agent for $780 USD. On January 24, 2020, Rondeau entered the U.S. at the Champlain, NY port of entry with the polar bear skull in violation of the Endangered Species Act and proceeded to a third-party shipping business to send the polar bear skull to the agent in Amherst, NY. The agent received the package on February 2, 2020. On January 26, 2021, Rondeau again communicated with the agent and agreed to sell another polar bear skull for $584.11 USD. On February 11, 2021, the agent received a Canada Post package from Rondeau which was labeled as “1 Cadre,” which is the French word for “frame.”
Rondeau also illegally trafficked in other protected wildlife by shipping and/or bringing wildlife from Canada to the United States without being declared to the FWS. The total value of the wildlife illegally trafficked by Rondeau was approximately $37,204.
The sentencing is the result of an investigation by the United States Fish and Wildlife Service, under the direction of Ryan Noel, Special Agent-in-Charge of the USFWS-Office of Law Enforcement North-Atlantic Appalachian Region. The charges carry a maximum penalty of life in prison and a $1,000,000 fine.
Assistant U.S. Attorney Cassie Kocher, who is handling the case, stated that according to the complaint, on April 29, 2022, Rochester Police officers responded to the area of 212 Saratoga Street for a report of four gunshots being fired in the area. While driving to the area, an officer observed a male that he knew from previous contacts as James, who was found to be in possession of a revolver that contained a live round of ammunition and four spent or empty casings in the cylinder. James also possessed 34 small bags of suspected cocaine. James was convicted in February 2015, in Monroe County Court of Criminal Possession of a Weapon in the Second Degree and Assault in the Second degree and is legally prohibited from possessing a firearm.
James made an initial appearance before U.S. Magistrate Judge Mark W. Pedersen and is being detained.

Ross announced today that Michael Angstenberger, 46, of North Tonawanda, NY, was arrested and charged by criminal complaint with possession and receipt of child pornography. The charges carry a mandatory minimum sentence of five years in prison, a maximum of 20 years, and a $250,000 fine.
Assistant U.S. Attorney Charles M. Kruly, who is handling the case, stated that according to the complaint, in March 2022, the FBI received a tip from the National Center for Missing and Exploited Children stating that in late November 2021, a Snapchat user, later identified as Angstenberger, shared or sent two videos containing child pornography. On April 7, 2022, the FBI executed a search warrant at Angstenberger’s residence and seized a Samsung smart phone and Samsung tablet. A review of the phone and tablet recovered approximately 189 images and 13 videos containing child pornography.
Angstenberger made an initial appearance this afternoon before U.S. Magistrate Judge Jonathan W. Feldman and was released on conditions, including home detention with location monitoring.

Violanti, who is handling the case, stated that according to the indictment, between January 2019, and June 2022, Knapp conspired with others to sell heroin, methamphetamine, and fentanyl. On August 13, 2020, Knapp sold a controlled substance that caused serious bodily injury to an individual identified as M.H. During the conspiracy, Knapp used a 9th Street residence for his drug trafficking activities.

Ross announced today that Travis Sanders, 36, of Jamestown, NY, who was convicted of possession of child pornography involving a prepubescent minor, was sentenced to serve 96 months in prison and 10 years supervised release by U.S. District Judge Richard J. Arcara.
Assistant U.S. Attorney Laura A. Higgins, who handled the case, stated that in November 2017, Sanders possessed a laptop that contained 151 images of child pornography, including one image that depicted the sexual abuse or exploitation of an infant or toddler. During a search of the laptop and Sanders’ iPhone, investigators also discovered sexually explicit online contact between Sanders and various victims, who were or appeared to be minors. Sanders admitted that he sometimes told victims that he was a 15-year-old boy. On November 29, 2017, after Homeland Security Investigations informed Sanders that he was under investigation for sending child pornography via Skype, and after requesting to see Sander’s phone, Sanders deleted the Skype application from his iPhone.

Assistant U.S. Attorney Matthew T. McGrath, who is handling the case, stated that during the summer of 2021, Homeland Security Investigations and the Greater Rochester Area Narcotics Enforcement Team began investigating Wilson’s drug trafficking activities after learning that he sold fentanyl to an individual, who then overdosed on the drugs. In October 2021 investigators executed a search warrant at Wilson’s Wolfert Terrace residence in Rochester, which resulted in the seizure of fentanyl and cocaine packaged for street sale, a loaded firearm, drug packaging paraphernalia and U.S. currency.
The plea is the culmination of an investigation by Homeland Security Investigations, under the direction of Acting Special Agent-in-Charge Matthew Scarpino, the Greater Rochester Area Narcotics Enforcement Team, the Rochester Police Department, under the direction of Interim Chief David Smith, the Brighton Police Department, under the direction of Chief David Catholdi and the Monroe County Sheriff’s Office, under the direction of Sheriff Todd Baxter.

Ross announced today that Mark Rogers, 39, and Joseph Way a/k/a Gus, 36, both of Rochester, NY, who were convicted of kidnapping a federal employee, were sentenced by U.S. District Judge Frank P. Geraci, Jr. Rogers was sentenced serve 210 months in prison and Way was sentenced to serve 168 months in prison. A third defendant, Tashara Levans, who was also convicted of kidnapping a federal employee, is scheduled to be sentenced July 8.
Assistant U.S. Attorney Robert A. Marangola, who handled the case, stated that on November 16, 2019, in the area of Second Street and Central Park in Rochester, the defendants kidnapped a U.S. Postal Service mail carrier while she was delivering mail. Rogers and Way confronted the mail carrier about a package she delivered to them. The package did not contain cocaine, which Rogers and Way were expecting, and the two men accused the mail carrier of taking the narcotics. Rogers and Way directed the mail carrier to a vehicle driven by Rogers’ girlfriend Tashara Levans. Over the next two hours, Levans drove Rogers and Way as they threatened to shoot and kill the mail carrier and her children if she did not provide either the cocaine, they believed she had stolen, or $70,000, which was the street value of the cocaine. Eventually, the mail carrier was released unharmed.
Today’s sentencings are the result of an investigation by U.S. Postal Inspection Service, under the direction of Inspector-in-Charge Ketty Larco-Ward, Boston Division, and the Rochester Police Department, under the direction of Interim Chief David Smith.

Sinatra, Jr. to possession of child pornography. The charge carries a maximum penalty of 20 years in prison, and a $250,000 fine.
Assistant U.S. Attorney Aaron J. Mango, who handled the case, stated that on June 28, 2021, Scherer, a teacher for approximately 25 years in the Montgomery County (Maryland) Public Schools, arrived at a local grocery store to meet what he believed was a 13-year-old female. Scherer had been communicating online with the supposed 13-year-old girl for approximately two months, during which they discussed different sexual acts. When Scherer arrived, he was confronted by a concerned citizen who had been posing online as the 13-year-old female. Law enforcement officers were notified of the incident and Scherer was arrested. A search of Scherer’s cellular telephone resulted in the seizure of an image of child pornography.
The criminal plea is the result of an investigation by the Federal Bureau of Investigation, under the direction of Stephen Belongia, Special Agent-in-Charge, the Buffalo Police Department, under the direction of Commissioner Joseph Gramaglia, and the Cheektowaga Police Department, under the direction of Chief Brian Gould.

Federal Jury Convicts Rochester Man of Drug Conspiracy and Selling Cocaine and FentanylRead the Press Release

Ross announced today that following a four-week trial, a federal jury has convicted Earnest Baker, 36, of Rochester, NY, of conspiracy to possess with intent to distribute and distributing cocaine and 40 grams or more of fentanyl and distributing cocaine and fentanyl.
Assistant U.S. Attorneys Everardo Rodriguez and Matthew T. McGrath, who handled the prosecution of the case, stated that the investigation into the conspiracy began in 2018, while Baker was in federal prison, serving his sentence on a prior drug conviction. Baker was released in August 2019 on federal supervised release and New York State parole, and quickly returned to drug dealing activities. During the course of the investigation, Drug Enforcement Administration Special Agents made two controlled purchases of narcotics from Baker and used various investigative techniques to surveil Baker’s drug dealing activities and his interactions with other drug dealers with whom he conspired.
Baker was arrested on April 30, 2020, along with 17 other defendants. That same day, search warrants were executed at 24 residences in Rochester, West Henrietta, Penfield, Greece, Irondequoit, and Syracuse, and on 12 cars associated with defendants. During the execution of those search warrants, investigators seized eight firearms; approximately 3.5 kilograms of fentanyl; approximately two kilograms of cocaine and crack cocaine, and $928,400 in cash and over $500,000 worth of jewelry.
The trial of the remaining co-defendants is scheduled for January 2023.

Assistant U.S. Attorney Jeremiah E. Lenihan, who is handling the case, stated that on July 7, 2021, at approximately 10:00 p.m., law enforcement officers encountered Mills in Salamanca, NY, and executed a search warrant of his vehicle and residence. Located in a bag Mills wore around his shoulder, officers found and seized a loaded .22 caliber semi-automatic pistol, a digital scale, and a flip phone. After being transported to the police station, officers located a quantity of cocaine, which Mills attempted to swallow.

Wrapped around Jackson’s ankle, officers found quantities of methamphetamine and cocaine.

Accused Tops Shooter Charged with Federal Hate Crimes and Using a Firearm to Commit MurderRead the Press Release
Today, Payton Gendron, 18, of Conklin, New York, was charged by criminal complaint with hate crimes resulting in death and hate crimes involving bodily injury and attempt to kill, use of a firearm to commit murder during and in relation to a crime of violence, and use and discharge of a firearm during and in relation to a crime of violence. The announcement was made by Attorney General Merrick B. Garland, Associate Attorney General Vanita Gupta, Assistant Attorney General Kristen Clarke for the Civil Rights Division, U.S. Attorney Trini E. Ross for the Western District of New York, and FBI Deputy Director Paul Abbate.
The complaint alleges that on May 14, at approximately 2:30 p.m., Gendron, a white male, committed a mass shooting targeting Black people at Tops Friendly Market in Buffalo, New York. The mass shooting, which Gendron live-streamed on the Internet, resulted in the deaths of 10 Black people and injuries to one Black person and two Caucasian people. The complaint further alleges that Gendron’s motive for the mass shooting was to prevent Black people from replacing white people and eliminating the white race, and to inspire others to commit similar attacks.
At the time of the attack, Gendron was wearing a tactical-style helmet, camouflage clothing, body armor, and a GoPro video camera, and carrying a loaded Bushmaster XM-15 .223 caliber rifle and multiple loaded magazines. After parking and exiting his vehicle, Gendron shot and killed three Black people in the Tops’ parking lot and injured a fourth Black person. Gendron then fired several shots through the front window of the store before entering, where he immediately shot and killed two more Black people. At that time, Gendron and an armed Black security guard exchanged gunfire. Gendron aimed at, shot, and killed the security guard. After Gendron killed the security guard, he turned and aimed his rifle at a white male Tops employee who, at some point during the attack, had been shot in the leg and injured. Rather than shooting him, Gendron said, “sorry,” to the employee. At some point during the attack, one of the shots also struck and injured a white female Tops employee in the pharmacy area of the store, which is located near the checkout lanes. Gendron then walked through a checkout lane, and shot and killed a Black person, before moving through the aisles of the store and shooting and killing three additional Black people. Gendron ultimately returned to the front of the store where members of the Buffalo Police Department took him into custody.
When he was taken into custody, officers recovered the rifle used by Gendron in the attack. The rifle had various writings on it, including racial slurs, the statement “Here’s your reparations!,” and the phrase “The Great Replacement.” Investigators have determined that Gendron fired approximately 60 shots during the attack. Two other firearms, a loaded 12-gauge shotgun and a loaded bolt-action rifle, as well as three loaded rifle magazines, were recovered from Gendron’s vehicle after the attack.
Subsequent investigation determined that in the months preceding the attack, Gendron wrote a self-described manifesto containing a detailed plan to shoot and kill Black people at Tops using a Bushmaster XM-15 rifle, a diagram of the interior layout of the store, a discussion of the clothing and equipment that he would use during the attack, and statements that his motivation for the attack was to prevent Black people from replacing white people and eliminating the white race, and to inspire others to commit similar racially-motivated attacks. Gendron also wrote that he selected the zip code 14208 because it has the highest percentage of Black people close enough to where he lives and that he selected the Tops store because it is where a large number of Black people can be found. The investigation also determined that Gendron traveled to Tops to scout the location on several occasions prior to the attack, including on May 14, 2022, only two and a half hours before the attack.
Upon conviction, the charges in the complaint carry a maximum penalty of life imprisonment or the death penalty. Gendron is currently in state custody pending state criminal charges.
The criminal complaint is the result of an investigation by the Buffalo and Albany Offices of the FBI, the Buffalo Office of the Bureau of Alcohol, Tobacco, Firearms, and Explosives, the Buffalo Police Department, the New York State Police, and the Erie County Sheriff’s Office. Ross announced today that Matthew Shulman, 36, of Rochester, NY, was arrested and charged by criminal complaint with attempted production of child pornography, receipt and distribution of child pornography, and possession of child pornography following a previous conviction for possessing child pornography. The charges carry a minimum penalty of 25 years in prison, a maximum of 50 years, lifetime supervised release, and a $250,000 fine.
Assistant U.S. Attorney Kyle P. Rossi, who is handling the case, stated that according to the complaint, between May 2021, and June 2022, Shulman engaged in sexually explicit online communications with an undercover New York State Police Investigator that he believed was an 11-year-old girl. During these conversations, Shulman asked the girl to produce and send images to him and he attempted to persuade the girl to meet him for sex. On June 7, 2022, the NYSP and Homeland Security Investigations executed a search warrant at Shulman’s residence at which time Shulman was taken into custody. Shulman was previously convicted of possessing child pornography in Monroe County Court in June 2016 and is a registered sex offender.
The defendant made an initial appearance before U.S. Magistrate Judge Mark W. Pedersen and is being held without bail.

Ross announced today that Michael Woloschuk, 42, of Hamlin, NY, was arrested and charged by criminal complaint with receipt, distribution, and possession of child pornography, after having previously been convicted of a child pornography offense. The charges carry a minimum penalty of 10 years in prison, a maximum of 30 years, and a $250,000 fine.
Assistant U.S. Attorney Kyle P. Rossi, who is handling the case, stated that according to the complaint, in October 2020, the National Center for Missing and Exploited Children (NCMEC) received a cybertip from a social media platform that an individual distributed child pornography over the platform. NCMEC forwarded the information to the New York State Police, who identified the individual as Woloschuk, a registered sex offender. On October 26, 2021, during the execution of a search warrant at Woloschuk’s residence, investigators seized several digital devices, to include a thumb drive and laptop. A forensic analysis recovered several videos and images of child pornography, to include material that depicted violence against prepubescent children. Some of the child pornography was located on the thumb drive, which also contained Woloschuk’s sex offender registration information. Woloschuk was previously convicted on New York State child pornography charges in 2005 and sentenced to serve 3 to 9 years in prison.

Batavia Woman Pleads Guilty to COVID FraudRead the Press Release

Assistant U.S. Attorney Kyle P. Rossi, who is handling the case, stated that between July 9 and December 4, 2020, Tooley applied for and collected unemployment benefits to which she was not entitled, benefits that were connected to federal COVID-19 relief programs. The scheme came to the attention of law enforcement on November 24, 2020, when Tooley was arrested for criminal possession of a controlled substance during a vehicle traffic stop on Clinton Street in Bergen, NY. A New York State Police trooper observed a crack pipe with white residue inside Tooley’s vehicle. Tooley admitted at the time that she had crack cocaine in the center console of the vehicle. As they prepared for Tooley’s vehicle to be towed, troopers recovered six New York State unemployment benefit cards issued to individuals other than Tooley, which they turned over to the U.S. Department of Labor, Office of Inspector General. Subsequent investigation determined that Tooley consistently withdrew money from bank accounts associated with the benefit cards.

Vilardo to with conspiracy to possess with intent to distribute, and to distribute, 50 grams or more of methamphetamine, and being a felon in possession of a firearm and ammunition. The charges carry a mandatory minimum penalty of 10 years in prison, and a maximum of life in prison, and a $10,000,000 fine.
Assistant U.S. Attorney Meghan E. Leydecker, who is handling the case, stated that on August 31, 2020, law enforcement officers intercepted a package from California, which contained approximately 837 grams of pure methamphetamine. On September 4, 2020, Drug Enforcement Administration agents conducted a controlled delivery of the parcel, which had been replaced with sham and a transmitter installed, at Medina’s residence on South Avenue in Niagara Falls. Approximately an hour later, the transmitter alerted agents that the parcel had been opened. As agents approached the home, they observed Medina standing on the second-floor balcony throwing the sham and parcel into an adjacent yard. Medina was then taken into custody. During the execution of a search warrant at the residence, agents recovered the parcel, the sham placed inside the package, approximately $15,200 in U.S. currency, approximately 74 grams of marijuana, a digital scale, and a black iPhone. In addition, a .40 caliber semi-automatic handgun and a .40 caliber magazine loaded with five rounds. Medina was previously convicted three times in 2011 and 2012, on drug charges in California and is legally prohibited from possessing firearms and ammunition.The plea is the result of an investigation by the United States Postal Inspection Service, under the direction of Inspector-in-Charge Ketty Larco-Ward of the Boston Division, and the Drug Enforcement Administration, under the direction of Special Agent-in-Charge Frank A. Zaso a/k/a Joey Cracks, 38, of Buffalo, NY, and Denver J. Komenda, 47, of Jamestown, NY, with narcotics conspiracy. In addition, Zaso is charged with using and maintaining a drug-involved premises and distribution of fentanyl and faces a mandatory minimum penalty of 15 years in prison and a maximum of life. Komenda is also charged with possession with intent to distribute fentanyl and faces a mandatory minimum penalty of 10 years in prison and a maximum of life.
Assistant U.S. Attorney Joshua A. Violanti, who is handling the case, stated according to the indictment, between September 2018, and May 2022, Zaso and Komenda conspired to possess and sell heroin and fentanyl. Zaso is also accused of using a residence on Locust Street in Jamestown to conduct drug trafficking activities, including the distribution of large quantities of heroin and fentanyl. Zaso was previously convicted of possession with intent to distribute controlled substances in federal court in the Eastern District of Michigan and sentenced to serve 60 months in prison. Zaso was on federal supervised release, which was transferred from Michigan to the Western District of New York, until July 2021.

Elmira Man Going to Prison for 10 Years on Meth ConvictionRead the Press Release

Ross announced today that Lamar Thompkins, 35, of Elmira, NY, who was convicted of possession with intent to distribute 500 grams or more of methamphetamine, was sentenced to serve 121 months in prison by Chief U.S. District Judge Elizabeth A. Wolford.
Assistant U.S. Attorney Matthew T. McGrath, who handled the case, stated that Thompkins arranged for over four kilograms of methamphetamine to be shipped from California to a private residence in Elmira, the owner of which had recently died. A video camera at the residence captured Thompkins affixing a fake name to the mailbox. Members of the Elmira Police Department and New York State Police were alerted to the incoming drug parcel and were conducting surveillance on the residence when they observed Thompkins and another individual retrieve the package and attempt to drive away from the location in a vehicle. Law enforcement officers pulled the vehicle over and obtained a search warrant. Approximately 4.5 kilograms of methamphetamine was recovered from the drug parcel.

Sakr, M.D., has agreed to pay $602,661.61 to resolve allegations, arising under the False Claims Act, that he fraudulently billed Medicare and Medicaid for procedures that were not medically necessary or that he did not perform.
Assistant U.S. Attorney David M. Coriell, who handled the case, stated that from at least January 1, 2014, to December 31, 2019, Dr. Sakr, an ear, nose, and throat (ENT) doctor based in Dansville, NY, billed Medicare and Medicaid for procedures not performed at all or were not documented in patient medical records.
“This health care provider billed for services and procedures that he did not perform and for which he was paid with the public’s money,” stated U.S. Attorney Ross. “The resolution of this case holds Dr. Sakr accountable for his actions and requires him to return the money he should not have received from Medicare and Medicaid. Our office will continue to root out fraud in federal healthcare programs and hold those who defraud the public accountable.”
The civil settlement includes the resolution of claims brought under the qui tam or whistleblower provisions of the False Claims Act by Lee M. Mandel, M.D., FACS. Under those provisions, a private party can file an action on behalf of the United States and receive a portion of any recovery. The qui tam case is captioned United States ex rel. Mandel v. Sakr, 17-cv-907 (W.D.N.Y.). Dr. Mandel will receive a share of the settlement.
The resolution of this matter was the result of a coordinated effort between the U.S. Attorney’s Office for the Western District of New York, the U.S. Department of Health and Human Services Office of Inspector General, and the New York State Attorney General’s Office Medicaid Fraud Control Unit.

Canadian Man Going to Prison for His Role in Scheme That Defrauded Elderly Victims Out of $2,600,000Read the Press Release

FAX #: (716) 551-3051ROCHESTER, N.Y.-U.S. Attorney Trini E. Ross announced today that Martin Hogan, 53, of Montreal Canada, who was convicted of conspiracy to commit wire and mail fraud, was sentenced to serve 111 months in prison by U.S. District Judge Frank P. Geraci, Jr.
Assistant U.S. Attorney Melissa Marangola, who handled the case, stated that between September 2015 and March 2020, Hogan conspired with multiple co-defendants to defraud elderly victims using a fraudulent telemarketing scheme. Hogan placed telephone calls from Canada to victims in the United States, telling them that they had won the Canadian lottery. However, victims were told that they had to first pay the taxes, brokerage fee, and/or custom fees due in connection with the winnings. Some victims were instructed to mail cash to addresses in New York owned by co-conspirators. The cash was then smuggled over the border into Canada and given to Hogan. In total, elderly victims were defrauded out of more than $2,600,000.
Martin Hogan was on vacation in Jamaica where he was apprehended at the request of the United States and later extradited in January 2021. The money he used to pay for his vacation was money obtained from the scheme.

Ross announced today that Jawayne Watkins, 33, aka Weezy, of Buffalo, NY, who was convicted by a federal jury of distributing heroin and 4-fluoroisobutyryl fentanyl resulting in the death an individual, as well as conspiracy and other distribution charges, was sentenced to serve 360 months by U.S. District Judge Richard J. Arcara.
Assistant U.S. Attorneys Michael J. Adler and Meghan E. Leydecker, who handled the prosecution of the case, stated that Watkins sold heroin and 4-fluoroisobutyryl fentanyl, a rare and extremely dangerous fentanyl analogue. On at least two occasions, in July 2017, and on November 9, 2017, Homeland Security Investigations made controlled purchases from Watkins. The substances purchased from Watkins later tested positive for heroin and 4-fluoroisobutyryl fentanyl. On November 10, 2017, an individual identified as A.C. died after taking a substance received from Watkins. Toxicology reports following the victim’s death indicated she had heroin and 4-fluoroisobutyryl fentanyl in her system. During the investigation, law enforcement officers also made other seizures of the deadly substance from Watkins.
Watkins was on New York State parole and living in a halfway house at the time of his arrest in November 2017.The sentencing is the result of an investigation by the Buffalo Police Department, under the direction of Commissioner Joseph Gramaglia and Homeland Security Investigations, under the direction of Acting Special Agent-in-Charge Matthew Scarpino.

Ross announced today that a federal grand jury has returned a 23-count indictment charging Jennifer Campbell, 47, of Niagara Falls, NY, with wire fraud and aggravated identity theft. The charges carry a minimum penalty of two years in prison, a maximum penalty of 20 years, and a $250,000 fine.
Assistant U.S. Attorney Douglas A. C. Penrose, who is handling the case, stated that according to the indictment, Campbell was employed as the Office Manager and Chief Compliance Officer at an investment advisory firm based in Buffalo, NY, with access to client accounts. Between November 2018, and May 2021, Campbell used this access to steal over $500,000 from several clients and from the firm itself. Campbell wrote checks from client accounts, forging signatures of either the client or a principal at the firm, and then deposited the checks into her own personal account. Campbell also took steps to conceal the thefts. For instance, she sent a victim a falsified account statement showing a balance of approximately $148,000, when in fact the account had a balance of only $93. In another instance, Campbell took funds from a client and transferred the funds to the bank account of one of a previous victim, who believed that the funds she received were a distribution from her account.
In addition, Campbell diverted emails received by firm principals from anti-money laundering and financial crimes personnel at the firm’s broker-dealer, who had begun to raise questions about some of the transactions that Campbell had engaged in. To put off these inquiries, Campbell sent several emails using the email account of a firm principal making false statements and submitted fake documentation in an effort to make the transactions appear legitimate.
The defendant was arraigned today before U.S. Magistrate Judge Jeremiah J. McCarthy and was released on conditions.
The indictment is the result of an investigation by the Federal Bureau of Investigation, under the direction of Special Agent-in-Charge Stephen Belongia, and the Internal Revenue Service, Criminal Investigation Division, under the direction of Thomas Fattorusso, Special Agent-in-Charge.

Rochester Man Pleads Guilty to Gun Charge for His Role in Cocaine ConspiracyRead the Press Release

FAX #: (716) 551-3051ROCHESTER, N.Y. - U.S. Attorney Trini E. Ross announced today that Deshan Scott, 22, of Rochester, NY, pleaded guilty before U.S. District Judge Frank P. Geraci, Jr. to possession of a firearm in furtherance of a drug trafficking crime, which carries a mandatory minimum penalty of five years in prison, a maximum of life and a $250,000 fine.
Assistant U.S. Attorney Katelyn M. Hartford, who is handling the case, stated that between September and October 26, 2021, Scott conspired with others to sell cocaine. In the early morning of October 26, 2021, investigators executed search warrants at numerous locations associated with the narcotics conspiracy, including a residence on Bernard Street. At that location, Scott worked as a lookout for the organization, watching for threats to their operation such as law enforcement or armed robbers, while other co-conspirators sold street-level quantities of cocaine to customers. When Scott saw law enforcement approaching, he threw a loaded 9mm handgun out of a window, which was found on a roof ledge outside a window. During the search of the residence, law enforcement also recovered 200 plastic vials of cocaine and $2,310 United States currency.
Scott was arrested and charged along with eight other defendants. He is the fifth defendant to be convicted.

Ross announced today that Robert Colon, 30, of Rochester, N.Y., was arrested and charged by criminal complaint with possession with intent to distribute and distribution of cocaine and fentanyl. The charge carries a maximum penalty of 20 years in prison and a $1,000,000 fine.
Assistant U.S. Attorney Cassie Kocher, who is handling the case, stated that between January 18 and March 9, 2022, Colon sold cocaine and fentanyl to an undercover officer on five separate occasions.
Colon made an initial appearance before U.S. Magistrate Judge Mark W. Pedersen and is being held without bail.

Ross announced today that Chad Owens, 30, of Rochester, NY, was arrested and charged by criminal complaint with possession with intent to distribute cocaine, being a felon in possession of a firearm, and possession of a firearm in furtherance of drug trafficking. The charges carry a maximum penalty of life in prison and a $1,000,000 fine.
Assistant U.S. Attorney Cassie Kocher, who is handling the case, stated that on May 13, 2022, a search warrant was executed at Owens’s Barberry Terrace residence in Rochester. During the search, investigators recovered $23,280 in cash, 75 individually wrapped bags of cocaine, another 52 grams of cocaine, and drug paraphernalia. A loaded .45 caliber handgun and a .40 caliber handgun with a defaced serial number, both of which had been reported stolen, and ammunition were also recovered. Owens was previously convicted on in Monroe County Court of Attempted Criminal Possession of a Firearm in the Second Degree and is legally prohibited from possessing firearms.
The defendant made an initial appearance before U.S. Magistrate Judge Mark W. Pedersen and is being held without bail.

Assistant U.S. Attorney Paul E. Bonanno, who handled the case, stated that between October 8, 2020, and January 9, 2021, Mesko engaged in a sexual relationship with a 17-year-old minor female (Victim 1), who was mentally disabled. Mesko communicated with Victim 1 via text message and mobile chat applications. On February 16, 2021, Mesko fled with Victim 1 to the State of Pennsylvania, causing an Amber Alert to be issued for Victim 1. After Mesko’s vehicle was spotted by a Pennsylvania State Police Trooper, Mesko fled at a high rate of speed and had to be forcibly stopped and taken into custody.

FAX #: (716) 551-3051ROCHESTER, N.Y.-U.S. Attorney Trini E. Ross announced today that Stephen Reed Pattison, 33, of Hilton, NY, who was convicted of possession of firearms and ammunition by a convicted felon, was sentenced to serve 96 months in prison by U.S. District Judge David G. Larimer.
Assistant U.S. Attorney Brett A. Harvey, who handled the case, stated that in December 2016, Pattison was convicted of Domestic Assault in the Second Degree in Boone County, Missouri, and was legally prohibited from possessing firearms and ammunition. On October 30, 2020, Pattison was taken into custody on a parole absconder warrant from Missouri. In November 2020, law enforcement officers conducted a search of the Church Road residence that Pattison shared with his girlfriend and recovered two firearms, 25 rounds of ammunition, a black tactical vest with an expandable baton and knife, various items of white supremacist and Nazi paraphernalia.
As part of his guilty plea, Pattison admitted that he attempted to obstruct justice by telling his girlfriend to lie to the police and testify falsely that the firearms recovered did not belong to him. Pattison also attempted to obtain false affidavits from the individuals who gave him the firearms and ammunition. Pattison wanted the individuals to state that they gave the firearms to his girlfriend after he was taken into custody.
As detailed in a complaint against Pattison, he is a supporter of white supremacist ideology who frequently expressed racial animus and disdain for activist and political groups, such as Black Lives Matter and Antifa, and aggressively and sometimes violently expressed his disagreement with local protests in Rochester over the deaths of George Floyd and Daniel Prude.
The sentencing is the result of an investigation by the Rochester Joint Terrorism Task Force of the Federal Bureau of Investigation, under the direction of Special Agent-in-Charge Stephen Belongia.

Assistant U.S. Attorneys Nicholas T. Cooper and Aaron J. Mango, who are handling the case, stated that according to the superseding indictment, between June 2020, and October 2021, the defendants conspired to sell fentanyl, heroin, and cocaine, using residences at 60 Liddell and 454 Davey Streets in Buffalo to manufacture, distribute, and use these illegal narcotics. During this same time period, the defendants are accused of conspiring to entice a victim to engage in commercial sex acts using force and threats of force. Defendant Lairon Graham also allegedly forced two other victims to engage in sex trafficking, including taking one of the victims to Pennsylvania to engage in commercial sex acts.
