U.A. Attorney Kennedy and D-A Swanson Announce Overdose Response InitiativeRead the Press Release

Jr. and Chautauqua County District Attorney Patrick Swanson announced today the creation of the Overdose Response Initiative (ORI). Modeled after similar initiatives across the state and country, this program aims to examine overdose deaths in an effort to track down drug dealers and offer support to victims’ relatives.
The Overdose Response Initiative aims to coordinate local law enforcement and compile information from a multitude of sources to find the origin of the drugs that lead to overdoses. “We then will work with our federal partners, including the US Attorney’s Office and the FBI, to put these cases together for federal prosecution,” D-A Patrick Swanson stated. “Until now, the partnership has been an informal one, however, today, we are formalizing that partnership and making public our efforts to combat overdose deaths.”
The partnership announcement follows a training session, organized by D-A Swanson and presented by Assistant U.S. Attorney Michael Adler, the Opioid Coordinator for the U.S. Attorney’s Office. Over 40 investigators and top level administrators from law enforcement agencies across Chautauqua County attended the training hosted by SUNY Fredonia and its new Campus Police Chief Brent Isaacson. Swanson said, “The level of participation today is a testament to the commitment by our law enforcement leaders to fight this problem in our community.”Defendants who sell drugs that lead to an overdose death can be charged federally and face up to life in prison if convicted. For example, in November 2018, in a first of its kind verdict, a federal jury convicted Dontrell Wise of supplying the drugs that led to November 2017 death of a young Cheektowaga, NY woman. Wise was sentenced in March of this year to life in prison. The prosecution resulted from the combined efforts of the FBI, DEA, Buffalo Police, and Cheektowaga Police. DA Swanson offered, “Collaboration at that level is what is needed to bring these peddlers of poison to justice.” Assistant U.S. Attorney Michael Adler handled the prosecution of that case.
The initiative’s multistep, multi-agency approach, begins when an overdose occurs. Overdoses are being investigated like crime scenes. Investigating officers will work with the newly appointed Chautauqua County Narcotics Prosecutor to collect facts concerning the time, place and identity of the deceased and whether or not there is evidence of value at the scene. Another critical component is the cooperation of family and friends of the deceased. Investigators will interview those closest to the victim in hopes of discovering the source of the fatal drugs. All of this information, along with a toxicology analysis, will be compiled and relayed to the District Attorney’s Office, which will then develop a prosecution strategy in conjunction with the US Attorney’s Office.“I commend District Attorney Swanson for his proactive leadership in seeking to address the opioid crisis in Chautauqua County and the greater Southern Tier region,” stated U.S. Attorney Kennedy. “We know that in areas where public health and public safety come together, death rates are reduced and communities make positive strides in the opioid battle. The residents of Chautauqua County should be encouraged by this new collaborative partnership. However, let this also serve as a warning to those peddling these deadly drugs that we are one team and we will find you and prosecute you.”
D-A Swanson further stated, “We are able to take these steps because our U.S. Attorney, James P. Kennedy, Jr. is committed to holding those who deal drugs accountable for the havoc they wreak. This is also possible in part because of an additional attorney being added to my staff. With the right resources we are able to accomplish more. One of my current priorities is to request the funds for an investigator to work side-by-side with my Narcotic Prosecutor. I am eager to give these cases the attention they deserve. Our citizens are dying and it needs to stop. This initiative is a much needed response to a tragic crisis that is gripping Chautauqua County and destroying countless lives throughout the county.”

Drug Trafficking Organization Second in Command and Ring Leader's Wife Plead Guilty to Cocaine ConspiracyRead the Press Release

Kennedy, Jr. announced today that Josue Cardona-Soto, 38, of Puerto Rico, and Virgen Perez-Jurado, 28, of Buffalo, NY, pleaded guilty before U.S. District Judge Lawrence J. Vilardo to conspiracy to possess with intent to distribute, and to distribute, over five kilograms of cocaine. The charge carries a mandatory minimum penalty of 10 years in prison, a maximum of life in prison, and a $10,000,000 fine.
Assistant U.S. Attorneys Laura A. Higgins and Jeremiah E. Lenihan, who are handling the case, stated that between June 2017 and September 29, 2017, Cardona-Soto assisted Cesar Rivera-Figueroa, a/k/a Fat Boy, the leader of a drug trafficking organization, by making deliveries of bulk quantities of cocaine to mid-level distributors in the organization, collecting drug proceeds from them, and retrieving packages containing bulk quantities of cocaine shipped from Puerto Rico in the U.S. mail. Perez-Jurado, the wife of Cesar Rivera-Figueroa, also distributed bulk quantities of cocaine to mid-level distributors, collected payment, stored the organization’s drug proceeds inside her Wiley Street residence, and taught co-conspirators the means and methods of drug-trafficking.
On August 15, 2017, Cardona-Soto was appointed by Rivera-Figueroa as his second-in-command to replace co-defendant Daniel Navarro. Navarro and Rivera-Figueroa had a falling out after the organization suffered some loses as a result of law enforcement seizures of cocaine.
In addition to completing multiple drug transactions locally, Cardona-Soto also made trips to the New York City area, sometimes with Rivera-Figueroa, to pick up bulk quantities of cocaine or make payments for cocaine.
Cardona-Soto and Perez-Jurado were charged along with 10 other defendants. A total of seven defendants have been convicted.
The pleas are the result of an investigation by the Federal Bureau of Investigation, Safe Streets Task Force, under the direction of Special Agent-in-Charge Gary Loeffert; the Drug Enforcement Administration, under the direction of Special Agent-in-Charge Ray Donovan, New York Field Division; the Bureau of Alcohol, Tobacco, Firearms, and Explosives, under the direction of Special Agent-in Charge John B. Devito, New York Field Division; the United States Postal Inspection Service, Boston Division, under the direction of Inspector-in-Charge Joseph W. Cronin; the Buffalo Police Department, under the direction of Commissioner Byron Lockwood; the New York State Police, under the direction of Major Edward Kennedy; and the Erie County Sheriff’s office, under the direction of Sheriff Timothy Howard.
Cardona-Soto and Perez-Jurado are scheduled to be sentenced on January 2 and January 3, 2020, respectively, both before Judge Vilardo.

Buffalo Man Admits to Selling Fentanyl That Led to the Deaths of Five PeopleRead the Press Release

FAX #: (716) 551-3051BUFFALO, N.Y. - U.S. Attorney James P. Kennedy, Jr. announced today that Robert Moore, 41, of Buffalo, NY, pleaded guilty before U.S. District Judge Lawrence J. Vilardo to distribution of fentanyl causing death. The charge carries a mandatory minimum penalty of 20 years in prison, a maximum of life, and a $1,000,000 fine. Pursuant to the plea agreement between the parties, Moore faces between 20 and 22½ years imprisonment when he is sentenced.
Assistant U.S. Attorney Joseph M. Tripi, who is handling the case, stated that between February 2015 and March 16, 2017, the defendant worked with his brother Reese Moore, Kevin Abernathy, Joshua Levine, and others to distribute heroin and fentanyl in the City of Buffalo and surrounding suburbs. Robert Moore used cell phones to schedule meetings in and around Buffalo where he personally distributed quantities of heroin and fentanyl. When the defendant was not available, he sent co-defendants Reese Moore and Kevin Abernathy to sell the heroin and fentanyl to customers. Joshua Levine was a customer of Robert Moore who used the heroin and fentanyl, but also re-distributed quantities for profit to other users.
Robert Moore pleaded guilty to selling the heroin and fentanyl that caused the death of one individual, but he also admitted to selling the heroin and fentanyl that led to the overdose deaths of four other individuals.
• On May 15, 2015, defendant Moore distributed heroin and fentanyl to another individual who used the heroin and fentanyl with J.J., and J.J. died as a result of ingesting the heroin and fentanyl defendant Moore supplied.
• On March 12, 2016, defendant Moore distributed heroin and fentanyl to others, who provided it to S.S. S.S. used the heroin and fentanyl and died as a result of using the heroin and fentanyl defendant Moore supplied.
• On March 15, 2016, defendant Moore distributed fentanyl to others, who provided it to J.P. J.P. used the fentanyl and died as a result of using the fentanyl defendant Moore supplied.
• On January 8, 2017, defendant Moore distributed fentanyl to another person, who provided it to C.G. C.G. used the fentanyl and died as a result of using the fentanyl defendant Moore supplied.
• On February 18, 2017, defendant Moore distributed heroin and fentanyl to Joshua Levine who distributed a quantity of the heroin and fentanyl to B.G. B.G. used the heroin and fentanyl and died as a result of using the heroin and fentanyl supplied by defendant Moore and Joshua Levine.On November 27, 2015, Robert Moore’s vehicle was stopped by Buffalo Police. Officers seized 15 bags of heroin and seven bags of butyryl and $1000 in U.S. currency.
During the course of the investigation, law enforcement officers from the Amherst, Lancaster, and the Buffalo Police Departments, and the New York State Police and DEA, conducted 11 controlled purchases of fentanyl and butyryl fentanyl from Robert Moore.
Robert Moore was arrested on March 16, 2017, at which time law enforcement officers searched his residence on Glenwood Drive in Williamsville, NY. Investigators seized 202 bags of fentanyl and numerous cellular telephones, including the cell phone Kevin Abernathy used to make sales of heroin and fentanyl to Robert Moore's customers. The search also resulted in the seizure of items the defendant obtained as a result of his heroin and fentanyl distribution activities, including assorted valuable pieces of jewelry and a 2009 Audi S5 Quattro.
Reese Moore and Kevin Abernathy were previously convicted and are awaiting sentencing. Charges remain pending against Joshua Levin. The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty.
“Stated simply, by his plea today, the defendant admitted to being responsible for the deaths of five members of our community,” stated U.S. Attorney Kennedy. “While today’s plea and the lengthy prison sentence, which is sure to follow, will never bring back those who died as a result of taking the drugs they got from Robert Moore, today’s plea should serve as a warning to those who remain out on the streets peddling this poison. The United States Attorney’s Office, together with our partners in federal, state, and local law enforcement, will work together tirelessly to find you, to build a case against you, and to hold you accountable for your actions. We do it in order to protect lives, to bring some measure of closure and justice to those who have lost a loved one to a drug overdose, and finally, to send the message that in the eyes of the law enforcement community here in Western New York–all lives matter.”

Karn, Jr.; the Buffalo Police Department Narcotics Squad, under the direction of Commissioner Byron C. Lockwood; the Lockport Police Department, under the direction of Interim Police Chief Steve Preisch; the Depew Police Department, under the direction of Chief Jerome Miller; the Niagara County Sherriff’s Office and the Niagara County Drug Task Force, under the direction of Sheriff James Voutour; the Erie County Sherriff’s Office, under the direction of Sheriff Timothy Howard; and Immigration and Customs Enforcement, Homeland Security Investigations, under the direction of Special Agent-in Charge Kevin Kelly.
Sentencing is scheduled for January 3, 2020, before Judge Vilardo.

Maryland Man Indicted on Multiple Fraud Counts for Defrauding an Orchard Park Aerospace CompanyRead the Press Release

Kennedy, Jr. announced today that a federal grand jury has returned an indictment charging Amir Jahed, a/k/a Amir Jahedmotlagh, 39, of Montgomery Villaga, Maryland, with 12 counts of mail fraud. The charge carries a maximum penalty of 20 years in prison and a $250,000 fine.
Assistant U.S. Attorney Maura K. O’Donnell, who is handling the case, stated that from 2010 to July 19, 2018, the defendant was an employee of Cobham Mission Systems, a company headquartered in Orchard Park, NY that was engaged in the development, delivery, and support of aerospace and defense technology and systems. Cobham also had an office located in Westminster, Maryland. As part of his employment, Jahed was assigned company credit cards (purchase cards) and was authorized to make certain purchases on behalf of Cobham for its business operations.
The indictment alleges that the defendant used his purchase cards to conduct approximately 600 unauthorized transactions. Jahed claimed that the transactions were purchases of parts for Cobham’s business operations. In truth and in fact, the defendant didn’t purchase any parts for Cobham, rather, he used the purchase cards to direct funds into accounts controlled by him, resulting in a financial loss to Cobham. After Jahed used a purchase card fraudulently to obtain funds, he mailed fraudulent invoices to Cobham headquarters in support of the fraudulent transactions to give the appearance that the purchases were made to support Cobham’s business operations.
The defendant was arraigned before U.S. Magistrate Judge Michael J. Roemer and released on conditions.
The indictment is the result of an investigation by the Federal Bureau of Investigation, Buffalo Office, under the direction of Special Agent-in-Charge Gary Loeffert.

Leader of Jamestown Drug Organization Pleads Guilty to Selling CocaineRead the Press Release

FAX #: (716) 551-3051BUFFALO, N.Y. - U.S. Attorney James P. Kennedy, Jr. announced today that Sigfredo Martinez, 47, of Celeron, NY, pleaded guilty before U.S. District Judge Richard J. Arcara to conspiracy to distribute one kilogram or more of heroin. The charge carries a mandatory minimum penalty of 10 years in prison, a maximum of life, and a $10,000,000 fine.
Assistant U.S. Attorneys Laura A. Higgins and Jeremiah E. Lenihan, who are handling the case, stated that beginning in early 2016, the defendant led a drug organization responsible for distributing heroin and cocaine in the Jamestown, NY area. The defendant appointed co-defendant Bryan Ferrer-Vazquez to be responsible for the “day shift” transactions, while his co-defendant, Alex Mercado, distributed during the “night shift.”
Every few days, Martinez would distribute a couple hundred bundles of heroin each to Ferrer-Vazquez and Mercado who were then tasked with distributing the heroin to smaller dealers and users. The proceeds were collected by an uncharged co-conspirator, who turned over the proceeds to the defendant. Martinez utilized a second uncharged co-conspirator to distribute quantities of cocaine and heroin.
Between February 11, 2016, and March 2, 2017, investigators conducted at least eight controlled purchases of heroin or cocaine from Ferrer-Vazquez and Mercado.
On April 6, 2017, a federal search warrant was executed at Martinez’s residence at 32 E. Duquesne Street in Celeron. Investigators seized nine cellphones, two electronic tablets, a laptop computer, a notebook, and a GPS device.
The same day, another search warrant was executed at 385 Buffalo Street in Jamestown. Investigators seized 19 cellphones, a quantity of suspected cocaine, a quantity of suspected heroin, $2,994 U.S. currency, three ledger notebooks, and a scale. A loaded semi-automatic handgun was found in the detached garage.
The FBI Cryptanalysis & Racketeering Records Unit performed an analysis on the ledgers and several loose pieces of paper recovered. The analysis determined that the organization was distributing “bundles” of heroin for a price of $75-80. Further, the analysis found that “on January 28, 2016 and between June 22, 2016 and April 5, 2017, the business distributed a minimum total of 8,106 bundles of heroin to approximately 28 separate accounts for a minimum total of $83,150.” 8,000 bundles equates to approximately eight kilograms of heroin.
Bryan Ferrer-Vazquez and Alex Mercado were previously convicted. Ferrer-Vazquez is awaiting sentencing. Mercado was sentenced to serve 120 months in prison.
The plea is the result of an investigation by the Drug Enforcement Administration, under the direction of Special Agent-in-Charge Ray Donovan, New York Field Division, the Jamestown Police Department, under the direction of Chief Harry Snellings, and the Southern Tier Regional Drug Task Force.
Sentencing is scheduled for November 26, 2019, at 12:30 p.m. before Judge Arcara.

East Aurora Woman Pleads Guilty to Attempting to Hire A Hitman on the Dark Web to Cripple Her Ex-BoyfriendRead the Press Release

FAX #: (716) 551-3051BUFFALO, N.Y. - U.S. Attorney James P. Kennedy, Jr. announced today that Yanyan Lesser, 48, of East Aurora, NY, pleaded guilty before Senior U.S. District Judge William M. Skretny to transmitting in interstate or foreign commerce a communication containing a threat to injure another person. The charge carries a maximum penalty of five years in prison and a $250,000 fine.
Assistant U.S. Attorney Wei Xiang, who is handling the case, stated that via a website on the dark web, the defendant, using the screenname “Tree1,” solicited what she believed to be a hitman to commit a crippling assault against G.Z., a former boyfriend in Florida. In her solicitation, Lesser posted the following messages:
• On February 14, 2019, the defendant posted, “Because of a business dispute, I would like to give this guy a lesson. Give him a good beating and legs broken, waist broken and even cripple the mark of his legs.” The defendant also shared an image of a person’s lower back with the words “broken waist” written on it;
• On February 16, 2019, the defendant posted, “Please give him a good beating and let he always walk in wheelchair;”
• On February 18, 2019, the defendant posted, “And also give him good beating of his body, and must be broken his legs to make him walk by wheelchair or crutches forever;”
• On February 19, 2019, the defendant posted, “Make the crippling be permanent, so that Chinese guy will always walk in wheelchair” and “must be broken his legs that he will never heal and never be back to normal, so that he always walk in wheelchair. Remember: crippling! Robbery!”An unknown subject on the dark web site initially responded to Lesser’s job request on February 14, 2019, urging the defendant to prepare funds for payment. The subject stated: “Sometimes kids or trolls do jokes and are not serious about their job.” On February 16, 2019, Lesser transferred 1.26 bitcoins (approximately $4,577) to a bitcoin address to pay for the beating. On February 19, 2019, the defendant transferred an additional .694 bitcoins (approximately $2,707) to pay for the crippling. Lesser made cash withdrawals in East Aurora relating to these transactions on February 15 and 18, 2019.
The plea is the result of an investigation by Homeland Security Investigations, under the direction of Special Agent-in-Charge Kevin Kelly. Additional assistance was provided by HSI St. Paul, Minnesota, and HSI Orlando, Florida.
Sentencing is scheduled for December 4, 2019, at 9:00 a.m. before Judge Skretny.

Medina Husband and Wife Arrested, Charged with Selling CocaineRead the Press Release

Kennedy, Jr. announced today that Anthony Allee, and Tashira Allee, both of Medina, NY, were arrested and charged by criminal complaint with possession with intent to distribute, and distribution of, cocaine, maintaining a drug-involved premises, and possession of a firearm in furtherance of drug trafficking activity. The charges carry a minimum penalty of five years in prison, a maximum of 20 years, and a $1,000,000 fine.
Assistant U.S. Attorney Justin G. Bish, who is handling the case, stated that according to the complaint, on July 22, 2019, a search warrant was executed at the defendants’ residence on Ridge Road in Medina. Investigators seized 11 firearms, numerous articles of property reported as stolen, marijuana, pills believed to be controlled substances, ammunition, scales, bags, and other items of evidence including Tashira Allee's cell phone. The firearms included a Taurus Judge pistol that had been reported stolen in the Town of Tonawanda.
Investigators also searched a barn located behind the main house. Inside, a safe was located. Within the safe, officers recovered prescription pill bottles containing pills, and a loaded Colt .45 ACP pistol. Also seized from the barn were digital scales with white powder residue, plastic bags, ammunition, an SKS rifle and magazine, a Ruger model 10-22 carbine, and marijuana.
The defendants made an initial appearance before U.S. Magistrate Judge H. Kenneth Schroeder, Jr. Anthony Allee was detained. Tashira Allee was released on conditions.
The complaint is the result of an investigation by the Orleans County Sheriff’s Office, under the direction of Sheriff Randy Bower, and Homeland Security Investigations, under the direction of Special Agent-in-Charge Kevin Kelly.

Lockport Man Indicted on Cocaine ConspiracyRead the Press Release

Kennedy, Jr. announced today that a federal grand jury has returned an indictment charging Gilberto Marchese, a/k/a, Noel, 38 of Lockport, NY, with conspiracy to distribute cocaine, attempted possession with intent to distribute of cocaine, possession with intent to distribute, and distribution of, cocaine, and maintaining a drug-involved premises. The charges carry a mandatory minimum penalty of five years in prison, a maximum of 40 years, and a $5,000,000 fine.
Assistant U.S. Attorney Justin G. Bish, who is handling the case, stated that according to the indictment, between December 2015 and March 27, 2019, the defendant conspired with other individuals to sell cocaine in the Lockport, NY area. In addition, Marchese is accused of using the residence at 150 Grand Street in Lockport, for the purpose of manufacturing, distributing, and using cocaine.
Marchese was arraigned before U.S. Magistrate Judge Michael J. Roemer and released on conditions.
The indictment is the culmination of an investigation by Homeland Security Investigations, under the direction of Special Agent-in-Charge Kevin Kelly, and the Niagara County Drug Task Force, under the direction of Niagara County Sheriff James Voutour.

Buffalo Man Sentenced on Illegal Gun Possession ChargeRead the Press Release

Kennedy, Jr. announced today that Errick Roseboro, 26 of Buffalo, NY, who was convicted of being a person prohibited from possessing a firearm, was sentenced to serve 12 months and one day in prison by U.S. District Judge Lawrence J. Vilardo.
Assistant U.S. Attorney Charles J. Volkert, Jr., who is handling the case, stated that on October 21, 2018, the Buffalo Police Department stopped the defendant’s vehicle for a traffic infraction. Officers found Roseboro unlawfully to be in possession of a loaded firearm and marijuana. Subsequent investigation determined that that the defendant was a habitual user of the controlled substance, and as such, he is prohibited from possessing a firearm.

Cheektowaga Man Pleads Guilty to Selling FentanylRead the Press Release

FAX #: (716) 551-3051BUFFALO, N.Y. - U.S. Attorney James P. Kennedy, Jr. announced today that Byron Cobb, aka Tone, 39, of Cheektowaga, NY, pleaded guilty before U.S. District Judge Richard J. Arcara to possession with intent to distribute 40 grams or more of fentanyl. The charge carries a mandatory minimum penalty of five years in prison, a maximum penalty of 40 years, and a $5,000,000 fine.
Assistant U.S. Attorneys Seth T. Molisani and Jeremiah E. Lenihan, who are handling the case, stated that in July 2017, the Drug Enforcement Administration began investigating the narcotics trafficking activities of the defendant. Between July 27, 2018, and February 13, 2018, investigators conducted 11 controlled purchases of heroin from Cobb.
On February 20, 2018, investigators executed a search warrant at the defendant’s Sidney Street residence in Buffalo. Officers seized multiple plastic bags containing suspected fentanyl, two digital scales, a strainer with suspected drug residue, and drug packaging materials.

Kennedy, Jr. announced today that Duke Jimenez, 36, of Buffalo, NY, who was convicted of production and possession of child pornography, was sentenced to serve 42 years in prison and a lifetime of supervised released by U.S. District Judge Richard J. Arcara.
Assistant U.S. Attorney Aaron J. Mango, who handled the case, stated that between February 10 and October 27, 2014, the defendant engaged in sexual contact with a three-year-old female child entrusted to his care. This conduct resulted in both physical and emotional harm to the child. In a written victim impact statement, the victim’s mother stated that the child would scream and cry “the bad man’s going to kill me” and “he said he would kill me.”
During the sexual contact, Jimenez used his cellular telephone to create visual depictions of the victim engaging in sexually explicit conduct. The images were located on the defendant’s SD card. Jimenez was arrested by the Buffalo Police Department on November 18, 2015, at which time the defendant’s telephone was seized. A subsequent search of phone and SD card in the phone revealed 18 image files which depicted the victim engaging in the sexually explicit conduct.
“While kids often seek to escape imaginary childhood monsters by hiding under their covers, where those monsters are real, we must do all that we can to capture and cage them,” noted U.S. Attorney Kennedy. “This sentence illustrates just how seriously we take our obligation to protect the most vulnerable among us.”

Kennedy, Jr. announced today that a federal grand jury has returned an indictment charging Victor Quinones, 22, of Buffalo, NY, with distribution of heroin, possession with intent to distribute butyryl fentanyl, and maintaining a drug-involved premises. The charges carry a maximum penalty of 20 years in prison and a $1,000,000 fine.
Assistant U.S. Attorney Charles J. Volkert, Jr., who is handling the case, stated that according to the indictment, between September 2018 and July 18, 2019, the defendant maintained and used a home at 165 Leroy Avenue in Buffalo for the purpose of drug trafficking. On July 16, 2019, Quinones sold heroin to an individual working with the FBI.
On July 18, 2019, investigators executed a federal search warrant at 165 Leroy Avenue. Officers seized drug packaging materials and a quantity of butyryl fentanyl. The defendant was arrested at that time.Quinones was arraigned before U.S. Magistrate Judge H. Kenneth Schroder, Jr. and is being detained.

Assistant U.S. Attorney Michael DiGiacomo, who handled the case, stated that on September 5, 2017, investigators found the defendant in possession of child pornography on multiple computers, hard drives, and cellular telephones. Doyle downloaded the images and videos from various websites. Some of the images and videos depicted prepubescent minors under 12 years old, violence, and the sexual abuse of an infant.

Two Men Arrested, Charged with Smuggling Marijuana into the United StatesRead the Press Release

Kennedy, Jr. announced today that Jason Ng, 59, of Woodside, NY, and Can Ren Li, 56, of Norwich, CT, were arrested and charged by criminal complaint with smuggling of goods into the United States, importation of a controlled substance, and possession with intent to distribute a controlled substance. The charges carry a maximum penalty of 20 years in prison and a $250,000 fine.
Assistant U.S. Attorney Jeremiah E. Lenihan, who is handling the case, stated that according to the complaint, on August 12, 2019, at approximately 11:10 a.m., the defendants attempted to enter the United States from Canada at the Rainbow Bridge Port of Entry in Niagara Falls, NY. Ng and Li were in a vehicle bearing New Jersey temporary license plates. During primary inspection, Ng, who was the driver, declared that he and Li spent one night at the casino and were returning to Buffalo. However, a Customs and Border Protection Officer noticed that both defendants had frequent border crossings at different ports of entry in different plated vehicles. The officer opened the back of the van and observed five spare tires. When asked why he had the tires, Ng stated that he had a tire repair business. Ng declared $1,000.00 U.S. currency and Li declared $125.00 U.S. currency. The defendants were then referred for secondary inspection.
During secondary inspection, the defendants stated that they did not have any alcohol, tobacco, marijuana, or any other illicit drugs. However, a K9 dog alerted to the side door of the van, as well as the five tires in the back of the van. An x-ray exam was conducted on the tires which showed compacted material inside the empty space of the tires. A drill was used to probe the tires and multiple plastic bags of suspected marijuana were discovered.
The defendants made an initial appearance this morning before U. S. Magistrate Judge Michael J. Roemer. Defendant Li was released on conditions. Defendant Ng was released on $25,000 bond.

North Tonawanda Man Sentenced to 12 Years in Prison After Officers Find 30 Kilograms of Cocaine in His CarRead the Press Release

Kennedy, Jr. announced today that Edgar Joel Jimenez-Rodriguez, 40, of North Tonawanda, NY, who was convicted of conspiracy to possess with intent to distribute, and to distribute, five kilograms or more of cocaine, was sentenced to serve 144 months in prison by Chief U.S. District Judge Frank P. Geraci, Jr.
Assistant U.S. Attorney Michael J. Adler, who handled the case, stated that between October 2017 and July 19, 2018, the defendant conspired with Jose Garcia-Santiago, Katherine Dejesus-Gonzalez, and others, to distribute cocaine. On July 19, 2018, the defendant picked up a Mercury Mariner containing 30 kilograms of cocaine, which was intended for distribution in the Western New York area. Law enforcement stopped the vehicle and arrested the defendant.
Previously, beginning in May 2018, investigators intercepted numerous conversations involving the defendant discussing cocaine trafficking and the associated proceeds. Many of those conversations were with co-conspirators Garcia-Santiago and DeJesus-Gonzalez, whom the defendant supervised. On May 26, 2018, law enforcement officers stopped a vehicle, driven by Garcia-Santiago with DeJesus-Gonzalez as the passenger, and found five kilograms of cocaine which defendant had previously directed them to pick up from the New York City area for distribution locally.
Prior to that, in September 2017, the U.S. Postal Service intercepted packages containing approximately five kilograms of cocaine which had arrived from Puerto Rico and, though addressed to various residences in Niagara Falls, were ultimately destined to defendant and his co-conspirators.
Jose Garcia-Santiago was previously convicted and is awaiting sentencing. Charges remain pending against Katherine Dejesus-Gonzalez. The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty.

Geraci, Jr. to conspiracy to transfer firearms purchased outside of state of residency, and possession with intent to distribute cocaine. The charges carry a maximum penalty of 20 years, and a $1,000,000 fine.
Assistant U.S. Attorneys Timothy C. Lynch and Emmanuel O. Ulubiyo, who are handling the case, stated that between December 2017 and March 23, 2018, the defendant, who was engaged in narcotics trafficking, conspired with Robert Lincoln to transport firearms from Pennsylvania to New York. At the direction of Anderson, Lincoln made straw purchases of firearms in Pennsylvania in his own name. The firearms were then transported to New York. Lincoln purchased three rifles and a shotgun for Anderson.
On March 9, 2018, during the execution of a state search warrant at the defendant’s residence on Willard Street Extension in Ellicott, law enforcement officers recovered approximately 62 grams of cocaine, a digital scale, and small baggies. Officers also seized the four firearms purchased by Robert Lincoln, as well as 11 other firearms. Anderson admitted the firearms were used in connection with his drug trafficking activities.
Robert Lincoln was previously convicted and is awaiting sentencing.

Assistant U.S. Attorney Seth T. Molisani, who handled the case, stated that on November 14, 2017, two Buffalo Police Officers observed a blue 2013 Dodge Avenger park in the vicinity of 1310 Broadway for a few minutes before leaving. Approximately 20 minutes later, the officers observed the same vehicle park again near 1310 Broadway, where it once again remained for a few minutes before departing.
The officers followed the vehicle to the intersection of Broadway and Miller Avenue, at which time the defendant jumped out of the front passenger door of the vehicle and shuffled through traffic to the sidewalk. The officers got out of their vehicle and approached Scales who placed his right hand into the pocket of his hoodie. Concerned that the defendant was reaching for a weapon, one the officers took the defendant’s hand and pulled it from the pocket. Scales was clutching a large plastic bag. Inside the bag were nine bundles which contained 81 white and blue-checkered glassine envelopes of butyryl fentanyl.

Buffalo Man Pleads Guilty to Committing A Bomb HoaxRead the Press Release

Geraci, Jr. to false information and hoaxes. The charge carries a maximum penalty of five years in prison and a $250,000 fine.
Assistant U.S. Attorneys Joel L. Violanti and Brendan T. Cullinane, who are handling the case, stated that on October 26, 2018, the defendant placed an apparent explosive device near the front door of the Buffalo Police Department station house on South Park Avenue in Buffalo. He then placed a second similar-type device in the back of the same police station. Both devices had all the features of a homemade explosive-type bomb, with protruding wires wrapped around a pipe-like instrument. The devices were safely secured by the Erie County Sheriff’s Department’s bomb squad, the ATF, and the FBI, but were later determined to be “clear of hazard.”
The following day, on October 27, 2018, Timpanaro placed another apparent explosive device near the front of the United States Postal Service, also on South Park Avenue in Buffalo. Once again, the device appeared to be a bomb, with protruding wires wrapped around a pipe-like instrument, with screws and nails. This device also contained a note stating, “RESIST COMMUNISM, THE POLICE STATE AND THE DEMOCRATIC PARTY.” This device was also safely secured and determined to be “clear of hazard.”
On November 2, 2018, the FBI and Buffalo Police executed a search warrant at the defendant’s Richfield Avenue residence. Investigators seized materials consistent with fake bombs, including broom stick handles, shavings, wires, and other materials. Timpanaro was subsequently arrested and charged by criminal complaint.
Later on November 2, 2018, the defendant made an initial appearance before U.S. Magistrate Judge H. Kenneth Schroeder, Jr., who ordered Timpanaro to complete an inpatient psychiatric and alcohol evaluation at the Buffalo VA Medical Center. Between January 26 and January 27, 2019, the defendant failed to comply with Judge Schroeder’s order to abide by all rules and directives of the inpatient treatment program, when he left the facility. Timpanaro was quickly apprehended by the U.S. Marshal Fugitive Task Force.

Rochester Man Pleads Guilty for His Role in Drug Trafficking OrganizationRead the Press Release

Geraci, Jr. to conspiracy to possess with intent to distribute, and to distribute, fentanyl, cocaine, and crack cocaine. The charge carries a maximum penalty of 20 years in prison, and a $1,000,000 fine.
Assistant U.S. Attorney Matthew T. McGrath, who is handling the case, stated that the defendant was a member of a drug trafficking organization led by co-defendant Jose Casado. Between December 2017 and May 2019, the organization distributed large quantities of fentanyl, cocaine, and crack cocaine out of drug houses located on Clifford Avenue and Treyer Street in Rochester.
Jose Casado would obtain bulk quantities of fentanyl, heroin, and cocaine, and he and other members of the conspiracy would package the substances to be sold to individual drug users. Drug users would contact Jose Casado directly via cellular phone to order quantities of drugs, and Mullins and others would serve as drug runners, delivering the drugs to the customer. On November 28, 2018, the defendant delivered 30 baggies of cocaine and 30 baggies of fentanyl to an undercover law enforcement officer.
On March 14, 2019, a search warrant was executed at the Clifford Avenue residence used by the drug trafficking organization. Investigators recovered 18 baggies of fentanyl, nine baggies of powder cocaine and nine baggies of crack cocaine, as well as numerous materials used to package controlled substances, 1,800 rounds of .22 caliber ammunition, and 50 shotgun shells.
Mullins is one of seven defendants charged in this case; he is the first to be convicted. Charges remain pending against the remaining six defendants. California Man Sentenced to 12 Years in Prison for His Role in Operating A Multi-Million Dollar Continuing Criminal Enterprise That Was Engaged in Narcotics Trafficking in Western New YorkRead the Press Release

Kennedy, Jr. announced today that Jose Ruben Gil, 53, of Bell Gardens, California, who was convicted of operating a continuing criminal enterprise and money laundering conspiracy, was sentenced to serve 144 months in prison by U.S. District Judge Lawrence J. Vilardo.
Assistant U.S. Attorneys Meghan Tokash and Wei Xiang, who handled the case, stated that between June 2013 and September 2015, the defendant conspired with others to sell cocaine in the Western District of New York. The defendant formed a relationship with co-defendant Darryl Williams, who agreed to distribute large amounts of drugs for Gil in Western New York and other cities. Gil, who was based out of California, requested that Darryl Williams and co-defendant Troy Gillon meet with him in California on at least two occasions to arrange for the set-up and delivery of illegal narcotics to Buffalo and other cities. The defendant began sending large shipments of cocaine via surface shipment on tractor-trailers, the proceeds of which were sent back to Gil via surface transportation.
On June 23, 2013, California Highway Patrol stopped a tractor-trailer in Barstow, California which resulted in the seizure of approximately $420,000 in United States Currency. The cash seized from the tractor¬ trailer was money collected from the sale of heroin and cocaine in the Buffalo area that Darryl Williams was sending to Gil.
Following Gil’s arrest in California on January 13, 2014, his associate, Herman Aguirre, continued the cross-continent drug trafficking operation. After Gil's arrest, the money obtained from drugs sales in Buffalo and other East Coast cities, was brought to Bank of America locations in Western New York, and deposited it into accounts held by three California-based corporations, including Triton Foods, Kamara Investments, and Fresh Choice Produce.
One coconspirator alone was responsible for depositing approximately $19,000,000 in cash derived from drug trafficking into those accounts. Once the money was deposited, the principals of the three California corporations engaged in further financial transactions for the purpose of withdrawing or otherwise debiting the funds from the bank accounts to give to Gil and/or Herman Aguirre to pay for the heroin, cocaine and fentanyl.
The transactions were designed to avoid a transaction reporting requirement under Federal law and made with knowledge that the money involved in the financial transactions represented the proceeds of narcotics trafficking.
A total of 17 defendants were charged and convicted in this case.

Assistant U.S. Attorneys Charles J. Volkert, Jr. and Justin G. Bish, who handled the case, stated that on August 5, 2018, Buffalo Police Officers observed a black vehicle, traveling eastbound on Winspear Avenue, violating several New York State traffic laws. Officers conducted a vehicle stop and determined that the defendant was not suitable to operate a motor vehicle. As officers attempted to secure Hatten and place him in handcuffs, he pushed them away, pulled a firearm from his waistband, began to flee on foot, and pointed the firearm in the direction of the officers. The defendant was ultimately apprehended on Highgate Avenue. The firearm was a 9mm pistol.
In August 2011, Hatten was convicted of a felony for Criminal Possession of a Weapon Second Degree in Erie County Court and is legally prohibited from possessing a firearm.

Buffalo Man Sentenced to More Than Two Years in Prison for Being A Felon in Possession of A FirearmRead the Press Release

Assistant U.S. Attorney Emmanuel O. Ulubiyo, who handled the case, stated that on March 25, 2018, two Buffalo Police Officers were flagged down by an unidentified civilian yelling and screaming, “he has a gun,” while simultaneously pointing his hands in the direction of a parking lot in the vicinity of Jefferson Avenue and Genesee Street. The officers observed another civilian pointing a firearm at the defendant as well as a firearm on the ground next to the defendant’s feet. After making eye contact with the officers, the defendant jumped into the rear seat of a vehicle. Seconds later, the defendant exited the vehicle and fled on foot. The defendant was quickly apprehended in the vicinity of Virginia and Cherry Streets by the officers.
One of the civilians, who identified himself as a sworn Peace Officer and licensed gun owner, reported that he observed and later broke up a physical fight between the defendant and an unidentified male and a female outside Arthur’s Pub in the vicinity of Jefferson Avenue and Genesee Street. After the fight, defendant went across the street and got into the aforementioned vehicle. The civilian observed the female who had been involved in the fight approach the car and spit in the defendant’s face. The defendant got out, approached the rear bumper, and removed a gun. The civilian withdrew his concealed firearm from his holster, pointed the gun at Baker and gave a verbal command to the defendant to drop his gun. Baker complied.
Officers subsequently recovered a loaded, .380 caliber pistol, on the ground next to where the defendant was standing prior to fleeing. Officers also recovered a loaded 12 gauge shotgun from the vehicle.
Baker was previously convicted of Attempted Criminal Possession of a Weapon in the 2nd degree in Erie County Court and is legally prohibited from possessing a firearm.

Assistant U.S. Attorney John D. Fabian, who handled the case, stated that in January and February of 2015, the defendant conspired with co-defendant D'Angelo Conner to engage in sex trafficking of minors. Connor managed an escort business which advertised two victims (Victim 1 and Victim 2) on backpage.com. At Connor’s request, Walker acted as a driver for the business, transporting Victim 1 and Victim 2 to prostitution appointments. The defendant was paid $25 per trip. Walker did so knowing or recklessly disregarding that both Victim 1 and Victim 2 were minors who engaged in commercial sex acts during the appointments.
On February 25, 2015, the defendant drove Victim 1 to a prostitution appointment at a hotel in Cheektowaga, NY. On that date, as well as on the two preceding days, February 23 and 24, 2015, Connor used the defendant’s cell phone to exchange text messages with Victim 1 regarding prostitution appointments and activities.
D'Angelo Conner was previously convicted and sentenced to serve 90 months in prison.

Maio, 34, of East Randolph, NY, with narcotics conspiracy, and possession with intent to distribute methamphetamine and marijuana. If convicted, defendants face a mandatory minimum penalty of 10 years in prison, a maximum of life in prison, and a $10,000,000.
Maio is also charged with using and maintaining a drug-involved premises, and possession with intent to distribute methamphetamine on premises where an individual under 18 was present and resided.
“Today we unveil a new weapon which we deploy as part of our effort to protect our community from the scourge that methamphetamine trafficking brings to it,” noted U.S. Attorney Kennedy. “This indictment marks the first time that any person in the Western District of New York has been charged with violating Title 21, United States Code, Section 860a, which requires that the sentencing court impose a mandatory, additional, consecutive term of up to 20 years in prison, whenever a methamphetamine-related drug offenses occurs on a premises at which a child is present. While we have directed much of our recent law enforcement effort to combatting deadly opioids, methamphetamine—though it may be a slower death—also kills. When it comes to protecting our community, new threats warrant new responses.”
Assistant U.S. Attorney Joshua A. Violanti, who is handling the case, stated that according to the indictment and a previously filed complaint, beginning in March 2018, the Jamestown Police Department Narcotics Unit began investigating Maio and Smith for the distribution of methamphetamine in and around the City of Jamestown. The investigation included controlled purchases of narcotics from defendant Maio.
On January 23, 2019, the Southern Tier Regional Drug Task Force executed a state search warrant at Maio’s residence on Main Street in East Randolph, NY. Maio and Smith were present at the time, along with two other adults and three minor children. Smith attempted to leave the residence but was detained and searched. Investigators recovered suspected crystal methamphetamine and on Smith. They also searched Maio and recovered suspected crack cocaine and a large amount of cash.
During a search of the residence, investigators recovered suspected marijuana, crystal methamphetamine, a digital scale, and other drug packaging and paraphernalia.
The defendants were arraigned this morning before U.S. Magistrate Judge Michael J. Roemer and detained.
The indictment is the result of an investigation by the Jamestown Police Department, under the direction of Chief Harry Snellings, the Drug Enforcement Administration, under the direction of Special Agent-in-Charge Ray Donovan, New York Field Division, and the Southern Tier Regional Drug Task Force, under the direction of Cattaraugus County Sheriff’s Office Lieutenant Ronald Lott.

Michigan Man Pleads Guilty for His Role in Scheme That Defrauded Victims Out of Millions of DollarsRead the Press Release

Kennedy, Jr. announced today that Leonard Smith, 54, of Clawson, Michigan, pleaded guilty to conspiracy to commit wire fraud, before U.S. District Judge Richard J. Arcara. The charge carries a maximum penalty of 20 years in prison and a $769,200 fine.
Assistant U.S. Attorney Douglas A. Penrose, who is handling the case, stated that between May 2010 and July 2015, the defendant conspired with others fraudulently to obtain money and property from investors. As part of the scheme, Smith, who was a financial advisor, solicited investments from his clients at two companies—i2i Capital LLC and i2i Settlement Partners LLC. The companies, which were formed by co-conspirators Christopher Dillon and Gilbert Lynagh, were incorporated in Delaware but listed a business address in Lancaster, NY.
Thereafter, Smith, Dillon, Lynagh, and other members of the conspiracy, caused 27 victims to invest over $5,000,000 in i2i Capital and/or i2i Settlement Partners. False and fraudulent representations were made to victims regarding the nature of the investment and the associated risks, duration, and rates of return. Smith also misrepresented his compensation regarding the victims’ investments in the companies. The majority of victim funds were utilized by Smith, Dillon, Lynagh, and other members of the conspiracy in a manner that was not authorized by the victims, including for personal use. None of the victims received the promised return on their investments, and none saw the return of their original investment funds as promised by Smith, Dillon, and Lynagh.
Gilbert Lynagh and Christopher Dillon were previously convicted for their roles in the conspiracy.
The plea is the result of an investigation by the Federal Bureau of Investigation, Buffalo Office, under the direction of Special Agent-in-Charge Gary Loeffert.
Sentencing is scheduled for November 18, 2019, at 12:30 p.m. before Judge Arcara.

McDuffie, a/k/a “G”, 24, of Buffalo, NY, who was convicted of distribution of heroin and butyryl fentanyl causing death, and distribution of fentanyl, butyryl fentanyl, and furanyl fentanyl causing death, was sentenced to serve 262 months in prison by U.S. District Judge Lawrence J. Vilardo.
“Our community has adopted a multi-faceted approach—including enforcement, treatment, and prevention efforts—in our battle against the deadly opioid epidemic,” stated U.S. Attorney Kennedy. “While that approach has produced positive results, too many of our loved ones and friends continue to die. Just as the Erie County Opiate Task Force has sought to build on prior successes by devising new and innovative treatment and prevention efforts, this Office, together with our law enforcement partners, has been extremely forward-leaning in our effort to develop a comprehensive and relentless law enforcement plan to take-out those who are fill our streets with these deadly opioids. While no amount of jail time will ever bring back an overdose victim, aggressive prosecutions such as this, which result in long prison sentences, serve: to protect our community, by ensuring that this defendant will not have the opportunity to fatally poison anyone else in our community for a very long time; to deter others from engaging in future drug trafficking activity, by letting them know that they will face severe and certain punishment if they distribute drugs that injure or kill others; and finally, to reinforce the message that, in our Western New York community, all lives are deemed to be worthy of protection.”
Assistant U.S. Attorneys Misha A. Coulson and Wei Xiang, who handled the case, stated that on June 27, 2015, the defendant met with a repeat drug customer identified as “A.E,” a 24 year-old Cheektowaga man. McDuffie sold A.E. a quantity of powder that the defendant advertised as “fire,” a mixture that contained heroin and butyryl fentanyl. A.E. died as a result of using the drugs McDuffie provided to him.
On November 23, 2016, McDuffie met with another repeat drug customer identified as “D.M,” a 34 year-old West Seneca man, and sold him a quantity of powder that the defendant advertised once again as “fire.” This mixture contained fentanyl, butyryl fentanyl, and furanyl fentanyl. D.M. also died as a result of using the drugs McDuffie provided to him.
On November 30, 2016, law enforcement officers arrested McDuffie leaving his residence in Buffalo. The defendant was on his way to distribute a quantity of powder that contained fentanyl, butyryl fentanyl, and furanyl fentanyl. Under McDuffie’s living room couch, officers recovered a Hi-Point, .40 caliber semi-automatic handgun that was loaded with eight rounds of .40 caliber ammunition.
The sentencing is result of an investigation by the Drug Enforcement Administration, under the direction of Ray Donovan, Special Agent-in-Charge, New York Field Division; Cheektowaga Police Department, under the direction of Chief David Zack; and the West Seneca Police Department, under the direction of Chief Daniel Denz.

Two Men Arrested at the Lewiston Queenston Bridge for Their Roles in Attempted Illegal EntryRead the Press Release

Garcia, 42, of Toronto, Ontario, and Jose Herrera-Galvaz, 43, a citizen and native of Chile, were arrested and charged by criminal complaint with harboring an illegal alien and attempted illegal entry respectively. Garcia faces five years in prison if convicted; Herrera-Galvaz faces six months in prison if he is convicted.
Assistant U.S. Attorney Meghan A. Tokash, who is handling the case, stated that according to the complaint, on August 5, 2019, a commercial truck with Ontario, Canada plates, being driven by defendant Garcia, attempted to enter the United States at the Lewiston Bridge Port of Entry. During primary inspection, Garcia was asked if anyone else was present in the truck and he stated “No.” Garcia was then referred to the Vehicle and Cargo Inspection System (VACIS) for a scan of the truck. Garcia appeared to drive toward the VACIS area, but instead of reporting directly to the VACIS exam area, he drove the truck in front of the warehouse. A CBP Officer saw the truck park for a brief moment in front of the warehouse, and saw an individual, later identified as Herrera-Galvaz, get out of the truck and walk directly into the entrance of the warehouse. The truck then turned around in the parking lot and headed towards the VACIS examination area.
The CBP officers alerted other officers who began to search the warehouse building for the person who exited the truck. Herrera-Galvaz was located in the hallway of the warehouse. Officers indicted that he appeared nervous and was speaking Spanish. It was determined that Herrera-Galvaz was the individual who exited the truck that had pulled in front of the warehouse. During a search of Herrera-Galvaz, officers found, concealed in Herrera-Galvaz’s pants, a Chilean passport, bearing his photograph and biographical information. Herrera-Galvaz and Garcia were referred to the secondary inspection area for further inspection.
A subsequent record check determined that Herrera-Galvaz was refused entry to the United States under the Visa Waiver Program, at the Toronto, Ontario Pre-flight Inspection Station on August 4, 2019. Herrera-Galvaz was refused entry for failing to disclose an arrest in Chile on his Electronic System for Travel Authorization (ESTA) application. As a result, he must obtain a Visa prior to attempting to enter the United States at any time.
The defendants made an initial appearance before U.S. Magistrate Judge Michael J. Roemer and were detained.
The complaint is the result of an investigation by Customs and Border Protection, under the direction of Director of Field Operations Rose Brophy.

Rochester Man Pleads Guilty in Theft of over 90 Guns Taken During Gun Store BurglariesRead the Press Release

Wolford to theft of firearms from a Federal Firearms Licensee and possession of stolen firearms. The charges each carry a maximum penalty of 10 years in prison and a $250,000 fine.
Assistant U.S. Attorney Brett A. Harvey, who is handling the case, stated that Sarfaty, along with co-defendants Luis D. Marcano-Agosto and Marcos D. Guzman, broke into Chinappi’s Firearms & Supplies, a gun store located at 5016 West Ridge Road in Spencerport, NY, in the early morning hours of August 16, 2018. Sarfaty entered the basement through a hole in the wall and, together with Marcano-Agosto and Guzman, stole approximately 87 firearms, almost all of which were handguns. Guzman, Sarfaty and Marcano-Agosto then sold many of the firearms on the streets of Rochester. Investigators recovered 14 of the stolen firearms in the days after the theft.
Sarafty also admitted to breaking into Chinappi’s Firearms & Supplies and stealing approximately seven firearms on August 12, 2018.
The plea is the result of an investigation by the Bureau of Alcohol, Tobacco, Firearms and Explosives, under the direction of Special Agent-in-Charge John B. Devito, New York Field Division; the Monroe County Sheriff’s Office, under the direction of Sheriff Todd Baxter; and the Rochester Police Department, under the direction of Chief La’Ron Singletary.

Niagara Falls Man Arrested, Facing Cocaine and Fentanyl Distribution ChargesRead the Press Release

Kennedy, Jr. announced today that Jake Seright, 40, of Niagara Falls, NY, was arrested and charged by criminal complaint with possession with the intent to distribute 500 grams or more of cocaine, and possession with the intent to distribute 10 grams or more of fentanyl. The charges carry a mandatory minimum penalty of five years in prison, a maximum of 40 years, and a $5,000,000 fine.
Assistant U.S. Attorney Misha A. Coulson, who is handling the case, stated that on July 19, 2019, investigators obtained a federal search warrant for the defendant’s Zito Drive apartment in Niagara Falls. In anticipation of executing the search warrant, investigators conducted surveillance in the vicinity during the afternoon and evening hours of August 5, 2019. At approximately 11:20 p.m., a vehicle stop was conducted of a vehicle the defendant was driving. A quantity of marijuana was recovered from Seright, who was arrested at that time.
On August 6, 2019, investigators executed the search warrant at the Zito Drive apartment and seized approximately two kilograms of cocaine and 88 grams of suspected fentanyl from the apartment.
The defendant made an initial appearance before U.S. Magistrate Judge Michael J. Roemer and are being held pending a detention hearing on August 9, 2019.
The complaint is the result of an investigation by the Drug Enforcement Administration, under the direction of Special Agent-in Charge Ray Donovan, New York Field Division, and the Niagara Falls Police Department, under the direction of Superintendent Thomas Licata.

Mexican Citizen Pleads Guilty to Drug ConspiracyRead the Press Release

Kennedy, Jr. announced today that Humberto Martinez-Vega, 48, a citizen of Mexico, pleaded guilty before Senior U.S. District Judge William M. Skretny to conspiracy to possession with intent to distribute, and to distribute, one kilogram or more of heroin. The charges carry a mandatory minimum penalty of 10 years in prison, a maximum of life, and a $10,000,000 fine.
Assistant U.S. Attorney Timothy C. Lynch, who is handling the case, stated that beginning sometime in 2018 and continuing until July 26, 2018, the defendant conspired with co-defendant Giovani Ramirez-Soto, 27, also a citizen of Mexico, to sell heroin.
On July 26, 2018, a New York State Police Trooper conducted a traffic stop of a red Honda Accord, with Alabama license plates, driving on Route 20A in the Town of Warsaw in Wyoming County. The trooper approached the vehicle, which was being driven by Martinez-Vega with Ramirez-Soto as a passenger. Martinez-Vega gave the trooper an expired Georgia identification card, and told the trooper he was looking for work.
Martinez-Vega gave the trooper consent to search the vehicle. A NYSP K9 Trooper was brought to the scene. The K9 alerted to several areas of the vehicle and a subsequent search recovered 1,200 grams of suspected heroin, and approximately 421 grams of suspected methamphetamine hidden behind the front dashboard of the vehicle.
Further investigation determined that the defendants were illegally present in the United States.
Co-defendant Giovani Ramirez-Soto was previously convicted and is awaiting sentencing.
The plea is the result of an investigation by the New York State Police, under the direction of Major Edward Kennedy, and the Drug Enforcement Administration, under the direction of Special Agent-in-Charge Ray Donovan, New York Field Division.
Sentencing is scheduled for November 20, 2019, at 10:00 a.m. before Judge Skretny.

Assistant U.S. Attorney John J. Field, who is handling the case, stated that Walton worked in the finance department of a local real estate business that owned and operated numerous apartments and mobile home parks. In that capacity, the defendant was responsible for processing security deposits and security deposit refunds for tenants. Between 2011 and 2014, Walton took advantage of his position to embezzle security deposit refunds payable to tenants of the business. In total, he stole approximately $53,786.98 from the business.
The plea is the result of an investigation by Special Agents with the Rochester Office of the Federal Bureau of Investigation, under the direction of Special Agent-in-Charge Gary Loeffert.

Kennedy, Jr. announced today that Russell Ruth, 34, of Lyons, NY, who was convicted of possession of child pornography, including prepubescent images, was sentenced to serve 80 months in prison by Chief U.S. District Judge Frank P. Geraci, Jr.
Assistant U.S. Attorney Melissa M. Marangola, who handled the case, stated that between March 13 and June 7, 2018, the defendant uploaded five files containing child pornography to a Yahoo! Server. Yahoo! intercepted the files and reported to the National Center for Missing and Exploited Children (NCMEC).
Investigators determined the images were uploaded by Ruth and executed a search warrant at his residence on June 7, 2018. During the search, investigators seized electronic devices containing over 10,285 images and 602 videos of child pornography, including images of prepubescent children and images involving violence.
The defendant was employed by the Boy Scouts of America in the Ovid, NY area.The sentencing is the result of investigation by Homeland Security Investigations, under the direction of Special Agent-in-Charge Kevin Kelly.

Kennedy, Jr. announced today that a federal grand jury has returned an indictment charging Maylin Santiago, 25, and Rosa Merced, 39, both of Buffalo, NY, with conspiracy to possess with intent to distribute 500 grams or more of cocaine, and possession and attempted possession of more than 500 grams of cocaine with intent to distribute. The charges carry a mandatory minimum five years in prison, a maximum penalty of 40 years, and a $5,000,000 fine.
Assistant U.S. Attorney Charles J. Volkert, Jr., who is handling the case, stated that according to the indictment, between November 2017 and April 2018, the defendants conspired to possess and sell cocaine. On at least two occasions in March 2019, Santiago and Merced obtained or attempted to obtain postal packages from Puerto Rico that contained kilograms of cocaine. Additionally, in January 2018, Santiago sold cocaine to an individual working with the Drug Enforcement Administration.

Ratcliffe, 28, of Dorchester, MA, were arrested and charged by criminal complaint with smuggling of goods into the United States, importation of a controlled substance, and possession of a controlled substance. The charges carry a maximum of 20 years in prison and a $250,000.
Assistant U.S. Attorney Jeremiah E. Lenihan, who is handling the case, stated that according to the complaint, on Monday, August 5, 2019, at approximately 8:15 a.m., the defendants attempted to enter the United States from Canada at the Lewiston Queenston Bridge Port of Entry in Lewiston, NY. The defendants all gave a negative declaration when asked if there was any marijuana and/or contraband in the vehicle. A Customs and Border Protection office noted that Ratcliffe had a record for a prior incident involving travel with marijuana and referred the defendants for a secondary inspection.
The defendants once again gave a negative declaration for narcotics. However, when a CBP officer searched Younger’s purse, multiple rolled joints containing suspected marijuana were recovered. During a subsequent search of the vehicle, officers found commercial packaged marijuana and marijuana products in multiple bags, that the investigation suggested had been lawfully purchased at marijuana dispensaries in Canada. All three defendants were arrested at the scene.
Younger, Johnson, and Ratcliffe made an initial appearance this afternoon before U.S. Magistrate Judge Michael J. Roemer and were released on conditions.
“The possession of marijuana and its importation into the United States remain federal crimes,” noted U.S. Attorney Kennedy. “The fact that it may have been lawfully purchased in Canada does not change that. To those who may ask what’s the harm here? My response is simple. In the last two weeks right here in Erie County, two different individuals have been charged with manslaughter for having been involved in fatal car crashes while driving under the influence of marijuana. The first victim was a woman who was struck by a drugged driver while walking down a sidewalk. The second victim was a woman who was watching television in her living room when a drugged driver plowed his car into her apartment and killed her. If this office, together with our federal partners, can help to save the lives of innocent potential future victims by curbing the flow of marijuana into our community and/or by letting the public know of the significant legal consequences that flow from being charged with a violation of federal law, then we will not hesitate to act. Such actions are undertaken not only enhance the safety of our community but quite possibly to prevent today’s marijuana possessor or importer from either becoming or supplying tomorrow’s manslaughter defendant. Regardless of the law in Canada—or even New York State—the public must be aware that the manufacture, possession, distribution, or importation of marijuana remain federal crimes.”

Leader and Member of Drug Trafficking Organization Going to Prison for Selling DrugsRead the Press Release

Kennedy, Jr. announced today that Andre Cunningham, 25, and Terrence Morgan, aka Young, 24, both of Rochester, who were convicted of conspiracy to possess with intent to distribute, and distribute, 40 grams or more of fentanyl, 28 grams or more of crack cocaine, and heroin, were sentenced to serve 135 months and 87 months in prison respectively by Chief U.S. District Court Judge Frank P. Geraci, Jr.
Assistant U.S. Attorney Matthew T. McGrath, who handled the case, stated that Cunningham and co-defendant Michael Wyatt were leaders of a drug trafficking organization that distributed significant quantities of fentanyl, heroin, and cocaine base throughout the Rochester area. Wyatt would obtain bulk quantities of those controlled substances from various suppliers. Wyatt and Cunningham then supervised and directed the distribution and sale of those controlled substances to individual drug users, at various drug houses maintained for that purpose. The drug houses were operated by members of the conspiracy, including Wyatt, Cunningham, and others. The locations of the drug houses included 218 Emerson Street, and 131 Saratoga Avenue, both in Rochester.
At the direction of Wyatt or Cunningham, members of the conspiracy, including Morgan, would process, break down, and re-package the controlled substances into smaller quantities to be sold to individual drug users. Morgan was also responsible for selling the controlled substances to individual buyers. The proceeds from these individual sales were collected from Morgan and others by Wyatt and/or Cunningham at regular intervals. Morgan was compensated for his role in the conspiracy.
In addition, between July 2018 and August 7, 2018, Morgan possessed a firearm in connection with the narcotics conspiracy.
Michael Wyatt was previously convicted and is awaiting sentencing.

Assistant U.S. Attorney Cassie Kocher, who handled the case, stated that during the early morning hours of January 25, 2019, the defendant fired a shotgun multiple times outside an apartment window at 1221 Affinity Lane in Greece, NY.
Rivers was previously convicted of Criminal Possession of a Firearm in Orleans County Court, and is legally prohibited from possessing a firearm.
The case was brought by the U.S. Attorney’s Office as part of its Project Safe Neighborhoods (PSN) initiative. PSN is the centerpiece of the Department of Justice’s violent crime reduction efforts. PSN is an evidence-based program proven to be effective at reducing violent crime. Kennedy, Jr. announced today that Gabriel Murillo, 44, of San Bernadino County, California, who was convicted of attempted online enticement of a minor, was sentenced to serve 10 years in prison by U.S. District Judge Elizabeth A. Wolford.
Assistant U.S. Attorney Kyle Rossi, who handled the case, stated that between April 2018 and February 2019, Murillo engaged in sexually explicit online conversations with an individual who he believed was a 12 year old girl living in upstate New York. The defendant attempted to groom the child by sending her pornography, and despite acknowledging her age, requested that she meet with him for sex. On February 16, 2019, Murillo flew from Los Angeles, CA to Rochester, NY in order to have sex with the child. Unbeknownst to the defendant, the child was actually an undercover New York State Police Investigator.
Murillo was apprehended while disembarking a plane at the Greater Rochester International Airport on February 16, 2019, by members of the New York State Police, Homeland Security Investigations, and the Federal Air Marshal Service.

Kennedy, Jr. announced today that David Sobczyk, 43, of Buffalo, NY, who was convicted of conspiracy to commit food stamp fraud, was sentenced to two years’ probation and ordered to pay restitution totaling $82,066. He also forfeited $33,991.41.
Assistant U.S. Attorney Richard A. Resnick, who handled the case, stated that between May 2015 and April 2017, the defendant conspired with co-conspirator Paul Carroll and others to commit food stamp fraud.
Congress established the Federal Food Stamp Program in 1977 to alleviate hunger and malnutrition. In 2008, the program was renamed the Supplemental Nutrition Assistance Program (SNAP program), which uses federal tax dollars to subsidize low-income households, helping low-income individuals and families to maintain more nutritious diets by increasing the food purchasing power of eligible households. The USDA Food and Nutrition Service (FNS) administers the SNAP program through retail food stores or food truck delivery business (FTDB) that have been approved for participation in the SNAP program to sell food in exchange for the SNAP program benefits.
A business that accepts the SNAP program benefits must do so only in connection with retail sales of eligible food products, and must be authorized by FNS as a retail food store or FTDB. According to USDA regulations, most edible items, except for prepared foods, vitamins and medicines, are eligible for purchase with food stamp benefits. Items such as beer, cigarettes, paper goods, soaps and detergents are ineligible for purchase with food stamp benefits. It is also against the SNAP program regulations to allow customers to pay for merchandise on credit with EBT SNAP/food stamps. Federal law specifies that a purchase made utilizing the SNAP program benefits must be tax exempt. Food stamp benefits may not lawfully be exchanged for cash.
In 1991, co-conspirator Paul Carroll applied to FNS and received authorization to operate a business, Carroll Services, which received the SNAP program benefits. Carroll Services operated a FTDB. In November 2015, the defendant applied to FNS and received authorization to operate a business, Sobczyk Services, which received the SNAP program benefits. Sobczyk Services operated a FTDB.
Contrary to the policies governing the administration of the SNAP program benefits, Sobczyk operated his FTDB as a “for credit” operation, whereby he allowed beneficiaries to purchase items from him “on credit.” He did so by obtaining from the beneficiaries their identifying information, including their EBT card number, PIN number, and social security number. Thereafter, he would cause funds to be deducted from the beneficiaries’ SNAP benefits accounts on the date that the benefits were available on the beneficiaries’ EBT cards.
Paul Carroll provided the defendant with the vehicle to use for his FTDB and was paid by the defendant monthly for the vehicle, knowing that the defendant was operating his FTDB as a “for credit” operation contrary to program policies.
Using the 1-800 number provided by the USDA’s NYS Customer Help line, Sobczyk would direct his employees to manipulate the USDA’s telephonic system in order to identify food stamp beneficiaries’ card numbers in order for the defendant to use the cards to make false claims to FNS in order to deduct food stamp benefits from the beneficiaries.
Paul Carroll was previously convicted and is awaiting sentencing.

BUFFALO, N.Y. U.S. Attorney James P. Kennedy, Jr. announced today that Jose O. Felix, 38, of Buffalo, NY, who was convicted of possession with intent to distribute 100 grams or more of heroin, and possession of a firearm in furtherance of drug trafficking, was sentenced to serve 123 months in prison by Senior U.S. District Judge William M. Skretny.
Assistant U.S. Attorneys Laura A. Higgins and Jeremiah E. Lenihan, who handled the case, stated that on July 11, 2018, the DEA conducted a controlled purchase of heroin from the defendant. On July 19, 2018, a federal search warrant was executed at Felix’s residence at the Marine Drive Apartments in Buffalo. During the search, investigators recovered quantities of controlled substances, four firearms, ammunition, and $192,614 in U.S. currency, along with multiple drug ledger notebooks, cutting agents, and a money counter.
The defendant will also forfeit $192,614 in drug proceeds, firearms, ammunition, and jewelry valued at $34,900. U.S. Attorney Kennedy further stated that, “beyond securing a sentence which puts defendant out of business—and out of the community—for the next 10 years, our use of the forfeiture process allowed us not only to defund a drug dealer but also to use his ill-gotten gains to fund law enforcement’s efforts to catch others like him who continue to purvey this poison in our District.”

Rossi, who is handling the case, stated that in April 2018, an undercover FBI Special Agent determined that a computer at the defendant’s address in Painted Post was sharing child pornography. A federal search warrant was executed in November 2018 during which investigators seized several of Kelly’s digital devices. A forensic analysis revealed that the devices contained approximately 251 images and five videos containing child pornography, some of which involved prepubescent minors, as well as children being subjected to violence.
The plea is the result of an investigation by the Federal Bureau of Investigation, Corning Office, under the direction of Special Agent-in-Charge Gary Loeffert.

Investigators executed a search warrant in October 2018 and seized multiple digital devices. A forensic analysis recovered more than 600 images and videos containing child pornography, some of which involved prepubescent minors, as well as children being subjected to violent conduct.

Assistant U.S. Attorney Katelyn Hartford, who handled the case, stated that between May 2018 and October 15, 2018, the defendant conspired with a co-conspirator to distribute cocaine in the Rochester area.
On numerous occasions, Medina received packages, via the United States Postal Service, that had been sent from Puerto Rico to locations in Rochester, on behalf of the co-conspirator. The packages each contained approximately 500 grams of cocaine. The defendant would pick up the packages from various locations, at the direction of the co-conspirator, and then deliver them to the co-conspirator. Also in furtherance of the conspiracy, Medina distributed a quantity of cocaine to an individual in Rochester in August 2018.In addition, the defendant assisted the co-conspirator by mailing packages containing United States currency to Puerto Rico as payment for the cocaine. On August 22, 2018, Medina and the co-conspirator purchased three electronic devices from Best Buy in which to secrete United States currency that would be mailed to Puerto Rico as payment for cocaine. That same day, the defendant shipped one of those devices, with $20,500 hidden inside, via the United States Postal Service, to Puerto Rico. That money was payment for approximately one kilogram of cocaine.

Akron Man Pleads Guilty to Stealing FEMA Grant Funding Intended for Education ExpensesRead the Press Release

Assistant U.S. Attorney John D. Fabian, who is handling the case, stated that on January 12, 2015, the defendant deposited into his account at the Bank of Akron, $18,000 of grant funds intended to be used for educational expenses for his children. The funds were administered as part of a Federal Emergency Management Agency (FEMA) Staffing for Adequate Fire and Emergency Response (SAFER) grant.
Between January 12 and June 9, 2015, Lobur provided $15,000 of the grant funds to his children, but also converted more than $1,000 of the remaining $3,000 to his personal use. The defendant knew that he was not entitled to convert the grant funds to his own personal use and he knew that the intended and lawful use of the funds was for educational expenses for his children.
As part of his plea agreement, Lobur will pay restitution totaling $39,182.92. The money was used for, among other things: payments on a Yard Card, Discover Card, and FIA Card, which were used to buy a truck, lawnmower and camper, and a payment to Akron Mobile Home Park.
“It’s a sad day when a defendant chooses to line his own pockets with federal funding intended for the educational expenses of his own children,” stated U.S. Attorney Kennedy. “The SAFER grant is designed to allow individuals to serve the public as firefighters and first responders without the added burden and stress of having to figure out how to pay for their children’s education. Any misuse of such funding will not be tolerated and anyone who does attempt to abuse the program will be brought to justice.”

Wolford to two counts of Hobbs Act Robbery. The charges each carry a maximum penalty of 20 years in prison and a $250,000 fine.
Assistant U.S. Attorney Sean C. Eldridge, who is handling the case, stated that in the early morning hours of December 28, 2018, Lott went to the McDonald’s restaurant on East Avenue in Rochester with co-defendants Lavon Wims and Juwan Baldwin. Lott and Wims entered the restaurant, and Wims held a knife to the throat of an employee. Wims then dragged the employee to the cash register—and then to the safe—and demanded money. At the same time, Lott displayed what appeared to be a handgun to another McDonald’s employee. Wims and Lott then fled the McDonald’s with the stolen cash.
On January 23, 2019, Lott went to Jordy’s Spirits on Dewey Avenue in Rochester with co-defendants Lavon Wims and Kayla Dade. Lott and Wims entered the store, and Wims pointed what appeared to be a gun at the store employee, and demanded money. Lott waited by the front door of the store, and after Wims told the employee to give them money, Lott then assisted Wims in removing cash from the register drawer. Wims and Lott then fled the store with the stolen cash.

Wolford to theft of firearms from a Federal Firearms Licensee and possession of firearms by a convicted felon. The charges each carry a maximum penalty of 10 years in prison and a $250,000 fine.
Assistant U.S. Attorney Brett A. Harvey, who is handling the case, stated that Marcano-Agosto, along with co-defendants Dakota Sarfaty and Marcos D. Guzman, broke into Chinappi’s Firearms & Supplies, a gun store located at 5016 West Ridge Road in Spencerport, NY, in the early morning hours of August 16, 2018. Sarfaty entered the basement through the hole in the wall and, together with Marcano-Agosto and Guzman, stole approximately 87 firearms, almost all of which were handguns. Thereafter, Guzman, Sarfaty and Marcano-Agosto sold many of the firearms on the streets of Rochester. Investigators recovered 14 of the stolen firearms the day after the theft.

Kennedy, Jr. announced today that Mark Buechler, 45, of Henrietta, NY, who was convicted of production of child pornography involving two prepubescent minors, was sentenced to serve 30 years in prison by U.S. District Judge Elizabeth A. Wolford.
Assistant U.S. Attorney Kyle P. Rossi, who handled the case, stated that on May 3, 2018, an 11-year-old boy, minor victim 1, disclosed to his school counselor that the defendant performed various sexual acts on him on an ongoing basis at Buechler’s home in Henrietta. The counselor contacted Child Protective Services (CPS) to report the alleged incidents. A Monroe County CPS Investigator and a Monroe County Sheriff’s Office Investigator interviewed the minor victim and Buechler was arrested that day.
Also on May 3, 2018, a state search warrant was executed at the defendant’s Stone Road residence. Multiple digital and storage devices were seized, including computers, tablets, phones, SD cards, thumb drives, and digital cameras.
On May 7, 2018, Sheriff’s Office Investigators interviewed minor victim 2, an 18-year-old boy who had visited Buechler’s residence when he was younger. Minor victim 2 also disclosed that he was sexually abused by the defendant over an extended period of time. A second state search warrant was executed on May 7, 2018, at which time additional digital devices were seized.
The Federal Bureau of Investigation was contacted, and on May 24, 2018, a federal search warrant was obtained to review the items seized during the execution of the state search warrants. A review of some of the items seized uncovered approximately 8,700 images and two videos of child pornography produced by Buechler, some of which depicted the defendant abusing the minor victims. Buechler’s federal conviction follows a state court conviction secured by the Monroe County District Attorney’s Office in October 2018.“We must protect our children, the most vulnerable and precious members of our community, from predators such as this defendant,” stated U.S. Attorney Kennedy. “By combining efforts with our tremendous law enforcement partners in Monroe County, we have teamed up to ensure that we communicate—in the most forceful terms possible—that those who bring harm to our children have no place in our community.”
The sentencing is the result of an investigation by the Monroe County Sheriff’s Office, Major Crimes Unit, under the direction of Sheriff Todd Baxter; the Monroe County District Attorney’s Office, Special Victims Unit, under the direction of District Attorney Sandra Doorley; Monroe County Child Protective Services, under the direction of Amy Natale-McConnell; the Federal Bureau of Investigation, under the direction of Special Agent-in-Charge Gary Loeffert; and the Bivona Child Advocacy Center, under the direction of Executive Director Deb Rosen.

Four Florida Men Sentenced in Connection with Multi-Million Dollar Fraud Against Xerox CorporationRead the Press Release

Kennedy, Jr. announced today that Kyle Haynes, Bryan Day, Jason Haynes, and David Haynes of the Daytona, Florida area, were sentenced by U.S. District Judge Elizabeth A. Wolford for their involvement in a fraud scheme to defraud Xerox Corporation of more than $20,000,000 worth of toner.
Kyle Haynes, Bryan Day, and Jason Haynes were convicted of conspiracy to commit wire fraud and filing a false tax return, and were sentenced to serve 30 months, 27 months, and six months in prison respectively. David Haynes, who was convicted of filing a false tax return, was sentenced to a three year term of probation.
In addition, Kyle Haynes, Bryan Day, and Jason Haynes were ordered to pay $9,475,000 in restitution to Xerox. David Haynes was ordered to pay $884,000 in restitution to Xerox. All four defendants were also ordered also to pay approximately $25,000 in restitution to the Internal Revenue Service.
Assistant U.S. Attorney Richard A. Resnick, who handled the case, stated that Xerox is located in, among other places, Webster, NY, and sells and leases office equipment, including printers. The company sells or leases the office equipment directly to end-user customers or to authorized resellers, like Robert Fisher, a co-conspirator and owner of RBM Imaging, who then resell or lease the office equipment to end-user customers, like the four defendants. The office equipment requires toner and other products to operate. End-user customers order the toner for their printers from Xerox. Rather than pay Xerox upfront for the toner, however, the end-user customers pay Xerox based on the number of prints made with the toner. Until consumed by the end-user customers, the toner belongs to Xerox. At no time may the end-user customers sell the toner.
The Haynes’ and Day set up a sham company, HDH Graphics, to obtain approximately 63 Xerox printers from Robert Fisher. Although HDH Graphics made few, if any, prints with the printers, the defendants fraudulently represented to Xerox that HDH Graphics was making prints, using much more toner than the industry average. In executing the scheme, the defendants repeatedly misrepresented to Xerox that they were making millions of prints with the toner, even though they never took most of the printers out of their boxes. Their deception caused Xerox to ship approximately $25,000,000 worth of toner to HDH Graphics. The defendants then sold the fraudulently obtained toner for approximately $11,000,000 to an individual in Miami, Florida. The Haynes’, Day and Fisher shared the profits from the fraudulent sale of the Xerox toner.
The Haynes’ and Day also filed false personal income tax returns with the Internal Revenue Service for the years 2008 through 2013. Their personal tax returns failed to report net income HDH Graphics earned from the fraudulent sale of the Xerox toner. Because HDH Graphics was a partnership, all of its net income flowed through to the defendants’ personal tax returns. Therefore, the underreporting of the net income on HDH Graphics’ tax returns resulted in the underreporting of the income on the defendants personal tax returns.
The Haynes’ and Day underreported the net income earned by HDH Graphics by falsely claiming that they had personally paid and incurred travel and shipping expenses on behalf of HDH Graphics. They then had HDH Graphics reimburse them for the falsely claimed expenses and falsely reported such expenses as deductions on HDH Graphics’ tax returns. The falsely reported deductions on HDH Graphics’ tax returns were approximately $265,154, resulting in approximately $265,154 less in net income being reported on the corporate returns. As a result, 25 percent of such income, that is, approximately $66,288.50, should have flowed through as income to the defendant’s personal tax returns.
The defendants agreed to forfeiture of over $600,000 in cash in lieu of the forfeiture of several real properties that were purchased and funded with fraud proceeds.
“Prosecutions such as this should send the message that fraudulent gains are never secure,” stated U.S. Attorney Kennedy. “This Office, together with our federal law enforcement partners, will continue aggressively to investigate and prosecute those who seek to profit through dishonesty.”
“The truth about scams like this is that losses suffered by companies often get passed on to the consumer in the forms of higher prices, which is why we must hold the operators of these schemes accountable,” said Kevin Kelly, Special Agent-in-Charge for HSI Buffalo. “HSI special agents will continue to use their broad authorities to uncover financial schemes and ensure that those who seek to blatantly disregard the law for their own financial gain are brought to justice.”
The sentencings are the result of an investigation by Homeland Security Investigations, under the direction of Special Agent-in-Charge Kevin Kelly, and the Internal Revenue Service, Criminal Investigation Division, under the direction of Jonathan D. Larsen, Special Agent-in-Charge.
