Rosebud Man Charged with Possession of Child PornographyRead the Press Release
United States Attorney Brendan V. Johnson announced that Jeremy Gunhammer, age 20, of Rosebud, South Dakota, appeared before U.S. District Judge Roberto A. Lange on November 19, 2013, and pled guilty to Possession of Child Pornography.
The maximum penalty upon conviction is 10 years in custody and/or a $250,000 fine, life of supervised release, and $100 to the Federal Crime Victims Fund.
The conviction stems from incidents that took place between January 1, 2013, and May 31, 2013, when Gunhammer would use the internet to receive and possess images of child pornography. Gunhammer knew that the child pornography images were produced using material that had been mailed and shipped and transported in interstate and foreign commerce by means of computer, cellular phone, Facebook, and other online services.
The investigation was conducted by the Federal Bureau of Investigation, South Dakota Division of Criminal Investigation, South Dakota Internet Crimes Against Children Task Force, Rosebud Sioux Tribe Law Enforcement Services, Bureau of Indian Affairs, Pennington County Sheriff’s Office, Rapid City Police Department, Sioux Falls Police Department and the U.S. Marshals Service. Assistant U.S. Attorneys Tim Maher and Sarah Collins are prosecuting the case.
A presentence investigation was ordered and a sentencing date was set for January 27, 2013. The defendant was released on conditions pending sentencing.
Rosebud Man Charged with Assault Resulting in Serious Bodily InjuryRead the Press Release
United States Attorney Brendan V. Johnson announced that Jason Riley, age 36, of Rosebud, South Dakota, appeared before U.S. District Judge Roberto A. Lange on November 19, 2013, and pled guilty to Assault Resulting in Serious Bodily Injury.
The maximum penalty upon conviction is 10 years in custody and/or a $250,000 fine, 3 years of supervised release, and $100 to the Federal Crime Victims Fund.
On October 13, 2010, Jason Riley was at the Sicangu Village Housing on the Rosebud Sioux Indian Reservation. The victim approached Riley and asked for a cigarette. A verbal disagreement ensued and Riley struck the victim in the face and kicked the victim with shod feet while the victim was on the ground. The victim suffered multiple abrasions, soft tissue bruising, and a nose bone fracture.
The investigation was conducted by the Rosebud Sioux Tribe Law Enforcement Services. The case is being prosecuted by Assistant U.S. Attorney Tim Maher.
A presentence investigation was ordered and a sentencing date was set for February 10, 2014. Riley was released pending sentencing.
Pine Ridge Woman Pleads Guilty to LarcenyRead the Press Release
United States Attorney Brendan V. Johnson announced that Philana Red Feather, a/k/a Philana Garcia, age 37, of Pine Ridge, South Dakota, appeared before U.S. Magistrate Judge Veronica L. Duffy on November 15, 2013, and pled guilty to misdemeanor Larceny.
The maximum penalty upon conviction is 1 year imprisonment and a $100,000 fine.
The charge relates to Red Feather and others stealing items from a house in Pine Ridge in the early morning hours of December 15, 2012. The stolen items included, but were not limited to, an air compressor, tools, electronic devices, DVDs, games, and jewelry.
The investigation was conducted by the Bureau of Indian Affairs, Office of Justice Services, and the Oglala Sioux Tribe Department of Public Safety.
A presentence investigation was ordered and a sentencing date will be set. The defendant was remanded to the custody of the U.S. Marshals Service pending sentencing.
Pierre Man Charged with Distribution of A Controlled SubstanceRead the Press Release
United States Attorney Brendan V. Johnson announced that a Pierre, South Dakota, man has been indicted by a federal grand jury.
Edwin Clayton Cook, Jr., age 37, was indicted on November 14, 2013, for Distribution of a Controlled Substance. Cook appeared before U.S. Magistrate Judge Mark A. Moreno on November 19, 2013, and pled not guilty to the Indictment.
The maximum penalty upon conviction is 20 years of imprisonment and/or $1,000,000 fine, at least 3 years of supervised release, an additional 2 years of supervised release upon revocation, and a mandatory $100 special assessment to the Federal Crime Victims Fund. Restitution may also be ordered.
The charge is merely an accusation, and Cook is presumed innocent until and unless proven guilty.
The Indictment alleges that on or about June 12, 2013, Cook knowingly and intentionally distributed a mixture and substance containing a detectable amount of methamphetamine.
The investigation is being conducted by the Northern Plains Safe Trails Drug Enforcement Task Force. Assistant U.S. Attorney Jay Miller is prosecuting the case.
Cook was released on bond pending trial which has not been set.
Parmelee Man Sentenced for Assaulting A Federal OfficerRead the Press Release
United States Attorney Brendan V. Johnson announced that a Parmelee, South Dakota, man convicted of Assaulting, Resisting, Opposing, and Impeding a Federal officer was sentenced on November 20, 2013, by U.S. District Judge Roberto A. Lange.
William Rahn, age 27, was sentenced to 5 months in custody, 5 months of home confinement, 1 year of supervised release, and $100 to the Federal Crime Victims Fund.
Rahn was indicted by a federal grand jury on May 16, 2013, and pled guilty to the charge on August 30, 2013.
The charge stems from an incident wherein Rahn was driving erratically, attempting to elude Bureau of Indian Affairs police officers on the Rosebud Sioux Indian Reservation. He drove his vehicle directly at a parked police unit, coming within feet of hitting the vehicle. When Rahn finally stopped his vehicle on a dirt road, he resisted the officers and that resistance involved physical contact with an officer.
The investigation was conducted by the Rosebud Sioux Tribe Law Enforcement Services. The case was prosecuted by Assistant U.S. Attorney Tim Maher.
Rahn was remanded to the custody of the U.S. Marshals Service.
Martin Man Pleads Guilty to Benefits FraudRead the Press Release
United States Attorney Brendan V. Johnson announced that Walter York, age 34, of Martin, South Dakota, appeared before U.S. Magistrate Judge Veronica L. Duffy on November 14, 2013, and pled guilty to Benefits Fraud. The maximum penalty upon conviction is 1 year imprisonment and a $100,000 fine.
York was indicted for fraudulently making a purchase at Sam’s Club in Rapid City on July 10, 2011, when he used another person’s Electronic Benefits Transfer card.
The investigation was conducted by the Federal Bureau of Investigation and the South Dakota Department of Social Services. The case is being prosecuted by Assistant U.S. Attorney Wayne Venhuizen.
A presentence investigation was ordered and a sentencing date was set for February 3, 2014. The defendant was released on bond pending sentencing.
La Plant Couple Charged with Involuntary Manslaughter, Child Abuse and False StatementRead the Press Release
United States Attorney Brendan V. Johnson announced that a couple from La Plant, South Dakota, has been indicted by a federal grand jury.
Rochelle Breckbill, a/k/a Rochelle LeBeau, age 25, and Henry Chase Alone, age 30, were indicted on November 14, 2013, for Involuntary Manslaughter, Child Abuse, and False Statement. They appeared before U.S. Magistrate Judge Mark A. Moreno on November 19, 2013, and pled not guilty to the Indictment.
The maximum penalty upon conviction for each person is 15 years of imprisonment and/or a $250,000 fine, 3 years of supervised release, an additional 2 years of supervised release upon revocation, and a mandatory $100 special assessment to the Federal Crime Victims Fund. Restitution may also be ordered.
The charges are merely accusations, and Breckbill and Chase Alone are presumed innocent until and unless proven guilty.
The three-count Indictment alleges that between September 29, 2013 and October 1, 2013, Breckbill and Chase Alone unlawfully killed a human being, without malice. The Indictment also alleges that they abused, exposed, tortured, tormented, and cruelly punished a child who had not attained the age of 7 years. Following those acts, it is alleged that Breckbill and Chase Alone lied to the Federal Bureau of Investigation.
The investigation is being conducted by the Federal Bureau of Investigation. Assistant U.S. Attorney Jay P. Miller is prosecuting the case.
Breckbill and Chase Alone were released on bond pending trial which has not been set.
Fort Thompson Man Sentenced for Felon in Possession of FirearmRead the Press Release
United States Attorney Brendan V. Johnson announced that a Fort Thompson, South Dakota, man convicted of Felon in Possession of Firearm was sentenced on November 20, 2013, by U.S. District Judge Roberto A. Lange.
Bryant Ross, age 39, was sentenced to 9 months of imprisonment, 18 months of supervised release, and a $100 special assessment to the Federal Crime Victims Fund.
Ross was indicted for the above charge by a federal grand jury on July 16, 2013. He pled guilty on August 29, 2013.
The conviction stems from an incident occurring on February 23, 2013, when a Bureau of Indian Affairs Officer made contact with Ross in the Old Fort campground area off of Highway 47. At this time, it was learned that Ross had an active tribal warrant. During his arrest on the tribal warrant, two firearms were discovered in Ross’ possession.
In 1998, Ross was convicted of Possession of a Controlled Substance-Meth, which makes him a prohibited person.
The investigation was conducted by the Bureau of Indian Affairs. Assistant U.S. Attorney Meghan N. Dilges prosecuted the case.
Ross was immediately turned over to the custody of the U.S. Marshals Service.
First Cousins from La Plant Sentenced for IncestRead the Press Release
United States Attorney Brendan V. Johnson announced that a La Plant, South Dakota, man and woman convicted of Incest were sentenced on November 18, 2013, by U.S. District Judge Roberto A. Lange.
The investigation was conducted by the Cheyenne River Sioux Tribe Law Enforcement Division. The case was prosecuted by Assistant U.S. Attorney Mikal Hanson.
Nicholas Ray White Eagle, age 26, and Fawn Lynn Scott, age 21, were each sentenced to 3 years of probation and a $100 special assessment to the Federal Crime Victims Fund.
White Eagle and Scott were indicted by a federal grand jury on June 12, 2013, and pled guilty to Incest on August 14, 2013.
In April 2011, White Eagle and Scott, first cousins, had consensual sexual intercourse that produced a child with a genetic disability. At the time of the sexual intercourse, White Eagle and Scott were not legally married and were within the degrees of consanguinity with each other within which marriages are void.
Eagle Butte Woman Sentenced for Possession of A Controlled SubstanceRead the Press Release
United States Attorney Brendan V. Johnson announced that Nicole Condon, a/k/a Nicole Garreau, age 35, of Eagle Butte, South Dakota, has pled guilty to Possession of a Controlled Substance and was sentenced on November 19, 2013, by U.S. Magistrate Judge Mark A. Moreno.
Condon was sentenced to 2 years of probation, a $1,000 fine, and a $25 special assessment to the Federal Crime Victims Fund. Condon was indicted on August 21, 2013.
The conviction stems from an incident occurring on October 23, 2012, when Condon was in a vehicle that was stopped for a traffic violation. Condon was transported to the Cheyenne River Sioux Tribe Adult Detention Center and searched. Officers found 0.68 grams of a mixture or substance containing a detectable amount of methamphetamine on her person in addition to several syringes, a straw, and empty plastic bags. Condon admitted to consuming methamphetamine.
The investigation was conducted by the Northern Safe Trails Drug Enforcement Task Force. Assistant U.S. Attorney Kathryn N. Rich prosecuted the case.
Texas Man Sentenced for Distribution of A Controlled SubstanceRead the Press Release
United States Attorney Brendan V. Johnson announced that a Pearsall, Texas, man convicted of Distribution of a Controlled Substance was sentenced on November 18, 2013, by U.S. District Judge Roberto A. Lange.
Ricardo Avila, age 53, was sentenced to 33 months of imprisonment, a $1,000 fine, 3 years of supervised release, and a $100 special assessment to the Federal Crime Victims Fund.
Avila was indicted for the above charge by a federal grand jury on November 19, 2012. He pled guilty on August 19, 2013.
The conviction stems from an incident occurring on or about April 12, 2012, when an undercover officer was introduced to Avila, and a purchase of cocaine was arranged. Avila delivered to the undercover officer a substance that was confirmed to be 28.3 grams of powder cocaine, a Schedule II controlled substance.
The investigation was conducted by the Northern Plains Safe Trails Drug Enforcement Task Force. Assistant U.S. Attorney Kathryn N. Rich prosecuted the case.
Avila was immediately turned over to the custody of the U.S. Marshals Service.
Pine Ridge Man Guilty of Two AssaultsRead the Press Release
United States Attorney Brendan V. Johnson announced that Lee Larney, a/k/a “Southern Wind,” 32, of Pine Ridge, South Dakota, appeared before U.S. Magistrate Judge Veronica L. Duffy on November 14, 2013, and pled guilty to a charge of Assault Resulting in Serious Bodily Injury and a charge of Assault on a Federal Officer.
The maximum penalty for Assault Resulting in Serious Bodily Injury is 10 years of imprisonment and/or a $250,000 fine, and the maximum penalty for Assault on a Federal Officer is 8 years of imprisonment and/or a $250,000 fine.
In April 2012, at Porcupine, Larney struck a man several times in the face, causing injuries to the man’s jaw, teeth, and gums which required surgery. He also experienced ear pain and a temporary loss of hearing.
In August 2012, near Oglala, Larney punched an Oglala Sioux Tribe police officer in the face while the officer was attempting to arrest him for intoxication.
The investigations were conducted by the Federal Bureau of Investigation, the Bureau of Indian Affairs Office of Justice Services, and the Oglala Sioux Tribe Department of Public Safety. The cases are being prosecuted by Assistant U.S. Attorney Sarah Collins.
Presentence investigations were ordered and sentencing dates will be set. Larney was remanded to the custody of the U.S. Marshals Service pending sentencing.
Murdo Man Sentenced for Possession of A Firearm by A Prohibited PersonRead the Press Release
United States Attorney Brendan V. Johnson announced that a Murdo, South Dakota, man convicted of Possession of a Firearm by a Prohibited Person was sentenced on November 7, 2013, by U.S. District Judge Roberto A. Lange.
Shaun Sporrer, age 42, was sentenced to 30 months of imprisonment, 18 months of supervised release, and a $100 special assessment to the Federal Crime Victims Fund.
Sporrer was indicted for the above charge by a federal grand jury on April 2, 2013. He pled guilty on August 13, 2013.
The conviction stems from an incident occurring on March 1, 2013, in which Sporrer pulled a revolver on a neighbor. Sporrer has previous domestic violence convictions, and as a result is prohibited from owning firearms.
The investigation was conducted by the Jones County Sheriff’s Office, the Bureau of Alcohol, Tobacco, Firearms and Explosives, and the Northern Plains Safe Trails Drug Enforcement Task Force. Assistant U.S. Attorney Jay P. Miller prosecuted the case.
Sporrer was immediately turned over to the custody of the U.S. Marshals Service.
Man from Mexico Sentenced for Conspiracy to Distribute MethamphetamineRead the Press Release
United States Attorney Brendan V. Johnson announced that a man from Mexico convicted of Conspiracy to Distribute of a Controlled Substance was sentenced on November 15, 2013, by Chief Judge Jeffrey L. Viken, U.S. District Court.
Lorenzo Camacho Tarango a/k/a "Lencho", a/k/a "Lecho", age 43, was sentenced to 120 months of imprisonment, 5 years of supervised release, and a $100 special assessment to the Federal Crime Victims Fund.
The charge relates to Tarango conspiring with Abraham Romero and others to distribute at least 500 grams or more of methamphetamine in the District of South Dakota between 2010 and 2012. Tarango would deliver methamphetamine to Romero, and Romero would then engage in further distribution within the state. Tarango pled guilty to the charge on July 23, 2013.
This case was investigated by the Federal Bureau of Investigation, Northern Plains Safe Trails Drug Enforcement Task Force, South Dakota Division of Criminal Investigation, and the Bureau of Indian Affairs Office of Justice Services. Assistant U.S. Attorney Ted L. McBride prosecuted the case.
Tarango remains in the custody of the U.S. Marshals Service.
Chamberlain Man Charged with Access Device Fraud and LarcenyRead the Press Release
United States Attorney Brendan V. Johnson announced that a Chamberlain, South Dakota, man has been indicted by a federal grand jury.
Warren LaRoche, age 23, was indicted on November 14, 2013, for Access Device Fraud and Larceny. LaRoche appeared before U.S. Magistrate Judge Mark A. Moreno on November 18, 2013, and pled not guilty to the Indictment.
The maximum penalty upon conviction is 15 years of imprisonment and/or a $250,000 fine, 3 years of supervised release, an additional 2 years of supervised release upon revocation, and a mandatory $100 special assessment to the Federal Crime Victims Fund. Restitution may also be ordered.
The charges are merely accusations, and LaRoche is presumed innocent until and unless proven guilty.
The Indictment alleges that between December 3, 2012, and April 16, 2013, LaRoche stole a credit card number and made unauthorized purchases in excess of $1,000.
The investigation is being conducted by the Bureau of Indian Affairs. Assistant U.S. Attorney Meghan N. Dilges is prosecuting the case.
LaRoche was remanded to the custody of the U.S. Marshals Service. A trial date has not been set.
Watertown Man Charged with Unlawful Taking of Migratory Birds and Lacey Act ViolationsRead the Press Release
United States Attorney Brendan V. Johnson announced that a Watertown, South Dakota, man has been charged with Unlawful Taking of Migratory Birds and Lacey Act Violations by an Information filed October 30, 2013.
Roger Meyer, age 52, appeared before U.S. Magistrate Judge William D. Gerdes on November 8, 2013, and pled not guilty to the charge.
The maximum penalty upon conviction is 1 year of imprisonment and/or a $100,000 fine, 1 year of supervised release and an additional year of supervised release upon revocation, and a $25 special assessment to the Federal Crime Victims Fund. Restitution may also be ordered.
The charges are merely accusations, and Meyer is presumed innocent until and unless proven guilty.
The investigation is being conducted by the U.S. Fish and Wildlife Service. Assistant U.S. Attorney Meghan N. Dilges is prosecuting the case.
Meyer was released on bond pending trial which has not been set.
Wanblee Woman Pleads Guilty to Conspiracy to Distribute MethamphetamineRead the Press Release
United States Attorney Brendan V. Johnson announced that Shy Bettelyoun, age 30, of Wanblee, South Dakota, appeared before U.S. Magistrate Judge Veronica L. Duffy, on November 8, 2013, and pled guilty to Conspiracy to Distribute a Controlled Substance and Distribution of a Controlled Substance.
The maximum penalty upon conviction is up to 20 years of imprisonment and/or a $1,000,000 fine.
On or about August 2009 through February 20, 2013, Bettelyoun conspired with other persons to distribute 50 grams or more of methamphetamine in and around the Pine Ridge Indian reservation.
The investigation was conducted by the Northern Plains Safe Trails Drug Enforcement Task Force, the Bureau of Indian Affairs Office of Justice Services, the Federal Bureau of Investigation, and Rapid City Police Department. The case is being prosecuted by Assistant U.S. Attorney Ted L. McBride.
A presentence investigation was ordered and a sentencing date has not been set. The defendant was remanded to the custody of the U.S. Marshals Service pending sentencing.
St. Francis Man Charged with Abusive Sexual ContactRead the Press Release
United States Attorney Brendan V. Johnson announced that Vernon Verdell Blackhorse, age 63, of St. Francis, South Dakota, appeared before U.S. District Judge Roberto A. Lange on November 6, 2013, and pled guilty to Abusive Sexual Contact.
The maximum penalty upon conviction is 6 years in custody and/or a $250,000 fine, 3 years of supervised release, and $100 to the Federal Crime Victims Fund.
The conviction stems from an incident that took place in Eagle Butte between May 1, 2002, and August 30, 2002, when Blackhorse was laying on a couch behind the victim, who was age 11 or 12 at the time. The victim woke up when she felt Blackhorse touching her over the clothing in a sexual manner. The victim jumped off the couch and was able to end the sexual contact.
The investigation was conducted by the Federal Bureau of Investigation and the Rosebud Sioux Tribe Law Enforcement Services. The case is being prosecuted by Assistant U.S. Attorney Marie H. Ruettgers.A presentence investigation was ordered and a sentencing date was set for January 27, 2014. Blackhorse was remanded to the custody of the U.S. Marshals Service pending sentencing.
Rapid City Woman Pleads Guilty to Concealing A FugitiveRead the Press Release
United States Attorney Brendan V. Johnson announced that Tina Marie Ladeaux, a/k/a Tina M. Cooper, a/k/a Tina Cooperboyd, age 41, of Rapid City, South Dakota, appeared before U.S. Magistrate Judge Veronica L. Duffy on October 31, 2013, and pled guilty to Concealing Person from Arrest.
The maximum penalty upon conviction is 5 years of imprisonment and a $250,000 fine.
The charge stems from Ladeaux concealing her husband, Eric Ladeaux, from law enforcement after being informed there was a warrant for his arrest for Escape on federal charges in September 2012.
The investigation was conducted by the U.S. Marshals Service. The case is being prosecuted by Assistant U.S. Attorney Sarah B. Collins.
A presentence investigation was ordered and a sentencing date was set for February 3, 2014. The defendant was released on bond pending sentencing.
Pine Ridge Man Guilty of AssaultRead the Press Release
United States Attorney Brendan V. Johnson announced that Alexander Winter, 27, of Pine Ridge, South Dakota, appeared before U.S. Magistrate Judge Veronica L. Duffy on November 14, 2013, and pled guilty to a charge of Assault by Striking, Beating, and Wounding.
The charge carries a maximum penalty upon conviction of 1 year of imprisonment and/or a $100,000 fine.
On March 18, 2013, Winter repeatedly punched a woman in the chest and face during an argument, causing contusions, bruises, a bloody nose, a black eye and a nasal fracture.
The investigation was conducted by the Bureau of Indian Affairs Office of Justice Services and the Oglala Sioux Tribe Department of Public Safety. The case is being prosecuted by Assistant U.S. Attorney Eric Kelderman.
A presentence investigation was ordered and a sentencing date was set for February 3, 2014. The defendant remained on bond pending sentencing.
Lower Brule Woman Sentenced for AssaultRead the Press Release
United States Attorney Brendan V. Johnson announced that a Lower Brule, South Dakota, woman convicted of Assault by Striking, Beating and Wounding was sentenced on November 14, 2013, by U.S. Magistrate Judge Mark A. Moreno.
Monica Quilt, age 42, was sentenced to 6 months of imprisonment, 1 year of supervised release, and a $25 special assessment to the Federal Crime Victims Fund.
Quilt was indicted by a federal grand jury on May 15, 2013. She pled guilty to an Information on September 4, 2013.
The conviction stems from an incident between May 8, 2013, and May 9, 2013, wherein Quilt and the victim, who were involved in an intimate, dating relationship, had both been out drinking, but separately. During the morning hours of May 9th, Quilt went to her home and the victim arrived later. A physical assault occurred between Quilt and the victim, which resulted in the victim suffering injuries to his neck and face that required medical treatment.
The investigation was conducted by the Bureau of Indian Affairs, Lower Brule Agency. Assistant U.S. Attorney Meghan N. Dilges prosecuted the case.
Quilt is to self-report to the U.S. Marshals Service on December 12, 2013.
Lower Brule Man Sentenced for Assaulting A Federal OfficerRead the Press Release
United States Attorney Brendan V. Johnson announced that Cole Brouse, age 20, of Lower Brule, South Dakota, pled guilty to an Information that charged him with Assaulting, Resisting and Impeding a Federal Officer.
Brouse was sentenced on November 1, 2013, by U.S. Magistrate Judge Mark A. Moreno to 18 months of probation, a $1,500 fine, and a $25 special assessment to the Federal Crime Victims Fund.
The charge stems from an incident occurring on March 26, 2013, when U. S. Marshals and a Bureau of Indian Affairs officer went to Brouse’s home to look for another individual who had a federal warrant. Brouse was not home but arrived a short time later. When he arrived, he got upset at the officers, yelled at them and retrieved his pit-bull. The dog barked loudly, snarling and pulling on her leash in an attempt to get at the officers. The U.S. Marshals were able to talk to Brouse, who then put his dog away.
The investigation was conducted by the U.S. Marshals Service and the Bureau of Indian Affairs. Assistant U.S. Attorney Meghan N. Dilges prosecuted the case.
Kyle Woman Sentenced for Conspiracy to Distribute MarijuanaRead the Press Release
United States Attorney Brendan V. Johnson announced that a Kyle, South Dakota, woman convicted of Conspiracy to Distribute a Controlled Substance was sentenced on November 13, 2013, by Chief Judge Jeffrey L. Viken, U.S. District Court.
Stephanie Standing Soldier, age 38, was sentenced to 16 months of imprisonment, 3 years' supervised release, and a $100 special assessment to the Federal Crime Victims Fund.
The conviction stems from Standing Soldier conspiring with others to distribute at least 100 kilograms or more of marijuana on the Pine Ridge Indian Reservation between 2008 and 2012. Standing Soldier pled guilty to the charge on April 30, 2013.

Gregory Man Charged with Second Degree Burglary and ForgeryRead the Press Release
United States Attorney Brendan V. Johnson announced that a Gregory, South Dakota, man has been indicted by a federal grand jury.
Roger B. King, age 45, was indicted on April 12, 2013, for Second Degree Burglary and Forgery. King appeared before U.S. Magistrate Judge Mark A. Moreno on November 13, 2013, and pled not guilty to the Indictment.
The maximum penalty upon conviction is 15 years of imprisonment and/or a $250,000 fine, 3 years of supervised release, an additional 2 years of supervised release upon revocation, and a mandatory $100 special assessment on each count to the Federal Crime Victims Fund. Restitution may also be ordered.
The charges are merely accusations, and King is presumed innocent until and unless proven guilty.
The Indictment alleges that on June 9, 2012, King unlawfully entered a residence and wrote stolen checks to different entities.
The investigation is being conducted by the Federal Bureau of Investigation. Assistant U.S. Attorney Troy R. Morley is prosecuting the case.
King was remanded to the custody of the U.S. Marshals Service. A trial date has not been set.
Eagle Butte Woman Sentenced for Accessory After the FactRead the Press Release
United States Attorney Brendan V. Johnson announced that Alex White Eyes, a 24-year-old woman from Eagle Butte, South Dakota, pled guilty to Accessory After The Fact and was sentenced on November 14, 2013, by U.S. Magistrate Judge Mark A. Moreno.
White Eyes was sentenced to 3 years of probation and a $10 assessment to the Federal Crime Victims Fund
In September 2012, White Eyes, knowing that an offender had committed the crime of Assault of a Minor in Indian country, hindered and prevented the offender’s apprehension for trial and punishment by failing to provide this information to the Cheyenne River Sioux Tribal Law Enforcement Department and the South Dakota Department of Social Services.
The investigation was conducted by the Federal Bureau of Investigation and the Cheyenne River Sioux Tribal Law Enforcement Department. Assistant U.S. Attorney Mikal Hanson prosecuted the case.
Eagle Butte Man Charged with Assaulting Federal Officers and Firearm Possession ViolationsRead the Press Release
United States Attorney Brendan V. Johnson announced that an Eagle Butte, South Dakota, man has been indicted by a federal grand jury.
Jason Todd Garreau, age 27, was indicted by a federal grand jury on November 5, 2013, for Assaulting, Resisting, and Impeding Federal Officers; Possession of a Firearm During a Crime of Violence; and Felon in Possession of a Firearm.
Garreau appeared before U.S. Magistrate Judge Mark A. Moreno on November 8, 2013, and pled not guilty to the Indictment.
The maximum penalty upon conviction is up to life of imprisonment and/or a $250,000 fine, 5 years of supervised release, an additional 3 years of supervised release upon revocation, and a mandatory $100 special assessment to the Federal Crime Victims Fund. Restitution may also be ordered.
The charges are merely accusations, and Garreau is presumed innocent until and unless proven guilty.
The investigation is being conducted by the Federal Bureau of Investigation and several other law enforcement agencies. Assistant U.S. Attorney Meghan N. Dilges is prosecuting the case.

Rosebud Man Sentenced for Sexual AbuseRead the Press Release
United States Attorney Brendan V. Johnson announced that a Rosebud, South Dakota, man convicted of Sexual Abuse was sentenced on November 6, 2013, by U.S. District Judge Roberto A. Lange.
Eagle Elk was remanded to the custody of the U.S. Marshals Service.
Ricky Eagle Elk, age 45, was sentenced to 121 months in custody, 5 years of supervised release, $100 to the Federal Crime Victims Fund, and is required to register as a sex offender.
Eagle Elk was indicted by a federal grand jury on April 12, 2013, and pled guilty to the charge on August 14, 2013.
The conviction stems from an incident that took place on August 27, 2012, at a local fair after the victim fell asleep in a tent. Eagle Elk entered the tent and sexually assaulted the victim while she was unconscious and not capable of consenting to the act.
The investigation was conducted by the Federal Bureau of Investigation and the Rosebud Sioux Tribe Law Enforcement Services. The case was prosecuted by Assistant U.S. Attorney Marie H. Ruettgers.
Rapid City Man Pleads Guilty to Conspiracy to Distribute MethamphetamineRead the Press Release
United States Attorney Brendan V. Johnson announced that Damian Antonia Quintana, age 30, of Rapid City, South Dakota, appeared before U.S. Magistrate Judge Veronica L. Duffy on November 6, 2013, and pled guilty to Conspiracy to Distribute a Controlled Substance.
The maximum penalty upon conviction is at least 10 years up to life imprisonment and/or a $10,000,000 fine.
During a timeframe of no later than 2008 and up to May 2013, Quintana received ounce quantities of methamphetamine in Rapid City from individuals who knew that it would be subject to further distribution in South Dakota. During the course of this conspiracy, more than 1.5 kilograms of methamphetamine had been distributed.
The investigation was conducted by the Drug Enforcement Administration and the Unified Narcotic Enforcement Team. The case is being prosecuted by Assistant U.S. Attorney Ted L. McBride.
A presentence investigation was ordered and a sentencing date has not been set. The defendant was remanded to the custody of the U.S. Marshals Service pending sentencing.
Pennsylvania Man Sentenced for Conspiracy to Distribute and Possess with Intent to Distribute A Controlled SubstanceRead the Press Release
United States Attorney Brendan V. Johnson announced that a Blossburg, Pennsylvania, man convicted of Conspiracy to Distribute and Possess with Intent to Distribute a Controlled Substance was sentenced on November 6, 2013, by U.S. District Judge Roberto A. Lange.
Michael Pearlingi, age 44, was sentenced to 13 months of imprisonment, a $1,000 fine, 3 years of supervised release, and a $100 special assessment to the Federal Crime Victims Fund.
Pearlingi was indicted for the above charge by a federal grand jury on April 2, 2013. He pled guilty on August 27, 2013.
The conviction stems from an incident on March 14, 2013, when a South Dakota Highway Patrol Trooper spoke with occupants of a motor home, including Pearlingi, when they stopped for fuel. The trooper’s suspicions were heightened during the conversations, and he deployed his narcotics detection dog. The dog indicated to the odor of illegal drugs in the motor home.
The trooper searched the motor home and found large garbage bags containing marijuana, packaged in approximately one-pound bundles. There was also 673 grams of hashish oil and a smaller amount of personal use marijuana in the motor home. The total amount of marijuana found was approximately 113 pounds.
The investigation was conducted by the Northern Plains Safe Trails Drug Enforcement Task Force and South Dakota Highway Patrol. Assistant U.S. Attorney Kathryn N. Rich prosecuted the case.
Pearlingi was immediately turned over to the custody of the U.S. Marshals Service.
California Woman Indicted for Failure to Pay Child SupportRead the Press Release
United States Attorney Brendan V. Johnson announced that an Anaheim, California, woman has been indicted by a federal grand jury for Failure to Pay Child Support.
Cheryl K. Ernesti, a/k/a Cheryl K. Houska and Cheryl K. Pangan, age 42, was indicted by a federal grand jury on April 2, 2013, for failing to pay over $19,853 in past due child support. She appeared before U.S. Magistrate Judge John E. Simko on November 6, 2013, and pled not guilty to the Indictment.
The maximum penalty upon conviction is two years' imprisonment and/or a $250,000 fine, one year supervised release, one additional year upon revocation, a $100.00 assessment fee to the Federal Crime Victims Fund, and child support restitution amount owing at the time of sentencing.
The charge is merely an accusation and Ernesti is presumed innocent until and unless proven guilty.
The investigation is being conducted by the Department of Health and Human Services, Office of Inspector General. Assistant U.S. Attorney Thomas J. Wright is prosecuting the case.

United States Attorney Brendan V. Johnson announced that a Box Elder, South Dakota, man convicted of Possession with Intent to Distribute a Controlled Substance was sentenced on November 6, 2013, by U.S. District Judge Roberto A. Lange.
Joseph McGregor, age 32, was sentenced to 1 month of imprisonment followed by 5 months of home confinement, a $1,000 fine, 2 years of supervised release, and a $100 special assessment to the Federal Crime Victims Fund. The Court also ordered a preliminary forfeiture of McGregor’s vehicle and a firearm found in the trunk of the vehicle.
McGregor was indicted for the above charge by a federal grand jury on April 2, 2013. He pled guilty on August 20, 2013.
The conviction stems from an incident occurring on March 24, 2013, when Rosebud Sioux Tribe Law Enforcement (RSTLE) initiated a traffic stop on McGregor’s vehicle because a headlight was out. While the officer ran a license status on McGregor, another RSTLE officer arrived on scene and eventually deployed his narcotics detection dog, who indicated on McGregor’s vehicle. Law enforcement searched McGregor’s vehicle and found 3 bags of marijuana with a total weight of 2.9974 pounds, several scales, two smaller bags of marijuana and methamphetamine, a grinder, 2 hand-rolled cigarettes with an odor of marijuana, a roach clip, and 2 packs of rolling papers.
The investigation was conducted by RSTLE, the Mission City Police Department, Northern Plains Safe Trails Drug Enforcement Task Force, and the Federal Bureau of Investigation. Assistant U.S. Attorney Kathryn N. Rich prosecuted the case.
McGregor is to self-report to serve his custody sentence on November 13, 2013.
Timber Lake Woman Sentenced for Misprision of A FelonyRead the Press Release
United States Attorney Brendan V. Johnson announced that a Timber Lake, South Dakota, woman convicted of Misprision of a Felony was sentenced on November 4, 2013, by U.S. District Judge Roberto A. Lange.
The investigation was conducted by the Cheyenne River Sioux Tribe Law Enforcement Division. The case was prosecuted by Assistant U.S. Attorney Mikal Hanson.
Stephanie Vandervier, age 28, was sentenced to 18 months of probation, $972.61 in restitution, and a $100 special assessment to the Federal Crime Victims Fund.
Vandervier was indicted by a federal grand jury on February 13, 2013, and pled guilty to a Superseding Information that charged her with Misprision of a Felony on August 19, 2013.
The conviction is the result of a January 6, 2013, late night break-in at the Chatter Box Corner Café and Bar, a downtown business in Timber Lake. Vandervier had knowledge that the burglary was committed and concealed the same from tribal and federal authorities.
Timber Lake Man Sentenced for Assault by Striking, Beating and Wounding and Simple AssaultRead the Press Release
United States Attorney Brendan V. Johnson announced that a Timber Lake, South Dakota, man convicted of Assault by Striking, Beating and Wounding, and Simple Assault was sentenced on October 29, 2013, by U.S. District Judge Roberto A. Lange.
Vincent Archambeault, age 25, was sentenced to18 months in custody, 1 year of supervised release, and a $35 special assessment to the Federal Crime Victims Fund.
Archambeault’s conviction was the result of a June 2013 incident in Timber Lake, when Archambeault had a verbal argument with the two victims that escalated into a physical fight. During the fight, Archambeault bit the two victims. One victim had the end of his finger bitten off and the second victim sustained a bite wound on her arm.
The Cheyenne River Sioux Tribe Law Enforcement Division conducted the investigation. The case was prosecuted by Assistant U.S. Attorney Mikal Hanson.
Archambeault was remanded to the custody of the U.S. Marshals Service to begin serving his sentence.
Sioux Falls Woman Sentenced for Bank EmbezzlementRead the Press Release
United States Attorney Brendan V. Johnson announced that a Sioux Falls, South Dakota, woman convicted of Embezzlement of Bank Funds was sentenced on November 4, 2013, by U.S. District Judge Lawrence L. Piersol.
This case was investigated by the Federal Bureau of Investigation. Assistant U.S. Attorney Ann M. Hendrickson prosecuted the case.
Andrea Schwartz, age 23, was sentenced to time served and 2 years of supervised release, to include 50 hours of community service. She was also fined $500 and ordered to make restitution of $7,720.
Schwartz was indicted for the above charge by a federal grand jury on May 8, 2013. She pled guilty to the offense on August 12, 2013.
The conviction stems from incidents that took place when Schwartz was employed as a teller at Home Federal Bank in Sioux Falls. Schwartz made several withdrawals from customers’ accounts under the pretense that the customers called her on the telephone, authorized withdrawals from their accounts, and told her another person would come to the bank to pick up the cash.Rosebud Man Charged and Sentenced for Theft of Governement PropertyRead the Press Release
United States Attorney Brendan V. Johnson announced that a Rosebud, South Dakota, man convicted of Theft of Government Property has pled guilty to the charge and was sentenced on November 4, 2013, by U.S. Magistrate Judge Mark A. Moreno.
Christopher Menard, age 39, was ordered to pay a $350 fine, $150.08 in restitution, and $25 to the Federal Crime Victims Fund.
The conviction stems from incidents that occurred on three separate occasions between December 3, 2012, and January 19, 2013, when Menard used gas cards that belonged to the Bureau of Indian Affairs Fire Management Office to steal gas money, which he put into his own personal vehicle.
The investigation was conducted by the U.S. Department of Interior – Office of Inspector General. The case was prosecuted by Assistant U.S. Attorney Tim Maher.
Rapid City Man Pleads Not Guilty to Child Pornography ChargesRead the Press Release
United States Attorney Brendan V. Johnson announced that a Rapid City, South Dakota, man has been indicted by a federal grand jury for allegedly downloading images of child pornography onto a computer in September 2013.
Rodney Volker, age 67, was indicted by a federal grand jury on October 22, 2013, for Possession of Child Pornography and Receipt of Child Pornography. Volker appeared before U.S. Magistrate Judge Veronica L. Duffy on November 4, 2013, and pled not guilty to the Indictment.
The penalty upon conviction for the Possession charge is a mandatory minimum of 10 years and up to 20 years of imprisonment and a $250,000 fine, and for Receipt of Child Pornography the penalty is a mandatory minimum of 5 years and up to 20 years of imprisonment and a $250,000 fine. The charges are merely accusations and Volker is presumed innocent until and unless proven guilty.
The investigation is being conducted by the Rapid City Police Department and the South Dakota Internet Crimes Against Children Taskforce. Assistant U.S. Attorney Sarah Collins is prosecuting the case.
Volker was remanded to the custody of the U.S. Marshals Service. A trial date has not been set.
Porcupine Man Pleads Guilty to Child AbuseRead the Press Release
United States Attorney Brendan V. Johnson announced that Corey Good Crow, age 37, of Porcupine, South Dakota, appeared before U.S. Magistrate Judge Veronica L. Duffy on November 1, 2013, and pled guilty to Felony Child Abuse and Neglect.
The maximum penalty upon conviction is 10 years of imprisonment and a $250,000 fine.
The charge relates to Good Crow engaging in a pattern of conduct between 2008 and 2010 that subjected a child to abuse and neglect which caused the child severe and permanent psychological injury.
The investigation was conducted by the Bureau of Indian Affairs, Office of Justice Services, and the Oglala Sioux Tribe Department of Public Safety. The case is being prosecuted by Assistant U.S. Attorney Wayne Venhuizen.
A presentence investigation was ordered and a sentencing date will be set. The defendant was remanded to the custody of the U.S. Marshals Service pending sentencing.
Pine Ridge Man Pleads Guilty to LarcenyRead the Press Release
United States Attorney Brendan V. Johnson announced that Michael Alford, age 31, of Pine Ridge, South Dakota, appeared before U.S. Magistrate Judge Veronica L. Duffy on October 31, 2013, and pled guilty to Larceny.
The maximum penalty upon conviction is 5 years of imprisonment and a $250,000 fine.
The charge relates to Alford and others stealing items from a house in Pine Ridge in the early morning hours of December 15, 2012. The items, valued at more than $1,000, included but were not limited to, an air compressor, tools, electronic devices, DVDs, games and jewelry.
The investigation was conducted by the Bureau of Indian Affairs, Office of Justice Services, and the Oglala Sioux Tribe Department of Public Safety.
A presentence investigation was ordered and a sentencing date will be set. The defendant was remanded to the custody of the U.S. Marshals Service pending sentencing.
Pine Ridge Man Pleads Guilty to Assault with A Dangerous WeaponRead the Press Release
United States Attorney Brendan V. Johnson announced that Michael Tobacco, age 21, of Pine Ridge, South Dakota, appeared before U.S. Magistrate Judge Veronica L. Duffy on October 31, 2013, and pled guilty to Assault with a Dangerous Weapon.
The maximum penalty upon conviction is 10 years of imprisonment and a $250,000 fine.
The charge relates to Tobacco assaulting a juvenile female at Pine Ridge on June 15, 2013. This assault resulted in the female receiving a severely bruised eye that was swollen shut and numerous bruises all over her upper body.
The investigation was conducted by the Bureau of Indian Affairs, Office of Justice Services, and the Oglala Sioux Tribe Department of Public Safety. The case is being prosecuted by Assistant U.S. Attorney Eric Kelderman.
A presentence investigation was ordered. The defendant was remanded to the custody of the U.S. Marshals Service pending sentencing.
Pierre Woman Sentenced for Theft from an Indian Tribal OrganizationRead the Press Release
United States Attorney Brendan V. Johnson announced that a Pierre, South Dakota, woman convicted of Theft From an Indian Tribal Organization was sentenced on October 29, 2013, by U.S. District Judge Roberto A. Lange.
Ravae Bowman, age 40, was sentenced to 3 years of probation with 6 months of home confinement, $5,183.07 in restitution, and a $100 special assessment to the Federal Crime Victims Fund.
In October 2012, Bowman embezzled money from a Subway store in Eagle Butte where she was the manager. At the time, the Subway store was an entity of the Cheyenne River Sioux Tribe Telephone Authority and the Cheyenne River Sioux Tribe.
The Federal Bureau of Investigation conducted the investigation. The case was prosecuted by Assistant U.S. Attorney Mikal Hanson.
Minnesota Woman Sentenced for Failure to Pay Child Support and Failure to AppearRead the Press Release
United States Attorney Brendan V. Johnson announced that a Garden City, Minnesota, woman convicted of Failure to Pay Child Support and Failure to Appear was sentenced on November 4, 2013, by U.S. District Court Judge Charles B. Kornmann.
Jessica Lynn Voss, age 29, was sentenced to 5 years of unsupervised probation, a $100.00 special assessment to the Federal Crime Victims Fund, and child support restitution in the amount of $23,812.78 for failure to pay child support. In addition, she was sentenced to imprisonment of time served, 1 year of unsupervised probation, and a $100.00 special assessment to the Federal Crime Victims Fund for failure to appear.
Voss was indicted by a federal grand jury on October 10, 2012, for failing to pay over $19,000 in past due child support. She had been ordered by the Fifth Judicial Circuit Court, Roberts County, South Dakota, to pay $350.00 per month for her minor children, commencing December 1, 2007. At the time of indictment, she had not made a child support payment since August of 2009. After her initial appearance in federal court in South Dakota, she was released on bond.
Voss had a change of plea hearing scheduled for May 28, 2013. Through her attorney, the defendant conveyed that she was going to plead guilty. The defendant did not appear at her plea hearing and a warrant was issued for failure to appear. Voss pled guilty to the child support charge on August 5, 2013, and to the failure to appear charge on November 4, 2013.

United States Attorney Brendan V. Johnson announced that four individuals were indicted by a federal grand jury on October 11, 2013, for stealing funds from the Oglala Sioux Tribe.
Samone Darla Milk, a/k/a Samone Darla Long Pumpkin, age 32, of Martin, South Dakota, was indicted for Conspiracy to Commit Theft Concerning Programs Receiving Federal Funds and two counts of Theft Concerning Programs Receiving Federal Funds.
Heather Marie Garcia, a/k/a Heather Marie Brings Plenty, age 30, Joe Marquios Garcia, age 34, and Wayne Wilson Cortier, age 45, all of Pine Ridge, South Dakota, were indicted for Conspiracy to Commit Theft Concerning Programs Receiving Federal Funds and one count of Theft Concerning Programs Receiving Federal Funds.
All four defendants appeared before U.S. Magistrate Veronica L. Duffy on October 16, 2013, and pled not guilty to the Indictments.The conspiracy count carries a maximum penalty upon conviction of up to 5 years in custody and/or a $250,000 fine, 3 years of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered. The theft counts carry a maximum penalty upon conviction of up to 10 years in custody and/or a $250,000 fine, 3 years of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
The Indictment alleges that the defendants made fraudulent claims on the Oglala Sioux Tribe’s Low Income Home Energy Assistance Program. Milk and Heather Garcia were employed by the Tribe at the time of the offenses, and Joe Garcia and Cortier were contractors for the Tribe.
The charges are merely accusations and the defendants are presumed innocent until and unless proven guilty.

United States Attorney Brendan V. Johnson announced that a Blackfoot, South Dakota, man convicted of Assault Resulting in Serious Bodily Injury was sentenced on November 4, 2013, by U.S. District Judge Charles B. Kornmann.
Stewart Bobtail Bear, Sr., age 42, was sentenced to 51 months of imprisonment, 3 years of supervised release, and a $100 special assessment to the Federal Crime Victims Fund.
Bobtail Bear was indicted for the above charge by a federal grand jury on March 13, 2013. He pled guilty on August 2, 2013.
The conviction stems from an incident occurring on March 24, 2011, when Bobtail Bear was present at a family gathering in Little Eagle. As the evening progressed, various arguments started between different people at the gathering. Due to all these arguments, the victim decided to leave. As the victim was about to enter his car, Bobtail Bear attacked him from behind and struck him in the facial area. The victim received a broken nose as a result of the attack and was required to have surgery. The victim also now has a permanent blind spot in his left eye.
The investigation was conducted by the Federal Bureau of Investigation. Assistant U.S. Attorney Troy R. Morley prosecuted the case.
Bobtail Bear was immediately turned over to the custody of the U.S. Marshals Service.
Aberdeen Man Sentenced for Assault with A Dangerous WeaponRead the Press Release
United States Attorney Brendan V. Johnson announced that an Aberdeen, South Dakota, man convicted of Assault with a Dangerous Weapon was sentenced on November 4, 2013, by U.S. District Judge Charles B. Kornmann.
Katlin Vine Tiger, age 22, was sentenced to 21 months of imprisonment, 3 years of supervised release, and a $100 special assessment to the Federal Crime Victims Fund.
Tiger was indicted for the above charge by a federal grand jury on December 11, 2012. He pled guilty on July 29, 2013.
The conviction stems from an incident occurring on August 25, 2012, when Tiger and another person accompanied the victim to a private residence. While they were walking, Tiger and the other male assaulted the victim with their fists until he fell to the ground. Once the victim fell to the ground, they began kicking him about the head and body. As a result of the attack, the victim suffered a severe concussion, loss of consciousness, and facial bruising. At the time of the attack, Tiger was wearing steel-toed boots.
The investigation was conducted by the Bureau of Indian Affairs, Standing Rock Agency. Assistant U.S. Attorney Troy R. Morley prosecuted the case.
Tiger was immediately turned over to the custody of the U.S. Marshals Service.
Sioux Falls Man Sentenced for Bank RobberyRead the Press Release
United States Attorney Brendan V. Johnson announced that a Sioux Falls, South Dakota, man convicted of robbing a bank at gunpoint was sentenced on November 4, 2013, by Senior U.S. District Judge Charles B. Kornmann.
Nathan Michael Reisetter, age 39, was sentenced to 117 months in custody. He received 57 months for Bank Robbery and 60 months for Possession of a Firearm in Relation to a Federal Crime of Violence, to be served consecutively. He will be under supervised release for 5 years upon his release from custody. He was fined $12,500 and ordered to make restitution of $26,355.
Reisetter was indicted by a federal grand jury on March 19, 2013, on both counts and pled guilty on August 13, 2013.
On January 2, 2013, Reisetter entered First Bank and Trust in Toronto and used a 9mm handgun to intimidate the two tellers present. He handed one of the bank tellers a garbage bag and told her to fill it with money from the vault. Once the Defendant had the bag of money and while still holding the firearm, he directed the tellers to a back room of the bank and fled.
This case was investigated by the Deuel County Sheriff's Office, the South Dakota Division of Criminal Investigation, and the Federal Bureau of Investigation. Assistant U.S. Attorney John E. Haak prosecuted the case.

United States Attorney Brendan V. Johnson announced that a Wanblee, South Dakota, man convicted of Distribution of a Controlled Substance was sentenced on October 24, 2013, by Chief Judge Jeffrey L. Viken, U.S. District Court.
Steven James Bull Bear, age 48, was sentenced to time served, 2 years' supervised release, and a $100 special assessment to the Federal Crime Victims Fund.
On November 5, 2012, Bull Bear sold 26.6 grams of marijuana near Kyle, South Dakota, to an individual cooperating with law enforcement officers. Bull Bear pled guilty to the charge Distribution of a Controlled Substance on July 16, 2013.
This case was investigated by the Northern Plains Safe Trails Drug Enforcement Task Force, the Federal Bureau of Investigation, the Bureau of Indian Affairs Office of Justice Services, and the Oglala Sioux Tribe Department of Public Safety. United States Attorney Brendan V. Johnson announced that Eric Murphy, age 28, of Rapid City, South Dakota, appeared before U.S. Magistrate Judge Veronica L. Duffy on October 21, 2013, and pled guilty to a charge of Attempted Trafficking with Respect to Involuntary Servitude and Forced Labor.
The charge carries a maximum penalty upon conviction of 20 years and a $250,000 fine. Murphy will be required to register as a sex offender.
On August 3, 2013, as part of a sex-trafficking undercover operation during the Sturgis Motorcycle Rally, Murphy was arrested for attempting to obtain sex with a 12-year old girl. Murphy responded to a law enforcement-generated internet advertisement which advertised sex with a fictitious 12 or 13 year-old girl and negotiated the terms of the sexual encounter. Murphy then met with an undercover agent posing as someone who could provide a young girl, and was subsequently arrested.
The investigation was conducted by the South Dakota Internet Crimes Against Children Taskforce, the South Dakota Division of Criminal Investigation, the Federal Bureau of Investigation, the Rapid City Police Department, the Pennington County Sheriff’s office, and the Meade County Sheriff’s Office. The case is being prosecuted by Assistant U.S. Attorney Sarah B. Collins.

United States Attorney Brendan V. Johnson announced that a Rapid City, South Dakota, man has been indicted by a federal grand jury for Conspiracy to Distribute Controlled Substances.
Gallegos was remanded to the custody of the U.S. Marshals Service. A trial date has yet been set December 17, 2013.
Robert Gallegos, age 35, was indicted on September 24, 2013. He appeared before U.S. Magistrate Judge Veronica L. Duffy on October 25, 2013, and pled not guilty to the Indictment.
The maximum penalty upon conviction is at least 5 years and not more than 40 years’ imprisonment and/or a $5,000,000 fine. The charge is merely an accusation and Gallegos is presumed innocent until and unless proven guilty.
The investigation is being conducted by the Unified Narcotic Enforcement Team, the Drug Enforcement Administration, the Division of Criminal Investigation, and the Rapid City Police Department. United States Attorney Brendan V. Johnson announced that a Pine Ridge, South Dakota, man convicted of Sexual Abuse of a Minor was sentenced on October 25, 2013, by Chief Judge Jeffrey L. Viken, U.S. District Court.
Derek Black Elk, age 25, was sentenced to 36 months of imprisonment, 5 years of supervised release, and was ordered to pay $100 to the Federal Crime Victims Fund.
The conviction stems from an incident in March 2009 at a home in Pine Ridge when Black Elk engaged in a sexual act with a girl under the age of 16. Black Elk was indicted in September 2012 and pled guilty to the charge on March 20, 2013.
This case was investigated by the Bureau of Indian Affairs Office of Justice Services. Assistant U.S. Attorney Sarah Collins prosecuted the case.
Black Elk was immediately turned over to the custody of the U.S. Marshals Service.
