Nebraska Man Sentenced for Sexual Abuse of a MinorRead the Press Release
Acting United States Attorney Dennis R. Holmes announced that a Gordon, Nebraska, man convicted of Sexual Abuse of a Minor was sentenced by Jeffrey L. Viken, U.S. District Court.
Aaron Wade, age 48, was sentenced on April 6, 2021, to 46 months in federal prison, followed by 5 years of supervised release, and ordered to pay a $100 special assessment to the Federal Crime Victims Fund for each charge.
Wade was indicted by a federal grand jury in January 2019. The charge related to Wade sexually abusing a juvenile female in 2017 at Pine Ridge.
This case was investigated by the Federal Bureau of Investigation. Assistant U.S. Attorney Megan Poppen prosecuted the case.
Wade was immediately turned over to the custody of the U.S. Marshals Service.
Kyle Man Sentenced to 45 Years in Federal Prison for Sexual AssaultRead the Press Release
Acting United States Attorney Dennis R. Holmes announced that a Kyle, South Dakota, man convicted of two counts of Abusive Sexual Contact was sentenced by Jeffrey L. Viken, U.S. District Court.
Antonio Frazier, age 35, was sentenced on April 5, 2021, to 45 years in federal prison, followed by a lifetime of supervised release, and ordered to pay a $100 special assessment to the Federal Crime Victims Fund for each charge. The time in federal prison is to be served concurrently.
Frazier was indicted by a federal grand jury in February 2020. The charges related to Frazier, between 2005 and 2011, having sexual contact with a minor female child at a housing development near Kyle. Between 2003 and 2004, Frazier also had sexual contact with another juvenile female near Kyle.
This case was investigated by the Oglala Sioux Tribe Department of Public Safety and the Federal Bureau of Investigation. Assistant U.S. Attorney Megan Poppen prosecuted the case.
Frazier was immediately turned over to the custody of the U.S. Marshals Service.
Eagle Butte Man Charged with Sexual Abuse of a MinorRead the Press Release
Acting United States Attorney Dennis R. Holmes announced that an Eagle Butte, South Dakota, man has been indicted by a federal grand jury for Sexual Abuse of a Minor.
Luis Torres, a/k/a “Bubba”, age 21, was indicted on March 9, 2021. He appeared before U.S. Magistrate Judge Mark A. Moreno on April 8, 2021, and pled not guilty to the Indictment.
The maximum penalty upon conviction is up to 15 years in federal prison and/or a $250,000 fine, 5 years, and up to life, of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
The Indictment alleges that between February 1, 2019, and February 28, 2019, in Eagle Butte, Torres knowingly caused and attempted to cause a minor who had not attained the age of 16, to engage in a sexual act.
The charge is merely an accusation and Torres is presumed innocent until and unless proven guilty.
The investigation is being conducted by the Federal Bureau of Investigation. Assistant U.S. Attorney Jay Miller is prosecuting the case.
Torres was released on bond pending trial. A trial date has not been set.
Sioux Falls Man Charged with Multiple Fraud Counts regarding Pandemic Relief ProgramsRead the Press Release
Acting United States Attorney Dennis Holmes announced that a Sioux Falls, South Dakota, man has been indicted by a federal grand jury for Bank Fraud, Attempted Bank Fraud, False Statement to a Financial Institution; Engaging in Monetary Transactions in Property Derived from Specified Unlawful Activity, and False Statement.
James Bunker, d/b/a Genuine Builders, Inc., d/b/a Tri-State Ag Services, LLC, d/b/a Falls Framing, LLC, and d/b/a No. 18, LLC, age 50, was indicted on April 6, 2021. He appeared before U.S. Magistrate Judge Veronica L. Duffy on April 8, 2021, and pled not guilty to the Indictment.
The maximum penalty upon conviction is up to 30 years in federal prison and/or a $1,000,000 fine, five years of supervised release, and up to $1,200 to the Federal Crime Victims Fund. Restitution may also be ordered.
The Indictment alleges that Bunker defrauded or attempted to defraud banks in connection with his efforts to acquire loans under the Paycheck Protection Program, or the Main Street Lending Program that relate to pandemic relief programs. The Indictment also alleges that Bunker submitted or caused to be submitted false financial documents to the banks and lied on loan forgiveness applications submitted to the U.S. Small Business Administration.
The charges are merely accusations and Bunker is presumed innocent until and unless proven guilty.
The investigation is being conducted by the Federal Bureau of Investigation, the Internal Revenue Service, and the U.S. Attorney’s Office. The Special Inspector General for Pandemic Recovery is also assisting in this case. Assistant U.S. Attorney Ann M. Hoffman is prosecuting the case.
Bunker was released on bond pending trial which has been set for June 15, 2021.
Pine Ridge Man Sentenced for Abusive Sexual ContactRead the Press Release
Acting United States Attorney Dennis R. Holmes announced that a Pine Ridge, South Dakota, man convicted of Abusive Sexual Contact was sentenced by Jeffrey L. Viken, U.S. District Court.
Benton Rowland, age 36, was sentenced on March 26, 2021, to 20 years in federal prison, followed by 10 years of supervised release, and ordered to pay a $100 special assessment to the Federal Crime Victims Fund.
Rowland was indicted by a federal grand jury in November 2016. The charge related to Rowland engaging in sexual contact with a child under the age of 12, between 2008 and 2014 at Pine Ridge and Manderson, South Dakota.
This case was investigated by the Oglala Sioux Tribe Department of Public Safety and the Federal Bureau of Investigation. Assistant U.S. Attorney Megan Poppen prosecuted the case.
Rowland was immediately turned over to the custody of the U.S. Marshals Service.
McLaughlin Woman Charged with Assault of Federal OfficerRead the Press Release
Acting United States Attorney Dennis R. Holmes announced that a McLaughlin, South Dakota, woman has been indicted by a federal grand jury for two counts of Assault of a Federal Officer.
Theresa Red Fox, age 35, was indicted on February 8, 2021. She appeared before U.S. Magistrate Judge William D. Gerdes on April 2, 2021, and pled not guilty to the Indictment.
The maximum penalty upon conviction is eight years in federal prison and/or a $250,000 fine, three years of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
The Indictment alleges that on May 27, 2020, in McLaughlin, Red Fox assaulted two Bureau of Indian Affairs police officers while they were performing a lawful arrest.
The charges are merely accusations and Red Fox is presumed innocent until and unless proven guilty.
The investigation is being conducted by the Bureau of Indian Affairs, Office of Justice Services. Assistant U.S. Attorney Cameron J. Cook is prosecuting the case.
Red Fox was released on conditions pending trial. A trial date has not been set.
Kyle Man Found Guilty of Sexual Abuse of a MinorRead the Press Release
Acting United States Attorney Dennis R. Holmes announced that Charles “CJ” Good Voice Elk, age 29, of Kyle, South Dakota, was found guilty of Sexual Abuse and Sexual Abuse of a Minor following a federal jury trial in Rapid City, South Dakota. The verdict was returned on April 1, 2021.
The convictions carry a sentence of up to life in federal prison and/or a $250,000 fine, any term of years not less than five up to life of supervised release, a $200 special assessment to the Federal Crime Victims Fund, and restitution.
Evidence at trial established that Good Voice Elk engaged in sexual intercourse with the juvenile victim in January 2018, at Kyle.
The investigation was conducted by the Oglala Sioux Tribe Department of Public Safety and the Federal Bureau of Investigation. Assistant U.S. Attorney Heather Sazama prosecuted and tried the case.
A sentencing date will be scheduled. Good Voice Elk was remanded to the custody of the U.S. Marshals Service pending sentencing.
Flandreau Man Sentenced for Abusive Sexual ContactRead the Press Release
Acting United States Attorney Dennis R. Holmes announced that a Flandreau, South Dakota, man convicted of Abusive Sexual Contact was sentenced on April 5, 2021, by U.S. District Judge Karen E. Schreier.
Cecil Long, age 68, was sentenced to 24 months in federal prison, followed by five years of supervised release, and a special assessment to the Federal Crime Victims Fund in the amount of $100.
Long was indicted by a federal grand jury on January 7, 2020. He pled guilty on November 16, 2020.
The conviction stemmed from an incident between August 31, 2015, and August 30, 2016, when Long, without permission, engaged in sexual contact with a juvenile victim, who lived with Long at the time.
This case was investigated by the Federal Bureau of Investigation and the Flandreau Santee Sioux Tribal Police Department. Assistant U.S. Attorney Ann M. Hoffman prosecuted the case.
Long has been allowed to self-report to the custody of the U.S. Marshals Service by April 26, 2021.
Texas Man Sentenced to 10 Years for Meth TraffickingRead the Press Release
Acting United States Attorney Dennis Holmes announced that a Fort Worth, Texas, man convicted of Conspiracy to Distribute a Controlled Substance was sentenced on March 29, 2021, by U.S. District Judge Karen E. Schreier.
Michael Allen Youngberg, a/k/a Opie, age 50, was sentenced to 120 months in federal prison, five years of supervised release, and a special assessment to the Federal Crime Victims Fund in the amount of $100.
Youngberg was indicted by a federal grand jury on September 1, 2020. He pled guilty on January 22, 2021.
The conviction stemmed from incidents beginning on an unknown date and continuing to on or about September 1, 2020, when Youngberg, along with at least one other person, reached an agreement or came to an understanding to distribute 500 grams or more of a mixture containing methamphetamine. Youngberg facilitated the transportation and exchange of the methamphetamine which was intended for re-distribution within South Dakota and elsewhere. Methamphetamine is a Schedule II controlled substance.
This case was investigated by the South Dakota Division of Criminal Investigation, the Sioux Falls Area Drug Task Force, and the Drug Enforcement Administration. Special Assistant U.S. Attorney Tamara Nash prosecuted the case.
Youngberg was immediately turned over to the custody of the U.S. Marshals Service.
Mission Man Sentenced for AssaultRead the Press Release
Acting United States Attorney Dennis Holmes announced that a Mission, South Dakota, man convicted of Assault by Striking, Beating, or Wounding was sentenced on March 29, 2021, by U.S. Magistrate Judge Mark A. Moreno.
Nicholas Miles Ten Fingers, age 27, was sentenced to 12 months in federal prison, one year of supervised release, and a special assessment to the Federal Crime Victims Fund in the amount of $25.
Ten Fingers was indicted by a federal grand jury on September 9, 2020. He pled guilty on January 28, 2021.
The conviction stemmed from an incident that occurred on July 25, 2019, in Todd County, South Dakota. On that date, Ten Fingers cut a man with a knife.
This case was investigated by the Rosebud Sioux Tribe Law Enforcement Services. Assistant U.S. Attorney Michael J. Elmore prosecuted the case.
Ten Fingers was immediately turned over to the custody of the U.S. Marshals Service.
Huron Man Charged with Failure to RegisterRead the Press Release
Acting United States Attorney Dennis R. Holmes announced that a Huron, South Dakota, man has been indicted by a federal grand jury for Failure to Register as a Sex Offender.
Patrick Red Legs, age 27, was indicted on March 9, 2021. He appeared before U.S. Magistrate Judge Mark A. Moreno on March 29, 2021, and pled not guilty to the Indictment.
The maximum penalty upon conviction is up to 10 years in federal prison and/or a $250,000 fine, 5 years, and up to life, of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
The Indictment alleges that on multiple occasions between May 31, 2020, and September 16, 2020, Red Legs, a person required to register under the Sex Offender Registration and Notification Act, knowingly failed to register and update his registration as required by law.
The charge is merely an accusation and Red Legs is presumed innocent until and unless proven guilty.
The investigation is being conducted by the U.S. Marshals Service. Assistant U.S. Attorney Troy R. Morley is prosecuting the case.
Red Legs was remanded to the custody of the U.S. Marshals Service pending trial. A trial date of June 8, 2021, has been set.
Sioux Falls Man Sentenced for Heroin TraffickingRead the Press Release
Acting United States Attorney Dennis Holmes announced that a Sioux Falls, South Dakota, man convicted of Conspiracy to Distribute a Controlled Substance was sentenced on March 8, 2021 by U.S. District Judge Karen E. Schreier.
Jonathan Edward Brown, age 34, was sentenced to 84 months in federal prison, followed by four years of supervised release, and a special assessment to the Federal Crime Victims Fund in the amount of $100.
Brown was indicted by a federal grand jury on September 1, 2020. He pled guilty on December 14, 2020.
The conviction stemmed from incidents beginning on an unknown date and continuing until on or about September 1, 2020, when Brown knowingly and intentionally combined, conspired, confederated, and agreed with others to distribute a mixture and substance containing 100 grams or more of heroin.
Brown voluntarily and intentionally joined in the agreement to distribute heroin. Brown also knew the purpose of the agreement. Brown obtained over 100 grams of heroin from a co-conspirator and re-distributed to drug customers in the District of South Dakota and elsewhere. Heroin is a Schedule I controlled substance.
This case was investigated by the Sioux Falls Area Drug Task Force and the Drug Enforcement Administration. Assistant U.S. Attorney Jennifer D. Mammenga prosecuted the case.
Brown was immediately turned over to the custody of the U.S. Marshals Service.
Sioux Falls Man Sentenced for Distribution of a Controlled Substance Resulting in Serious Bodily InjuryRead the Press Release
Acting United States Attorney Dennis R. Holmes announced that a Sioux Falls, South Dakota, man convicted of Distribution of a Controlled Substance Resulting in Serious Bodily Injury was sentenced on March 29, 2021, by U.S. District Judge Karen E. Schreier.
Jordan Daniel Ugalde, age 29, was sentenced to 240 months in federal prison, followed by five years of supervised release, and a special assessment to the Federal Crime Victims Fund in the amount of $100.
Ugalde was indicted by a federal grand jury on August 17, 2020. He pled guilty on January 4, 2021.
The conviction stemmed from an incident on or about May 6, 2019, when Ugalde, knowingly and intentionally distributed heroin and said heroin resulted in the serious bodily injury of a victim. The victim self-injected the heroin provided by Ugalde and sustained an overdose which was reversed by the administration of Narcan. Heroin is a Schedule I controlled substance.
This case was investigated by the Sioux Falls Police Department and the Drug Enforcement Administration. Assistant U.S. Attorney Jennifer D. Mammenga prosecuted the case.
Ugalde was immediately turned over to the custody of the U.S. Marshals Service.

Valerie Red Fish, age 43, was indicted on February 8, 2021. She appeared before U.S. Magistrate Judge William D. Gerdes on March 26, 2021, and pled not guilty to the Indictment.
The maximum penalty upon conviction is eight years in federal prison and/or a $250,000 fine, three years of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.

Five Men and One Woman Sentenced for Meth Trafficking ConspiracyRead the Press Release
Acting United States Attorney Dennis Holmes announced that six defendants convicted of Conspiracy to Distribute a Controlled Substance, have been sentenced to federal prison terms by U.S. District Judge Karen E. Schreier.
Robert Henry Heyer, Jr., a/k/a Bobby Heyer, age 49, from Peoria, Arizona, was sentenced on March 8, 2021, to 280 months in federal prison, followed by 5 years of supervised release, and a special assessment to the Federal Crime Victims Fund in the amount of $100.
Andrew Charles Anderson, a/k/a Andy Anderson, age 44, from Sioux Falls, South Dakota, was sentenced on December 14, 2020, to 60 months in federal prison, followed by 3 years of supervised release, and a special assessment to the Federal Crime Victims Fund in the amount of $100.
Rex Leon Burtis, age 57, from Coleman, South Dakota, was sentenced on October 26, 2020, to 144 months in federal prison, followed by 5 years of supervised release, and a special assessment to the Federal Crime Victims Fund in the amount of $100.
Jacquelyn Ann Muhs, age 45, from Dimock, South Dakota, was sentenced on May 18, 2020, to 120 months of federal prison, followed by 5 years of supervised release, and a special assessment to the Federal Crime Victims Fund in the amount of $100.
Alex Geoffery Lang, age 26, from Sioux Falls, South Dakota, was sentenced on May 11, 2020, to 114 months in federal prison, followed by 5 years of supervised release, and a special assessment to the Federal Crime Victims Fund in the amount of $100.
Christopher F. Vonwille, age 58, from Sioux Falls, South Dakota, was sentenced on October 21, 2019, to 180 months in federal prison, followed by 5 years of supervised release, and a special assessment to the Federal Crime Victims Fund in the amount of $100.
Vonwille was indicted on March 5, 2019; Muhs and Burtis were indicted on May 8, 2019; Lang was indicted on June 6, 2019; and Anderson and Heyer were indicated on January 7, 2020.
Vonwille pled guilty on August 2, 2019; Lang pled guilty on January 28, 2020; Muhs pled guilty on February 24, 2020; Anderson pled guilty on September 23, 2020; and Heyer pled guilty on October 5, 2020.
Burtis was found guilty as a result of a federal jury trial in Sioux Falls, South Dakota, on July 28, 2020.
Beginning at an unknown date and continuing until on or about January 7, 2020, in the District of South Dakota and elsewhere, Defendants knowingly and intentionally combined, conspired, confederated, and agreed together, with others known and unknown, to knowingly and intentionally distribute a mixture and substance containing 500 grams or more of methamphetamine, which is a Scheduled II controlled substance.
This case was investigated by the U.S. Postal Inspection Service, Drug Enforcement Administration, Sioux Falls Police Department, Minnehaha County Sheriff’s Office, and the Department of Criminal Investigation. Assistant U.S. Attorney Jennifer D. Mammenga prosecuted the case.
All Defendants were turned over to the custody of the U.S. Marshals Service following their sentencings.
Rapid City Woman Found Guilty of Theft of Government Property and FraudRead the Press Release
Acting United States Attorney Dennis R. Holmes announced that Holli Lundahl, a/k/a Holli Telford, age 64, of Rapid City, South Dakota, was found guilty of Theft of Government Property and Supplemental Security Income Benefits Fraud following a federal jury trial in Rapid City, South Dakota. The verdict was returned on March 25, 2021.
The Theft of Government Property charge carries a maximum penalty of 10 years in prison and/or a $250,000 fine, and 3 years of supervised release. The Supplemental Security Income Benefits Fraud charge carries a maximum penalty of 5 years in prison and/or a $250,000 fine, and 3 years of supervised release. Each charge also carries a $100 special assessment to the Federal Crime Victims Fund and restitution may be ordered.
Evidence at trial established Lundahl knowingly stole and converted to her own use over $40,000 worth of Social Security Administration Title XVI Social Security Supplemental Income payments between 2014 and 2019. The evidence showed Lundahl received and kept the payments, even though she was not entitled to them, because she owned property and had resources far in excess of the limits permissible for Title XVI beneficiaries. In order to continue to receive the benefits, Lundahl falsely reported, concealed, and failed to disclose to the Social Security Administration extensive property, resources, and assets she held or possessed.
This case was investigated by the Office of the Inspector General – Social Security Administration. Assistant U.S. Attorney Eric Kelderman prosecuted and tried the case.
A presentence investigation was ordered and a sentencing date has not been set. Lundahl remains released on bond pending sentencing.
Sioux Falls Man Sentenced for Distribution of a Controlled Substance Resulting in Serious Bodily InjuryRead the Press Release
Acting United States Attorney Dennis R. Holmes announced that a Sioux Falls, South Dakota, man convicted of Distribution of a Controlled Substance Resulting in Serious Bodily Injury was sentenced on March 22, 2021, by U.S. District Judge Karen E. Schreier.
Jacob Allen Baker, age 27, was sentenced to 240 months in federal prison, followed by three years of supervised release, and a special assessment to the Federal Crime Victims Fund in the amount of $100.
Baker was indicted by a federal grand jury on August 17, 2020. He pled guilty on December 21, 2020.
The conviction stemmed from an incident on or about August 14, 2019, when Baker, knowingly and intentionally distributed fentanyl and said fentanyl resulted in the serious bodily injury of a victim. The victim smoked the fentanyl provided by Baker and sustained an overdose, which was reversed by the administration of Narcan. Fentanyl is a Schedule II controlled substance.
This case was investigated by the Sioux Falls Area Drug Task Force and the Drug Enforcement Agency. Special Assistant U.S. Attorney Mark Hodges prosecuted the case.
Baker was immediately turned over to the custody of the U.S. Marshals Service.
North Dakota Man Sentenced for Failure to Register as a Sex OffenderRead the Press Release
Acting United States Attorney Dennis R. Holmes announced that a Bismarck, North Dakota, man convicted of Failure to Register as a Sex Offender was sentenced on March 22, 2021, by U.S. District Judge Karen E. Schreier.
Dorian Lester, age 24, was sentenced to 18 months in federal prison, followed by five years of supervised release, and a special assessment to the Federal Crime Victims Fund in the amount of $100.
An Information was filed on January 20, 2021. Lester pled guilty on January 22, 2021.
The conviction stems from Lester failing to register as a sex offender as required by federal law between August 7, 2020, and November 3, 2020. Lester, who had previously been convicted of a sex offense in federal court, was classified as a Tier III sex offender which requires him to register for the rest of his life.
This case was investigated by the U.S. Marshals Service. Assistant U.S. Attorney Jeffrey C. Clapper prosecuted the case.
Lester was immediately turned over to the custody of the U.S. Marshals Service.
Lake Andes Man Charged with Receipt and Distribution of Child PornographyRead the Press Release
Acting United States Attorney Dennis Holmes announced that a Lake Andes, South Dakota, man has been indicted by a federal grand jury for Receipt and Distribution of Child Pornography.
Cameron Allen Zephier, age 24, was indicted on March 2, 2021. He appeared before U.S. Magistrate Judge Veronica L. Duffy on March 10, 2021, and pled not guilty to the Indictment.
The maximum penalty upon conviction is up to 20 years in federal prison and/or a $250,000 fine, life of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
The Indictment alleges that on or about between May 6, 2020, and September 30, 2020, Zephier knowingly received and attempted to receive child pornography that had been mailed, shipped, and transported in or affecting interstate or foreign commerce by any means, including by computer.
The charge is merely an accusation and Zephier is presumed innocent until and unless proven guilty.
The investigation is being conducted by the Federal Bureau of Investigation, Division of Criminal Investigation, and the Charles Mix County Sheriff’s Office. Assistant U.S. Attorney Jeffrey C. Clapper is prosecuting the case.
Zephier was remanded to the custody of the U.S. Marshals Service pending trial. A trial date has not been set.
Fort Thompson Woman Charged with Assaulting a Federal OfficerRead the Press Release
Acting United States Attorney Dennis R. Holmes announced that a Fort Thompson, South Dakota, woman has been indicted by a federal grand jury for Assaulting, Resisting, and Impeding a Federal Officer.
Jennifer Surrounded, age 35, was indicted on March 9, 2021. She appeared before U.S. Magistrate Judge Mark A. Moreno on March 24, 2021, and pled not guilty to the Indictment.
The maximum penalty upon conviction is up to 20 years in federal prison and/or a $250,000 fine, 3 years of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
The Indictment alleges that on February 12, 2021, in Fort Thompson, Surrounded assaulted an officer with a knife while the officer was engaged in the performance of his official duties.
The charge is merely an accusation and Surrounded is presumed innocent until and unless proven guilty.
The investigation is being conducted by the Bureau of Indian Affairs, Crow Creek Agency. Assistant U.S. Attorney Troy R. Morley is prosecuting the case.

Fort Thompson Man Charged with AssaultRead the Press Release
Acting United States Attorney Dennis R. Holmes announced that a Fort Thompson, South Dakota, man has been indicted by a federal grand jury for Assault with a Dangerous Weapon and Assault Resulting in Serious Bodily Injury.
Gavin Drapeau, age 29, was indicted on March 9, 2021. He appeared before U.S. Magistrate Judge Mark A. Moreno on March 24, 2021, and pled not guilty to the Indictment.
The maximum penalty upon conviction is up to 10 years in federal prison and/or a $250,000 fine, 3 years of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
The Indictment alleges that on January 11, 2021, in Fort Thompson, Drapeau unlawfully assaulted an individual with shot feet, and said assault resulted in serious bodily injury to the victim.
The charges are merely accusations and Drapeau is presumed innocent until and unless proven guilty.
The investigation is being conducted by the Bureau of Indian Affairs, Crow Creek Agency. Assistant U.S. Attorney Troy R. Morley is prosecuting the case.

Eagle Butte Man Charged with AssaultRead the Press Release
Acting United States Attorney Dennis R. Holmes announced that an Eagle Butte, South Dakota, man has been indicted by a federal grand jury for Assault with a Dangerous Weapon and Assault Resulting in Serious Bodily Injury.
Vine Janis, age 40, was indicted on March 9, 2021. He appeared before U.S. Magistrate Judge Mark A. Moreno on March 24, 2021, and pled not guilty to the Indictment.
The maximum penalty upon conviction is up to 10 years in federal prison and/or a $250,000 fine, 3 years of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
The Indictment alleges that December 20, 2020, in Eagle Butte, Janis assaulted an individual with a knife and said assault resulted in serious bodily injury to the victim.
The charges are merely accusations and Janis is presumed innocent until and unless proven guilty.
The investigation is being conducted by the Cheyenne River Sioux Tribe Law Enforcement Services. Assistant U.S. Attorney Jay Miller is prosecuting the case.
Janis was remanded to the custody of the U.S. Marshals Service pending trial. A trial date has not been set.
Winner Man Indicted on Child Pornography ChargesRead the Press Release
Acting United States Attorney Dennis Holmes announced that a Winner, South Dakota, man has been indicted by a federal grand jury for Receipt of Child Pornography and Possession of Child Pornography.
Clayton Spotted Calf, age 26, was indicted on March 9, 2021. He appeared before U.S. Magistrate Judge Mark A. Moreno on March 18, 2021, and pled not guilty to the Indictment.
The maximum penalty upon conviction is up to 20 years in federal prison and/or a $250,000 fine, five years up to life of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
The Indictment alleges that between December 15, 2020, and February 22, 2021, in Tripp County, South Dakota, Spotted Calf knowingly received and possessed child pornography.
The charges are merely accusations and Spotted Calf is presumed innocent until and unless proven guilty.
The investigation is being conducted by the South Dakota Division of Criminal Investigation, the U.S. Department of Homeland Security, and the Internet Crimes Against Children Task Force. Assistant U.S. Attorney Kirk Albertson is prosecuting the case.

St. Francis Man Sentenced on Firearm ChargeRead the Press Release
Acting United States Attorney Dennis Holmes announced that a St. Francis, South Dakota, man convicted of Possession of an Unregistered Firearm was sentenced on March 19, 2021, by Chief Judge Roberto A. Lange, U.S. District Court.
Kendall Elk Looks Back, age 30, was sentenced to 12 months and one day in federal prison, followed by three years of supervised release, forfeiture of the firearm, and a special assessment to the Federal Crime Victims Fund in the amount of $100.
Elk Looks Back was indicted by a federal grand jury on March 9, 2020. He pled guilty on July 27, 2020.
The conviction stemmed from an incident that occurred on January 13, 2019, in Todd County, South Dakota, Elk Looks Back possessed a weapon less than sixteen inches in length, which was not registered to him in the National Firearms Registration and Transfer Record.

Rapid City Woman Sentenced to 10 Years for Meth Trafficking ConspiracyRead the Press Release
Acting United States Attorney Dennis R. Holmes announced that a Rapid City, South Dakota, woman who pleaded guilty to Conspiracy to Distribute a Controlled Substance was sentenced on March 12, 2021, by U.S. District Court Judge Jeffrey L. Viken.
Erin Hunter, age 36, was sentenced to 10 years in federal prison, followed by five years of supervised release, and a $100 special assessment to the Federal Crime Victims Fund.
From approximately July 2019 to May 2020, methamphetamine was brought to South Dakota by others. Hunter then dispersed the methamphetamine to others for use or additional distribution.
This case was investigated by the Unified Narcotics Enforcement Team (UNET), Drug Enforcement Agency, the South Dakota Division of Criminal Investigation, and the Bureau of Alcohol, Tobacco, Firearms, and Explosives. UNET is comprised of law enforcement from the Pennington County Sheriff’s Office, Rapid City Police Department, South Dakota Division of Criminal Investigation, and the South Dakota National Guard.

Rapid City Man Sentenced to 15 Years in Federal Prison for Attempted Sexual Exploitation of a MinorRead the Press Release
Acting United States Attorney Dennis R. Holmes announced that a Rapid City, South Dakota, man convicted of Attempted Sexual Exploitation of a Minor was sentenced on March 12, 2021, by Jeffrey L. Viken, U.S. District Court Judge.
Jonathan Andrew Whitney, age 34, was sentenced to 15 years in federal prison, followed by five years of supervised release, and was ordered to pay a $100 special assessment to the Federal Crime Victims Fund. Whitney will also be required to register as a sex offender under the Sex Offender Registration and Notification Act.
The conviction stemmed from an undercover sex trafficking operation conducted during the 2019 Sturgis Motorcycle Rally, targeting internet predators. Whitney, a previously convicted sex offender, was arrested and federally indicted following multiple chats he exchanged with a person Whitney believed to be a 15-year-old girl, but who was in fact an undercover agent. Whitney sent sexually explicit messages to the 15-year-old undercover persona and negotiated the time and place he would meet the minor to engage in unlawful sex acts. When Whitney went to the pre-determined location to meet the minor, he was instead met by law enforcement agents and placed under arrest.
The investigation was conducted by the South Dakota Division of Criminal Investigation, Department of Homeland Security, Rapid City Police Department, and the Pennington County Sheriff’s Office. Assistant U.S. Attorney Sarah B. Collins prosecuted the case.
Whitney was immediately remanded to the custody of the U.S. Marshals Service.
Rapid City Man Sentenced on Firearm ChargeRead the Press Release
Acting United States Attorney Dennis R. Holmes announced that a Rapid City, South Dakota, man convicted of Possession of a Firearm by a Prohibited Person was sentenced by Jeffrey L. Viken, U.S. District Judge.
Gordon Cosme, age 38, was sentenced on March 12, 2021, to five years in federal prison, followed by three years of supervised release, and was ordered to pay a $100 special assessment to the Federal Crime Victims Fund.
The conviction stems from Cosme, who is prohibited from possessing firearms due to a previous felony conviction, possessing a Springfield Armory, .45 auto caliber semi-automatic pistol, which was found after Cosme came into contact with law enforcement officers in February 2019 in Rapid City.

Acting United States Attorney Dennis Holmes announced that a Rapid City, South Dakota, man convicted of Conspiracy to Distribute a Controlled Substance was sentenced on March 22, 2021, by U.S. District Judge Karen E. Schreier.
Jacob Lee Walton, age 33, was sentenced to 200 months in federal prison, followed by five years of supervised release, and a special assessment to the Federal Crime Victims Fund in the amount of $100.
Walton was indicted by a federal grand jury on January 7, 2020. He pled guilty on July 27, 2020.
The conviction stemmed from an incident beginning on an unknown date and continuing until on or about December 2019, when Walton, along with others, reached an agreement or came to an understanding to distribute 500 grams or more of a mixture of a substance containing methamphetamine, which is a Schedule II controlled substance.
This case was investigated by Department of Homeland Security – Homeland Security Investigation and the Drug Enforcement Administration. Special Assistant U.S. Attorney Tamara Nash prosecuted the case.
Walton was immediately turned over to the custody of the U.S. Marshals Service.
Rapid City Man Sentenced for Cocaine and Firearm ChargesRead the Press Release
Acting United States Attorney Dennis Holmes announced that a Rapid City, South Dakota, man convicted of Conspiracy to Distribute Cocaine and Possession of a Firearm by a Prohibited Person was sentenced on March 22, 2021, Chief Judge Roberto A. Lange, U.S. District Court.
Michael Kearney, age 29, was sentenced to 24 months in federal prison, followed by three years of supervised release, a fine of $500, and a special assessment to the Federal Crime Victims Fund in the amount of $200.
Kearney was indicted by a federal grand jury on March 9, 2020. He pled guilty on December 21, 2020.
The convictions stemmed from a drug conspiracy that occurred from January 2017 through March 2018. Kearney was involved in a conspiracy with others on the Rosebud Indian Reservation to distribute cocaine and marijuana. Further, on July 23, 2017, Kearney, knowing he was an unlawful user of and addicted to a controlled substance, knowingly possessed a firearm.
Drug trafficking is an inherently violent activity. Firearms are tools of the trade for drug dealers. It is common to find drug traffickers armed with guns in order to protect their illegal drug product and cash, and enforce their illegal operations.

Little Eagle Man Sentenced for AssaultRead the Press Release
Acting United States Attorney Dennis Holmes announced that a Little Eagle, South Dakota, man convicted of Assault by Striking, Beating, or Wounding was sentenced on March 16, 2021, by U.S. Magistrate Judge William D. Gerdes.
Deon Fast Horse, age 27, was sentenced to 180 days in federal prison, followed by one year of supervised release, and a special assessment to the Federal Crime Victims Fund in the amount of $25.
Fast Horse was indicted by a federal grand jury on September 9, 2020. He pled guilty on November 2, 2020.
The conviction stemmed from an incident that occurred on May 27, 2020, in McLaughlin, South Dakota. On that date, Fast Horse assaulted his dating partner.
This case was investigated by the Standing Rock Sioux Tribe Bureau of Indian Affairs. Assistant U.S. Attorney Meghan N. Dilges prosecuted the case.
Fast Horse was immediately remanded to the custody of the U.S. Marshals Service.
Jury Finds Eagle Butte Man Not Guilty of Assault with a Dangerous WeaponRead the Press Release
Acting United States Attorney Dennis R. Holmes announced that an Eagle Butte, South Dakota man was acquitted of Assault with a Dangerous Weapon as a result of a federal jury trial in Pierre, South Dakota, on March 17, 2021.
Joshua Heideman, age 27, was indicted by a federal grand jury on July 16, 2020.
The charge relates to an incident where the Defendant is alleged to have assaulted a 69-year old man with a bar on May 20, 2020, in Dupree. After the jury trial, Heideman was remanded into custody based upon his admission to violating the terms and conditions of his supervised release from a 2017 First Degree Burglary conviction

Colorado Man Charged with Possession of a Firearm by a Prohibited PersonRead the Press Release
Acting United States Attorney Dennis R. Holmes announced that a Canon City, Colorado, man has been indicted by a federal grand jury for Possession of a Firearm by a Prohibited Person.
Jeremiah Edward Haning, age 38, was indicted on January 12, 2021. He appeared before U.S. Magistrate Judge Veronica L. Duffy on March 17, 2021, and pled not guilty to the Indictment.
The maximum penalty upon conviction is up to 10 years in federal prison and/or a $250,000 fine, 3 years of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
The Indictment alleges that on or about May 18, 2020, Haning, who had previously been convicted of a crime punishable by imprisonment exceeding one year, and being an unlawful user of a controlled substance, knowingly possessed a Taurus .38 Special caliber revolver, which had been previously shipped and transported in interstate and foreign commerce.
The charge is merely an accusation and Haning is presumed innocent until and unless proven guilty.
The investigation is being conducted by the Alcohol, Tobacco, Firearms, and Explosives and the South Dakota Highway Patrol. Assistant U.S. Attorney Jeffrey C. Clapper is prosecuting the case.
Haning was remanded to the custody of the U.S. Marshals Service pending trial, which has been set for May 25, 2021.
Arizona Man Found Guilty of Sex CrimesRead the Press Release
Acting United States Dennis R. Holmes announced that Carlocito Slim, 35, was found guilty of Attempted Commercial Sex Trafficking of a Minor and Attempted Enticement of a Minor Using the Internet following a two-day federal court trial held in Rapid City, South Dakota. The verdict was returned on March 10, 2021.
Each charge carries a mandatory minimum sentence of 10 years up to life in federal prison and/or a $250,000 fine, a mandatory minimum of five years up to lifetime supervised release, and a $100 special assessment to the Federal Crime Victims Fund.
Evidence at trial established that Slim was arrested and federally indicted as a result of an undercover sex trafficking operation conducted during the 2017 Sturgis Motorcycle Rally, targeting internet predators. Following multiple text messages with a person Slim believed to be a pimp for a 15 year-old prostitute, but who was in fact an undercover agent, he proceeded to negotiate the time and place he would meet the minor to engage in unlawful sex acts. When Slim went to the pre-determined location to meet the minor’s pimp, he was instead met by law enforcement agents and placed under arrest.
The undercover operation and arrests were a joint effort between the South Dakota Division of Criminal Investigation, the Internet Crimes Against Children Task Force, and the Department of Homeland Security. Assistant U.S. Attorney Sarah B. Collins prosecuted and tried the case.
A presentence investigation was ordered and a sentencing date has not been set. Slim was remanded to the custody of the U.S. Marshals Service pending sentencing.

Tanner Kills Enemy, age 22, was indicted on March 9, 2021. He appeared before U.S. Magistrate Judge Mark A. Moreno on March 12, 2021, and pled not guilty to the Indictment.
The maximum penalty upon conviction is up to 10 years in federal prison and/or a $250,000 fine, five years of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
Kills Enemy was convicted of Sexual Abuse in October 2020. As a result of this conviction, he is required to register as a sex offender. It is alleged that between November 4, 2020, and March 12, 2021, Kills Enemy, a person required to register under the Sex Offender Registration and Notification Act, and a sex offender by reason of conviction under Federal Law, failed to properly register as a sex offender and update his registration.
The charge is merely an accusation and Kills Enemy is presumed innocent until and unless proven guilty.

Willard Henry, Jr., age 40, was indicted on March 11, 2021. He appeared before U.S. Magistrate Judge Mark A. Moreno on March 12, 2021, and pled not guilty to the Indictment.
The maximum penalty upon conviction is up to life in federal prison and/or a $250,000 fine, seven years of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
The Indictment alleges that on February 3, 2021, in Todd County, South Dakota, Henry assaulted, opposed, impeded, intimidated, and interfered with multiple law enforcement officers who were employed by the Rosebud Sioux Tribe Law Enforcement Services, and that such conduct involved the use of a firearm.

William Henry Horse Looking, age 39, was indicted on March 9, 2021. He appeared before U.S. Magistrate Judge Mark A. Moreno on March 12, 2021, and pled not guilty to the Indictment.

Horse Looking was convicted of Abusive Sexual Contact in April 2009. As a result of this conviction, he is required to register as a sex offender. It is alleged that between September 10, 2020, and March 12, 2021, Horse Looking, a person required to register under the Sex Offender Registration and Notification Act, and a sex offender by reason of conviction under Federal Law, failed to properly register as a sex offender and update his registration.

Moses Left Hand Bull, age 29, was indicted on October 14, 2020. He appeared before U.S. Magistrate Judge Mark A. Moreno on March 12, 2021, and pled not guilty to the Indictment.

Left Hand Bull was convicted of Aggravated Sexual Abuse of a Minor in August 2009. As a result of this conviction, he is required to register as a sex offender. It is alleged that between June 8, 2020, and October 14, 2020, Left Hand Bull, a person required to register under the Sex Offender Registration and Notification Act, and a sex offender by reason of conviction under Federal Law, failed to properly register as a sex offender and update his registration.
The charge is merely an accusation and Left Hand Bull is presumed innocent until and unless proven guilty.
The investigation is being conducted by the U.S. Marshals Service. Assistant U.S. Attorney Kirk Albertson is prosecuting the case.

Colorado Man Sentenced to 15 ½ years for Meth Trafficking ConspiracyRead the Press Release
Acting United States Attorney Dennis R. Holmes announced that a Denver, Colorado, man who pleaded guilty to Conspiracy to Distribute a Controlled Substance was sentenced on March 2, 2021, by U.S. District Court Judge Jeffrey L. Viken.
James Renwick, age 59, was sentenced to 15 ½ years in federal prison, followed by five years of supervised release, and a $100 special assessment to the Federal Crime Victims Fund.
From approximately September 2019 to December 2019, Renwick brought methamphetamine to South Dakota from Colorado. Renwick then dispersed the methamphetamine to others for use or additional distribution.
This case was investigated by the Unified Narcotics Enforcement Team (UNET), Drug Enforcement Agency, the South Dakota Division of Criminal Investigation, and the Bureau of Alcohol, Tobacco, Firearms, and Explosives. UNET is comprised of law enforcement from the Pennington County Sheriff’s Office, Rapid City Police Department, South Dakota Division of Criminal Investigation, and the South Dakota National Guard.
This case is part of Project Safe Neighborhoods (PSN), a program bringing together all levels of law enforcement and the communities they serve to reduce violent crime and make our neighborhoods safer for everyone. The Department of Justice reinvigorated PSN in 2017 as part of the Department’s renewed focus on targeting violent criminals, directing all U.S. Attorney’s Offices to work in partnership with federal, state, local, and tribal law enforcement and the local community to develop effective, locally-based strategies to reduce violent crime.

Rapid City Man Sentenced to Prison for Possession of Child PornographyRead the Press Release
Acting United States Attorney Dennis R. Holmes announced that a Rapid City, South Dakota, man convicted of Possession of Child Pornography was sentenced on March 8, 2021, by U.S. District Judge Jeffrey L. Viken.
Vance Allan Warthen, age 31, was sentenced to 36 months in federal prison, followed by five years of supervised release, and was ordered to pay a $100 special assessment to the Federal Crime Victims Fund. Warthen will also be required to register as a sex offender under the Sex Offender Registration and Notification Act.
The conviction stems from Warthen sexually exploiting an underage female in August 2019 at Rapid City by producing images of child pornography. He remained in possession of the images thereafter.
The investigation was conducted by the South Dakota Division of Criminal Investigation, the Department of Homeland Security, the Federal Bureau of Investigation, the Rapid City Police Department, and the Pennington County Sheriff’s Office. Assistant U.S. Attorney Sarah B. Collins prosecuted the case.
Warthen was immediately remanded to the custody of the U.S. Marshals Service.
Pierre Men Indicted on Firearm ChargesRead the Press Release
Acting United States Attorney Dennis Holmes announced that two Pierre, South Dakota, men have been indicted by a federal grand jury for Prohibited Person in Possession of Firearm.
Guillermo Arceo-Estrada, age 23, and Eduardo Velasquez-Padilla, a/k/a Eduardo Velazquez-Padilla, age 30, were indicted on January 12, 2021. Both men appeared before U.S. Magistrate Judge Mark A. Moreno on March 9, 2021, and both pled not guilty to the Indictment.

The Indictment alleges that on November 5, 2020, in Pierre, Arceo-Estrada and Velasquez-Padilla, then being aliens illegally and unlawfully in the United States, did knowingly possess several firearms.
The charges are merely accusations and Arceo-Estrada and Velasquez-Padilla are presumed innocent until and unless proven guilty.

Beresford Man Charged with Receipt and Distribution of Child PornographyRead the Press Release
Acting United States Attorney Dennis Holmes announced that a Beresford, South Dakota, man has been indicted by a federal grand jury for Receipt and Distribution of Child Pornography.
Anthony James Berst, age 33, was indicted on March 2, 2021. He appeared before U.S. Magistrate Judge Veronica L. Duffy on March 4, 2021 and pled not guilty to the Indictment.
The maximum penalty upon conviction is up to 20 years in federal prison and/or a $250,000 fine, life of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
The Indictment alleges that on or about between September 7, 2020, and on or about January 6, 2021, Berst knowingly received and attempted to receive child pornography that had been mailed, shipped, and transported in or affecting interstate or foreign commerce by any means, including a computer.
The charge is merely an accusation and Berst is presumed innocent until and unless proven guilty.
The investigation is being conducted by the Division of Criminal Investigation and Federal Bureau of Investigation. Assistant U.S. Attorney Jeffrey C. Clapper is prosecuting the case.
Berst was remanded to the custody of the U.S. Marshals Service pending trial, which has been set for May 11, 2021.
Yankton Man Convicted of Possession of a Controlled SubstanceRead the Press Release
Acting United States Attorney Dennis R. Holmes announced that Michael Wayne Zephier, age 40, of Yankton, South Dakota, was found guilty of Possession of a Controlled Substance (methamphetamine) as a result of a federal jury trial in Sioux Falls, South Dakota.
The charge carries a minimum penalty of 90 days and maximum penalty of 3 years in custody and/or a minimum of a $5,000 fine, up to one year of supervised release, and a $100 special assessment to the Federal Crime Victims Fund.
Zephier was indicted by a federal grand jury on March 3, 2020. The grand jury charged that on or about February 2, 2020, in the District of South Dakota, Zephier, did knowingly and intentionally, possess with the intent to distribute 5 or more grams of methamphetamine (actual), a Schedule II controlled substance, in violation of 21 U.S.C. § 841(a)(1). The trial jury found Zephier not guilty of that charge, but found him guilty of the lesser included crime of possession of methamphetamine.
This case was investigated by the Federal Bureau of Investigation, U.S. Department of Homeland Security, and Yankton Sioux Tribal Law Enforcement. Special Assistant U.S. Attorney Mark Hodges prosecuted the case.
A presentence investigation was ordered and a sentencing date was set for April 19, 2021. The defendant was returned to the custody of the State of South Dakota, where he is currently incarcerated for violation of his parole.
Rapid City Man Sentenced to Prison for Receipt of Child PornographyRead the Press Release
Acting United States Attorney Dennis R. Holmes announced that a Rapid City, South Dakota, man convicted of Receipt of Child Pornography was sentenced on March 4, 2021, by U.S. District Judge Jeffrey L. Viken.
James Dakota Miller, age 21, was sentenced to five years in federal prison, followed by five years supervised release, and was ordered to pay a $100 special assessment to the Federal Crime Victims Fund. Miller will also be required to register as a sex offender under the Sex Offender Registration and Notification Act.
Miller was arrested and federally indicted following multiple Cybertips from the National Center of Missing and Exploited Children. The Cybertips included images of child pornography of young children found among Miller’s possession.
The investigation was conducted by the South Dakota Division of Criminal Investigation, the Department of Homeland Security, the Rapid City Police Department, and the Pennington County Sheriff’s Office. Assistant U.S. Attorney Sarah Collins prosecuted the case.
Miller was immediately remanded to the custody of the U.S. Marshals Service.
Rapid City Man Sentenced on Robbery ChargesRead the Press Release
Acting United States Attorney Dennis R. Holmes announced that a Rapid City, South Dakota, man convicted of two counts of Interference with Commerce by Robbery (Hobbs Act) was sentenced by Jeffrey L. Viken, U.S. District Judge.
Michael Daker, age 59, was sentenced on March 5, 2021, to 13 years in federal prison, followed by three years of supervised release, and was ordered to pay a $200 special assessment to the Federal Crime Victims Fund and restitution in an amount to be determined at a later date.
The conviction stems from Daker forcibly robbing a Yesway Convenience Store in Spearfish, and a BP Casino in Rapid City in March 2020.

Rapid City Man Indicted on Child Pornography ChargesRead the Press Release
Acting United States Attorney Dennis R. Holmes announced that a Rapid City, South Dakota, man was charged in federal district court with Receipt of Child Pornography and Possession of Child Pornography.
Matthew Buchko, age 38, was charged on February 18, 2021. Buchko appeared before U.S. Magistrate Judge Daneta Wollmann on March 3, 2021, and pleaded not guilty to the charges. The penalty upon conviction is a mandatory minimum of 5 years up to 20 years in prison and/or a $250,000 fine, a minimum of 5 years up to lifetime supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
The charges relate to Buchko knowingly receiving and possessing images of child pornography between September 2019 and February 2020 at Rapid City. The charges are merely an accusation and Buchko is presumed innocent until and unless proven guilty.
The investigation is being conducted by the Internet Crimes Against Children Taskforce. Assistant U.S. Attorney Sarah Collins is prosecuting the case.
Buchko was detained pending trial. A trial date has been set for May 11, 2021.
Rapid City Man Charged with Second Degree MurderRead the Press Release
Acting United States Attorney Dennis R. Holmes announced that a Rapid City, South Dakota, man has been indicted by a federal grand jury for Second Degree Murder and Discharging, Brandishing, or Possessing a Firearm During and in Relation to a Crime of Violence.
Phillip Pond, age 39, appeared before U.S. Magistrate Judge Daneta Wollmann on March 3, 2021, and pleaded not guilty to the Indictment.
The maximum penalty upon conviction for each charge is up to life in prison, and/or a $250,000 fine, 5 years of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
The charges relate to Pond shooting and killing a man on November 22, 2020, at Pine Ridge.
The charges are merely accusations and Pond is presumed innocent until and unless proven guilty.
The investigation is being conducted by the Federal Bureau of Investigation and the Oglala Sioux Tribe Department of Public Safety. Assistant U.S. Attorney Heather Sazama is prosecuting the case.
Pond was remanded to the custody of the U.S. Marshals Service pending trial. A trial date has been set for April 27, 2021.
Box Elder Woman Sentenced on Robbery ChargeRead the Press Release
Acting United States Attorney Dennis R. Holmes announced that a Box Elder, South Dakota, woman convicted of Interference with Commerce by Robbery was sentenced by Jeffrey L. Viken, U.S. District Judge.
Karmen Englert, age 37, was sentenced on March 3, 2021, to 8 years in federal prison, followed by 3 years of supervised release, and was ordered to pay a $100 special assessment to the Federal Crime Victims Fund and $1,579.49 in restitution to Rushmore Casino and $800.00 in restitution to Market Square Casino.
The conviction stems from Englert driving two men to and from Rushmore Casino and Market Square Casino, where the males robbed the casinos at gunpoint in March 2020. The three also drove to Jokers Casino with the intent of committing a robbery but were unsuccessful. All three casinos are located in Rapid City, South Dakota.

Belle Fourche Man Sentenced to Five Years Imprisonment for Attempted Receipt of Child PornographyRead the Press Release
Acting United States Attorney Dennis R. Holmes announced that a Belle Fourche, South Dakota, man convicted of Attempted Receipt of Child Pornography was sentenced on February 26, 2021, by Jeffrey L. Viken, U.S. District Court Judge.
Tyler Wayne Deel, age 33, was sentenced to five years in federal prison, followed by five years of supervised release, and was ordered to pay a $100 special assessment to the Federal Crime Victims Fund.
Between August 2018 and November 2018, Deel resided in St. Onge, South Dakota, and had a computer with internet access. Using his computer to connect and access websites and applications for “Tumblr,” Deel received and distributed digital files containing images of child pornography. Many of the images of child pornography depicted young children.
The investigation was conducted by the South Dakota Division of Criminal Investigation, the Department of Homeland Security, the Rapid City Police Department, and the Pennington County Sheriff’s Office. Assistant U.S. Attorney Sarah B. Collins prosecuted the case.
Deel was immediately remanded to the custody of the U.S. Marshals Service.
Sioux Falls Woman Sentenced for Meth Trafficking ConspiracyRead the Press Release
Acting United States Attorney Dennis Holmes announced that a Sioux Falls, South Dakota, woman convicted of Conspiracy to Distribute a Controlled Substance (methamphetamine) was sentenced on March 1, 2021, by U.S. District Judge Karen E. Schreier.
Samantha Kay Hill, a/k/a Samantha Kay Rieger, age 33, was sentenced to 120 months in federal prison, followed by five years of supervised release, and a special assessment to the Federal Crime Victims Fund in the amount of $100.
Hill was indicted for Conspiracy to Distribute a Controlled Substance by a federal grand jury on July 20, 2020. She pled guilty on December 7, 2020.
The conviction stemmed from incidents beginning on an unknown date and continuing until approximately July 20, 2020.
On October 12, 2019, a vehicle Hill was driving, for the purposes of transporting methamphetamine, was stopped and searched by law enforcement. Inside the vehicle, law enforcement located over 50 grams of actual methamphetamine.
This case was investigated by the South Dakota Division of Criminal Investigation, the Sioux Falls Area Drug Task Force, and the Drug Enforcement Administration. Special Assistant U.S. Attorney Tamara Nash prosecuted the case.
Hill was immediately turned over to the custody of the U.S. Marshals Service.
