WHEELING, WEST VIRGINIA - United States Attorney William J. Ihlenfeld, II, announced that during the month of April, 2013, seventeen individuals had their supervised release or probation revoked for violating terms and conditions imposed by the United States District Court.

JESSE TALERICO, age 26, of Steubenville, Ohio, was sentenced to 9 months imprisonment for failing to submit monthly reports in a timely manner, failure to follow instructions of probation officer and absconding from supervision. TALERICO was originally sentenced on September 14, 2009, to 3 years probation for possession with intent to distribute heroin. On July 2, 2012, TALERICO’s probation was revoked and he was sentenced to 3 months imprisonment and 3 years of supervised release. TALERICO was remanded to the custody of the United States Marshal pending designation to a Federal institution.
MATTHEW IAN HAUGHT, age 30, of Follansbee, West Virginia, was sentenced to 3 months imprisonment to be followed by 33 months of supervised release for use and possession of controlled substances and failure to report for scheduled drug screens. HAUGHT was originally sentenced on August 14, 2009, to 33 months imprisonment and 3 years of supervised release for being a drug addict in possession of a firearm. HAUGHT will self-report to the designated Federal institution.
CRAIG ELMORE, age 25, of Weirton, West Virginia, was sentenced to 2 months imprisonment to be followed by 58 months of supervised release for possession and use of controlled substances; failure to report to probation officer; failure to participate in testing, counseling and treatment for drug abuse; and failure to notify probation officer to change in residence or employment. ELMORE was originally sentenced on August 25, 2008, to 46 months imprisonment and 5 years of supervised release for conspiracy to distribute more than
50 grams of cocaine base. On November 1, 2011, ELMORE’s sentence was reduced to 30 months imprisonment pursuant to the crack re-sentencing guidelines. ELMORE will self- report to the designated Federal institution.The United States was represented at the Wheeling revocation hearings by Assistant

JOSHUA BLEAU BARNETT, age 34, of Dunbar, West Virginia, was sentenced to 18 months imprisonment for absconding from supervision, failure to report to the probation officer and failure to follow the instruction of the probation officer. BARNETT was originally sentenced on September 2, 2004, to 33 months imprisonment and 3 years of supervised release for theft of firearms from a federally licensed firearms dealer. On May 17, 2012, BARNETT’s supervised release was revoked for possession and use of controlled substances and failure to report for drug testing and he was sentenced to 6 months imprisonment and 30 months supervised release. BARNETT was remanded to the custody of the United States Marshal pending designation to a Federal institution.ROBERT WALLS, age 45, of Morgantown, West Virginia, was sentenced to 15 months imprisonment for failure to notify probation officer before obtaining any prescription medications, failure to truthfully answer inquiries of probation officer, failure to follow instructions of probation officer, possession and use of a prescription medication, failure to participate in substance abuse counseling, and state conviction for doctor shopping. WALLS was originally sentenced on July 11, 2008, to 12 months and 1 day imprisonment and 3 years of supervised release for possession, sale and disposal of a firearm. On September 6, 2011, WALLS’ supervised release was revoked and he was sentenced to 9 months imprisonment and
27 months of supervised release. WALLS was remanded to the custody of the United States
Marshal pending designation to a Federal institution.JENNIFER L. KELLY, age 30, of Bridgeport, West Virginia, was sentenced to 14 months imprisonment for testing positive for the use of controlled substances, failure to appear for a drug screen and a new misdemeanor citation for possession of drug paraphernalia. KELLEY was originally sentenced on November 5, 2007, to 15 months imprisonment and 6 years of supervised release for the distribution of cocaine base within 1,000 feet of a playground. On August 26, 2011, KELLEY’s supervised release was revoked for testing positive for the use of controlled substances and failure to report for a drug test and she was sentenced to 18 months imprisonment and 54 months of supervised release. KELLEY was remanded to the custody of the United States Marshal pending designation to a Federal institution.
STEVIE LAMAR STEPHENS, age 32, of Morgantown, West Virginia, was sentenced to 12 months and 1 day imprisonment for testing positive for the use of marijuana on two separate occasions. STEPHENS was originally sentenced on January 3, 2006, to 41 months imprisonment and 6 years of supervised release for the distribution of cocaine base within
1,000 feet of a school. On March 14, 2008, STEPHENS sentence was reduced to 33 months imprisonment pursuant to the crack re-sentencing guidelines. STEPHENS will self-report to the designated Federal institution.JOSEPH SPENCE, age 27, of Rachel, West Virginia, was sentenced to 12 months imprisonment for unlawful use and possession of a controlled substance, failure to report for drug testing on two occasions and four new traffic citations. SPENCE was originally sentenced on January 23, 2008, to 20 months imprisonment and 3 years of supervised release for the distribution of cocaine base. On June 24, 2010, SPENCE’s supervised release was revoked for testing positive for the use of controlled substances and he was sentenced to 10 months imprisonment and 26 months of supervised release. SPENCE was remanded to the custody of the United States Marshal pending designation to a Federal institution.
HAROLD WEIGHTMAN WILLIAMS, III, age 42, of Clarksburg, was sentenced to
12 months imprisonment for failure to update sex offender registration, change in residence without permission and failure to submit to drug testing. WILLIAMS was originally sentenced on February 13, 2003, to 110 months imprisonment and 3 years of supervised release for being a convicted felon in possession of a firearm. On October 27, 2011, WILLIAMS’ supervised release was revoked for failure to follow instructions of the probation officer, failure to submit to drug testing, use of marijuana and change of residence without permission and he was sentenced to 2 months imprisonment and 34 months of supervised release. On February 1, 2012, WILLIAMS’ supervised release was once again revoked for testing positive for the use of cocaine and he was sentenced to 10 months imprisonment and 24 months of supervised release. WILLIAMS was remanded to the custody of the United States Marshal pending designation to a Federal institution.CRAIG WAYNE SINGLETON, age 52, of Clarksburg, was sentenced to 5 months imprisonment to be followed by 67 months of supervised release for failure to follow instructions of probation officer, failure to participate in substance abuse counsel, failure to report for drug testing, frequenting places where controlled substances are used and associating with persons involved in criminal activity. SINGLETON was originally sentenced on April 5, 2007, to 63 months imprisonment and 6 years of supervised release for the distribution of cocaine base within 1,000 feet of a protected location. On October 31, 2008, SINGLETON’s sentence was reduced to 41 months imprisonment pursuant to the crack re- sentencing guidelines. SINGLETON will self-report to the designated Federal institution.

DELMAR HOZA CURRY, age 32, of Martinsburg, West Virginia, was sentenced to
18 months imprisonment for failure to submit timely monthly reports, conviction for no operators, arrest on two counts of possession with intent to deliver a controlled substance, failure to report police contact with probation officer and failure to truthfully answer the probation officer’s inquiry. CURRY was originally sentenced on December 2, 2002, to 78 months imprisonment and 60 months of supervised release for possession with intent to distribute cocaine. On July 21, 2010, CURRY’s supervised release was revoked for failure to report for drug testing and failure to attend treatment program and he was sentenced to 5 months imprisonment and 48 months of supervised release. CURRY was remanded to the custody of the United States Marshal pending designation to a Federal institution.SHANNON JAMES BARNEY, age 30, of Martinsburg, was sentenced to 18 months imprisonment for use of controlled substances, failure to notify probation office of address change, failure to follow probation officer’s directions and committing a new federal, state or local crime. BARNEY was originally sentenced on May 9, 2012, to 27 months imprisonment and 3 years of supervised release for the possession with intent to distribute heroin. BARNEY was remanded to the custody of the United States Marshal pending designation to a Federal institution.
JUSTIN AARON KESECKER, age 29, of Hedgesville, West Virginia, was sentenced to 16 months imprisonment for leaving the judicial district without permission, testing positive for the use of controlled substances, being untruthful with probation officer and possession of heroin. KESECKER was originally sentenced on October 18, 2011, to 2 years probation for assaulting, resisting and impeding a United States Postal Clerk with the intent to rob the Clerk. On May 10, 2012, KESECKER’s probation was revoked for testing positive for the use of heroin and he was sentenced to 6 months imprisonment and 3 years of supervised release. KESECKER was remanded to the custody of the United States Marshal pending designation to a Federal institution.
JORDAN TYLER KESECKER, age 26, of Hedgesville, was sentenced to 16 months imprisonment for possession of heroin. KESECKER was originally sentenced on October 18,
2011, to 2 years probation for assaulting, resisting and impeding a United States Postal Clerk with the intent to rob the Clerk. On May 10, 2012, KESECKER’s probation was revoked for testing positive for the use of heroin and he was sentenced to 6 months imprisonment and 3 years of supervised release. KESECKER was remanded to the custody of the United States Marshal pending designation to a Federal institution.LOUIS GONZALEZ, age 31, of Martinsburg, was sentenced to 12 months imprisonment to be followed by 24 months of supervised release for a new felony conviction for armed robbery. GONZALEZ was originally sentenced on February 17, 2005, to 31 months imprisonment and 3 years of supervised release for making a false statement in the acquisition of a firearm. GONZALEZ was remanded to the custody of the United States Marshal pending designation to a Federal institution.
DAVID DWAYNE GESFORD, age 28, of Martinsburg, was sentenced to 6 months imprisonment to be followed by 18 months of supervised release for use of controlled substances, failure to attend counsel, failure to file report with probation office and a stae conviction for delivery of a counterfeit controlled substance. GESFORD was originally sentenced on August 5, 2008, to 21 months imprisonment and 24 months of supervised release for being a drug user in possession of a firearm. GESFORD was remanded to the custody of the United States Marshal pending designation to a Federal institution.
RICHARD ANDREW ZOMBRO, age 45, of Bunker Hill, West Virginia, was sentenced to 5 months imprisonment to be followed by 19 months of supervised release for leaving judicial district without permission of probation officer, possession of drug paraphernalia, use of controlled substances, associating with drug user, and failure to follow instructions of his probation officer. ZOMBRO was originally sentenced on July 6, 2011, to 10 months imprisonment and 2 years of supervised release for disposal of a stolen firearm. ZOMBRO was remanded to the custody of the United States Marshal pending designation to a Federal institution.

ELKINS, WEST VIRGINIA - Eight individuals were recently sentenced in United States District Court in Elkins by Chief Judge John Preston Bailey, with seven of the sentencings related to the manufacture of methamphetamine.
According to United States Attorney William J. Ihlenfeld, II, the following individuals appeared before Judge Bailey for sentencings:
RICHARD WAYNE WEAVER, age 38, of Horner, West Virginia, was sentenced to 135 months imprisonment to be followed by six years of supervised release. WEAVER entered a plea of guilty on September 18, 2012, to “Conspiracy to Manufacture, Possess with Intent to Distribute and Distribute Methamphetamine from May of 2011 to July of 2012 in the Northern District of West Virginia.” WEAVER was remanded to the custody of the United States Marshal pending designation to a Federal institution. The case was investigated by the Upshur County Sheriff’s Department, the Buckhannon Police Department and the United States Marshals Service.
ROBERT ALLEN COOK, age 49, of Moorefield, West Virginia, was sentenced to 78 months imprisonment to be followed by three years of supervised release. COOK entered a plea of guilty on November 30, 2012, to “Possession of Material Used in the Manufacture of Methamphetamine” for conduct that occurred in January of 2012, in Hardy County. CHAMP, who is free on bond, will self-report to the designated Federal institution. The case was investigated by the West Virginia State Police, the Hardy County Sheriff’s Department and the Moorefield Police Department.
ANDREW CARR, age 18, of Lahmansville, West Virginia, was sentenced to 48 months imprisonment to be followed by three years of supervised release. CARR entered a plea of guilty on December 11, 2012, to “Possession of Material Used in the Manufacture of Methamphetamine.” CARR, who is free on bond, will self-report to the designated Federal institution. This case was investigated by the Grant County Sheriff’s Department, the West Virginia State Police-BCI and United States Forest Service/Homeland Security Investigations.
STEVEN B. MILLER a/k/a “PASCO,” age 40, of Dryfork, West Virginia, was sentenced to 57 months imprisonment to be followed by three years of supervised release. MILLER entered a plea of guilty on December 11, 2012, to “Possession of Material Used in the Manufacture of Methamphetamine.” MILLER, who is free on bond, will self-report to the designated Federal institution. This case was investigated by the Randolph County Sheriff’s Department, the West Virginia State Police-BCI and United States Forest Service/Homeland Security Investigations.
PAULA LYNN CHAMP, age 30, of Purgitsville, West Virginia, was sentenced to 33 months imprisonment to be followed by three years of supervised release. CHAMP entered a plea of guilty on November 30, 2012, to “Possession of Material Used in the Manufacture of Methamphetamine” for conduct that occurred in January of 2012, in Hardy County. CHAMP, who is free on bond, will self-report to the designated Federal institution. The case was investigated by the West Virginia State Police, the Hardy County Sheriff’s Department and the Moorefield Police Department.
ARCHIE RAY ARBOGAST, age 36, of Durbin, West Virginia, was sentenced to five years probation, with the first six months being under home confinement. ARBOGAST entered a plea of guilty on December 11, 2012, to “Possession of Material Used in the Manufacture of Methamphetamine.” This case was investigated by the Randolph County Sheriff’s Department, the West Virginia State Police-BCI and United States Forest Service/Homeland Security Investigations.
KELLEY LEIGH COHENOUR, age 35, of Marlinton, West Virginia, was sentenced to five years probation. COHENOUR entered a plea of guilty on February 7, 2013, to “Possession of Material Used in the Manufacture of Methamphetamine.” This case was investigated by the West Virginia State Police (Pocahontas County Detachment), the Pocahontas County Sheriff’s Office and the Pocahontas County Community Corrections.
These cases were prosecuted by Assistant United States Attorney Stephen D. Warner. LAWAN GADDY, age 24, of Lewis County, West Virginia, was sentenced to 21 months
imprisonment to be followed by three years of supervised release. GADDY entered a plea of
guilty on December 14, 2012, to “Providing a False Statement to a Federal Firearms Licensee in the Acquisition of a Firearm” on September 20, 2011. GADDY, was remanded to the custody of the United States Marshal pending designation to a Federal institution. This case was prosecuted by Assistant United States Attorney Zelda E. MARTINSBURG, WEST VIRGINIA - A 32-year old Martinsburg resident entered a plea of guilty in United States District Court in Martinsburg before Judge Gina M. Groh.
United States Attorney William J. Ihlenfeld, II, announced that:
CARLOS EDWARD CAREY, age 32, of Martinsburg, entered a plea of guilty to “Distribution of Crack Cocaine within 1,000 feet of the Blue Ridge Community and Technical College.” CAREY, who is free on bond pending sentencing, faces at least 1 and up to 60 years imprisonment and a fine of $4,000,000, due to a prior felony drug conviction in the Northern District of West Virginia. This case was prosecuted by Assistant United States Attorney Jarod J. Douglas and investigated by the Eastern Panhandle Drug & Violent Crime Task Force, consisting of officers from the West Virginia State Police - Bureau of Criminal Investigation, the Martinsburg Police Department, and the Berkeley County Sheriff’s Department.

WHEELING, WEST VIRGINIA - A 35-year old Deland, Florida, resident was sentenced on May 13, 2013, in United States District Court in Wheeling by Judge Frederick P. Stamp, Jr.
United States Attorney William J. Ihlenfeld, II, announced that: JAMIE L. JOYNER was sentenced to 120 months imprisonment to be followed by three years of supervised release. JOYNER entered a plea of guilty on January 3, 2013, to “Conspiracy to Distribute Schedule II Controlled Substances” from March of 2012 to September 12, 2012, for his role in Florida to West Virginia pill ring. In a joint investigation, involving the Marshall County Sheriff’s Department, the Moundsville Police Department, the DEA, United State Postal Service, and the West Virginia State Police, beginning in the spring of 2012, agents received information that an apartment in Marshall County was being used to distribute oxycodone pills being brought to West Virginia from Florida, typically via rental vehicles. The Court also ordered the forfeiture of $2,096 in drug proceeds.
This case was prosecuted by Assistant United States Attorney John C. Parr.

Ten others appear for Pleas and Sentencings
CLARKSBURG, WEST VIRGINIA - United States Attorney William J. Ihlenfeld, II
announced that the following individuals recently appeared in Federal Court in Clarksburg.RICHARD MAURICE HADDIX, age 33, of Elkins, West Virginia, entered a plea of guilty to “Wire Fraud.” HADDIX was a broker for a transportation management firm and created 230 fictitious cash advances and caused $102,260 to be deposited into his personal bank account. As part of his plea agreement, HADDIX will make restitution in the amount of $102,260 to the victims of his crime. HADDIX, who is free on bond pending sentencing, faces up to 20 years imprisonment and a $250,000 fine. This case was prosecuted by Assistant United States Attorney Stephen D. Warner and investigated by the Elkins Police Department.
BETH ALLEVATO a/k/a “ROXIE”, age 40, of Clarksburg, was sentenced to 33 months imprisonment to be followed by six years of supervised release. ALLEVATO entered a plea of guilty on November 28, 2012, to “Distribution of Cocaine” on December 2, 2011, in Clarksburg. ALLEVATO was remanded to the custody of the United States Marshal pending designation to a Federal institution. The case was prosecuted by Criminal Chief Shawn A. Morgan and investigated by the Harrison County Drug Task Force consisting of officers from the Clarksburg Police Department, the Harrison County Sheriff’s Department and the Bridgeport Police Department.
ANTHONY CRIPPIN, age 29, of Morgantown, entered a plea of guilty to “Distribution of Heroin within 1,000 Feet of WVU.” CRIPPIN, who is in custody pending sentencing, faces a term of at least 1 and up to 40 years imprisonment and a $2,000,000 fine. This case was prosecuted by Assistant United States Attorney Andrew R. Cogar and investigated by the Mon Valley Drug Task Force and the West Virginia State Police. The task force consists of officers from Morgantown Police Department, the Monongalia County Sheriff’s Department, and the Drug Enforcement Administration.
JENNIFER KELLEY, age 28, of Morgantown, West Virginia, entered a plea of guilty to “Distribution of Cocaine Hydrochloride.” KELLEY, who is free on bond pending sentencing, faces up to 20 years imprisonment and a $1,000,000 fine. This case was prosecuted by Assistant United States Attorney Zelda E. Wesley and was investigated by the West Virginia State Police-Bureau of Criminal Investigations.
WILLIAM TRENT RICHARDSON, age 21, of French Creek, West Virginia, entered a plea of guilty to Maintaining a Drug-Involved Premise” from February 2 to September 13,
2012, to manufacture, store, distribute and use methamphetamine. RICHARDSON, who is free on bond pending sentencing, faces up to 20 years imprisonment and a $500,000 fine. This case was prosecuted by Assistant United States Attorney Stephen D. Warner and investigated by the West Virginia State Police.JOHN THOMAS CHINNICI, age 27; VICTOR AVILES, age 32 and ALEX TEJADA, age 31, former inmates at FCI Gilmer entered pleas of guilty to “Assault.” On June 30, 2011, CHINNICI, AVILES and TEJADA assaulted another inmate by punching, kicking and stabbing him eight times with prison-made knives. CHINNICI, AVILES and TEJADA were each sentenced to 12 months imprisonment and remanded to the custody of the United States Marshal. This case was prosecuted by Assistant United States Attorney Brandon S. Flower and was investigated by the Special Investigative Services Staff at FCI Gilmer.
BENJAMIN RAYMOND, age 36, and DRYDEN CRAVENS, age 45, inmates at USP Hazleton entered pleas of guilty to “Assault.” On November 10, 2012, RAYMOND and CRAVENS assaulted another inmate by stabbing them 6 times with prison-made knives. RAYMOND was sentenced to 24 months imprisonment to run consecutive to his current sentence of 300 months. CRAVENS was sentenced to 18 months imprisonment to run concurrent with his current sentence of 77 months. This case was prosecuted by Assistant United States Attorney Brandon S. Flower and was investigated by the Special Investigative Services Staff at USP Hazelton.
ZSA ZSA DEE FIELDS, age 45, of Detroit, Michigan, entered a plea of guilty to “Introduction of a Prohibited Object - Marijuana.” On December 17, 2011, FIELDS provided marijuana to an inmate at FCI Gilmer. FIELDS was sentenced to 18 months probation. The case was prosecuted by Assistant United States Attorney Brandon S. Flower and investigated by the Special Investigative Services at FCI Gilmer.

ELKINS, WEST VIRGINIA - A 43 year old Belington attorney was recently sentenced to federal prison for billing the State of West Virginia for services that she did not perform.
According to United States Attorney William J. Ihlenfeld, II, attorney LISA A. WEESE was sentenced by Chief Judge John Preston Bailey to 12 months and 1 day imprisonment to be followed by three years of supervised release.
WEESE entered a plea of guilty on November 6, 2012 to “Mail Fraud.” From September 2006 to September 2011, WEESE was a panel attorney in the Circuit Court of Barbour, Randolph, Tucker and Taylor Counties. During this five-year period, WEESE submitted fraudulent vouchers to West Virginia Public Defender Services claiming to have worked more than 24 hours on each of the forty-eight days and more than 16 hours on an additional one hundred and sixty-eight days. The total amount of loss based on compensation paid to her for work she did not perform was $159,130.08. Judge Bailey is in the process of determining the precise amount of restitution that must be paid by WEESE and will provide a separate order regarding that issue in the near future.
WEESE, who is free on bond, will self-report to the designated Federal institution. The case was prosecuted by Assistant United States Attorney Stephen D. Warner and

CLARKSBURG, WEST VIRGINIA —United States Attorney William J. Ihlenfeld, II, announced that DEBORAH D. RADCLIFF, age 41, of Weston, West Virginia, was named in an eight-count Indictment charging her with one count of “Embezzlement by a Bank Employee” and seven counts of “Structuring.”
According to the Indictment, while serving as the branch manager of the Weston branch bank of Huntington National Bank from July 1, 2011, to November 5, 2012, RADCLIFF embezzled and misapplied $247,249.88 from depositors’ accounts and engaged in acts of structuring to cause the bank to fail to file a Currency Transaction Report for currency transactions of $10,000 or more. To execute the scheme, RADCLIFF utilized her position as branch manager to issue or direct to be issued cashier’s checks from funds withdrawn from depositors’ accounts issued in the name of the depositor. RADCLIFF would take possession of the cashier’s check, forge the name of the depositor and cash the checks for her own personal benefit. The ages of the alleged victims ranged from 56 to 90 years, with all but one alleged victim 64 years or older.
The Indictment also seeks the forfeiture of a money judgment of the $247,249.88. If convicted, RADCLIFF faces up to 30 years imprisonment and a $1,000,000 fine on the embezzlement count and up to 10 years imprisonment and a $500,000 fine on each of the structuring counts. This case will be prosecuted by Assistant United States Attorney John C. Parr and was investigated by the Federal Bureau of Investigation.
Other indictments returned by the grand jury include: MARTINSBURG DIVISION
DUANE MCATEE, age 43, of Metz, West Virginia, was named in a one-count
Indictment charging him with “Contempt of Court.” The Indictment alleges that on April 2,
2013, MCATEE disobeyed a lawful process of a Court by failing to appear as directed. If convicted, MCATEE faces up to six months imprisonment. The case was investigated by the FBI and IRS-CI.JOSE DELEON HERNANDEZ was named in a one-count Indictment charging him with “Illegal Reentry After Removal.” If convicted, HERNANDEZ faces up to two years imprisonment and a $250,000 fine. The case was investigated by US Immigration and Customs Enforcement, Homeland Security Investigations (ICE/HSI).
These two cases will be prosecuted by Assistant United States Attorney Paul T. Camilletti.
CLARKSBURG DIVISION
BRIAN FARLEY, age 30, of Oceana, West Virginia, was named in a fourteen-count Indictment charging him with six counts of “Obtaining Drugs by Fraud” and eight counts of “Making a Material False Statement.” If convicted, FARLEY faces up to 4 years imprisonment and a $250,000 fine on the fraud charges and up to 5 years imprisonment and a $250,000 fine on the false statement charges. This case will be prosecuted by Assistant United States Attorney Robert H. McWilliams, Jr. and was investigated by the US Deparmtent of Veterans’ Affairs/Office of Inspector General-Criminal Investigations Division.
EDWARD C. CROW, age 43, a former inmate at USP Hazelton, was indicted for multiple counts of “Possession of a Prohibited Object”, “Assaulting, Resisting and Impeding Officers,” and “Assault with a Dangerous Weapon with Intent to do Bodily Harm.” If convicted, CROW faces up to 40 years imprisonment. This case will be prosecuted by Assistant United States Attorney Brandon S. Flower and was investigated by the Special Investigative Services Staff at USP Hazelton.
SHANE O. BRANTLEY, age 36, of Sutton, West Virginia, was named in a one-count Indictment charging him with “Felon in Possession of a Firearm” on April 25, 2012, in Braxton County. If convicted, BRANTLEY faces a maximum exposure of 10 years imprisonment and a fine of $250,000.
RONALD M. STARKEY, age 27, of Morgantown, West Virginia, was named in a one- count Indictment charging him with “Felon in Possession of a Firearm” on May 24, 2011, in Morgantown. If convicted, STARKEY faces a maximum exposure of 10 years imprisonment and a fine of $250,000.
These two cases were investigated by the Bureau of Alcohol, Tobacco, Firearms and
Explosives.CHRISTOPHER WEAVER, age 36, of Morgantown, was named in a three-count Indictment charging him with one count of “Distribution of Crack Cocaine” and two counts of “Distribution of Cocaine Hydrochloride.” If convicted, WEAVER faces up to 20 years imprisonment and a $1,000,000 fine on each count. This case was investigated by the West Virginia State Police-Bureau of Criminal Investigations.
WELFORD LEE HARRIS, age 27 and CASEY SMITH, age 20, of Morgantown were named in an eight-count Indictment charging them with“Conspiracy to Possess with Intent to Distribute and to Distribute Oxycodone” and multiple counts of “Distribution of Oxycodone” and “Possession with Intent to Distribute Cocaine Hydrochloride.” If convicted, HARRIS and SMITH face up to 20 years imprisonment and a $1,000,000 fine on each count. This case was investigated by the Mon Valley Drug Task Force and the West Virginia State Police. The task force consists of officers from Morgantown Police Department, the Monongalia County Sheriff’s Department, and the Drug Enforcement Administration.
These four cases will be prosecuted by Assistant United States Attorney Zelda E. Wesley.
All of the charges contained in the above-referenced indictments are merely accusations and not evidence of guilt, and each defendant is presumed innocent until and unless proven guilty.

MORGANTOWN, WEST VIRGINIA - Charges were filed today against two teenagers implicated in the death and disappearance of Star City, West Virginia, teen Skylar Neese.
United States Attorney William Ihlenfeld, II and the Monongalia County Prosecutor’s Office announced that RACHEL SHOAF, 16 years old, of Morgantown, WV, was charged today with the murder of Neese, whose body was found in Pennsylvania on January 16, 2013. During her appearance in the Circuit Court of Monongalia County this morning SHOAF pleaded guilty to Second Degree Murder after agreeing to be transferred to adult status. She is in custody awaiting sentencing.
Charges are pending against a second juvenile who is currently in custody in Monongalia County. Due to the nature of the proceedings, no further information is available at the present time.
The charges filed today were the result of a continuing joint state and federal investigation conducted by the Star City Police, the West Virginia State Police, the Federal Bureau of Investigation, and other law enforcement agencies. The cases now pending will be prosecuted by Monongalia County Prosecuting Attorney Marcia Ashdown and Assistant Prosecuting Attorney Perri Jo DeChristopher.

Defendant fired shot after fight in Downtown Wheeling
WHEELING, WEST VIRGINIA – A 33-year old Wheeling man was sentenced this week in United States District Court for possession of a handgun that he fired at another man following a fist fight last year.
U.S. Attorney William Ihlenfeld, II, announced that CORDALE A. WILLIAMS received a 65-month prison term as a result of his conviction for “Felon in Possession of a Firearm.” According to testimony offered in court, Wheeling Police officers responded to a gunshot being fired after midnight on June 22, 2012, outside of the 7-11 store on Market Street and upon arrival learned that WILLIAMS had been in a fight with another man over a woman. D uring the fight WILLIAMS pulled a gun out and fired it at the person with whom he was fighting. WILLIAMS then chased after the man before coming came back to the 7-11 and dropping the firearm on the ground. Much of the incident was captured by a surveillance camera that was located in the area.
WILLIAMS has a prior federal felony conviction for “Distribution of Crack Cocaine within 1,000 feet of a School”, and was on supervised release at the time of the shooting incident. For violating the terms of his release WILLIAMS was given 24 months but that sentence that was ordered to run at the same time as the 65-month term.
WILLIAMS was remanded to the custody of the United States Marshal pending designation to a Federal institution.
The case was prosecuted by U.S. Attorney Ihlenfeld and Assistant U.S. Attorney Jarod J. Douglas. It was investigated by the Wheeling Police Department and the Bureau of Alcohol, Tobacco, Firearms and Explosives.

15, 2013, despite having a prior felony conviction from the Circuit Court of Cabell County for Burglary. As part of his plea, WILLIAMS will abandon the firearm. WILLIAMS, who is in custody pending sentencing, faces up to 10 years imprisonment and a $250,000 fine.JOHN HARLOW, age 46, of Clarksburg, entered a plea of guilty to“Possession of a Firearm by a Convicted Felon.” HARLOW possessed a firearm on February 13, 2012, despite having three prior felony convictions from the United States District Court for the Northern District of West Virginia for distribution of cocaine base, distribution of heroin and interstate transportation in aid of racketeering. HARLOW, who is in custody pending sentencing, faces up to 10 years imprisonment and a $250,000 fine.

CLARKSBURG, WEST VIRGINIA — A 30 year-old Morgantown, West Virginia, resident was convicted on April 18, 2013, by a Clarksburg jury on one count. The trial lasted two days, concluding early Thursday evening. Judge Irene M. Keeley presided over the trial.
United States Attorney William J. Ihlenfeld, II, announced that: SAMAD MADIR HARVEY a/k/a “WES,” was convicted of Possession of a Firearm on September 16, 2012, in Monongalia County after having previously been convicted of a crime punishable by imprisonment for a term exceeding one year. HARVEY had prior felony convictions from the Superior Court of Monmouth, New Jersey for Possession of Controlled Dangerous Substance and Distribution of Controlled Dangerous Substance.
Trial evidence indicated that HARVEY illegally possessed a Kel-Tec Model PSAT, .380 caliber pistol.
HARVEY, who is in custody pending sentencing, faces up to 10 years imprisonment and a $250,000 fine.

United States Attorney William J. Ihlenfeld, II, announced that: MARK WAYNE LUNDELL a/k/a “BREEZY” was sentenced to 63 months imprisonment to be followed by six years of supervised release. LUNDELL entered a plea of guilty on November 29, 2012, to “Distribution of Heroin within 1,000 Feet of Northview Elementary School on June 5, 2012. LUNDELL will also forfeit his interest in $1,675 seized during the execution of a search warrant at his residence and which constitutes proceeds from the drug activity. LUNDELL, who is free on bond, will self-report to the designated Federal institution on May 17, 2013.

WHEELING, WEST VIRGINIA - Two individuals were arrested today by agents of the Marshall County Drug Task Force pursuant to an Indictment returned by a Federal Grand Jury on April 16, 2013.
According to United States Attorney William J. Ihlenfeld, II:
AMANDA ALLISON, age 26, of Cameron, West Virginia, and TYLER JAY HOYLE, age 22, of Waynesburg, Pennsylvania, were charged with “Conspiracy to Distribute Heroin” from January of 2013 to April 6, 2013, in Cameron. ALLISON was also charged with three counts of “Illegal Use of a Telephone to Facilitate the Distribution of Heroin,” two counts of “Distribution of Heroin,” and, one count of “Distribution of Oxycodone.” The indictment also seeks the forfeiture of a money judgment of $7,500 and $3,100 in currency seized in the investigation, which constitutes proceeds from the drug activity.
ALLISON and HOYLE appeared in court today for an initial appearance. ALLISON was released with conditions and HOYLE was remanded to custody pending a detention hearing.
If convicted, ALLISON and HOYLE face up to 20 years imprisonment and a
$1,000,000 fine on the conspiracy charge. In addition, ALLISON faces up to 4 years imprisonment and a $250,000 fine on the phone charges and 20 years imprisonment and a
$1,000,000 fine on the distribution charges.

WHEELING, WEST VIRGINIA – Two Washington, Pennsylvania, men entered pleas of guilty on April 15, 2013, in United States District Court in Wheeling before Judge Frederick P. Stamp, Jr. in relation to the kidnapping of a low-functioning Wheeling woman and taking her across state lines to engage in illegal sexual activity for four days in July.
According to U.S. Attorney William J. Ihlenfeld, II, Jose Jesús TAPIA MONTES, age 38, and Elmer Pina PINTO, age 44, of Washington, Pennsylvania, entered pleas of guilty to “Aiding and Abetting in the Transportation of an Individual in Interstate Commerce with Intent to Engage in Illegal Sexual Activity.”
MONTES and PINTO, who are in custody pending sentencing, faces up to 10 years imprisonment and a $250,000 fine.

TROY LEWIS, age 40, entered a plea of guilty to “Possession of a Prohibited Object” on December 6, 2012, when a correction officer conducted a random search of inmate LEWIS and found a cell phone hidden in his pants pocket. LEWIS was sentenced to 3 months imprisonment to be served concurrently with his current 144-month sentence.
FRANK NAGI, age 39, entered a plea of guilty to “Possession of a Prohibited Object” on January 13, 2013, when a correction officer conducted a random search of inmate LEWIS and found a cell phone hidden in his pants pocket. NAGI was sentenced to 3 months imprisonment to be served concurrently with his current 78-month sentence.
PANAGOITOS SKORDALOS, age 34, entered a plea of guilty to “Possession of a Prohibited Object” on January 7, 2013, when a correction officer found a cell phone hidden in SKORDALOS’ bed. SKORDALOS was sentenced to 3 months imprisonment to be served consecutively with his current 180-month sentence.

WHEELING, WEST VIRGINIA - A 34-year old Moundsville, West Virginia, resident was sentenced on April 15, 2012, in United States District Court in Wheeling by Judge Frederick P. Stamp, Jr. for her role in a Florida to West Virginia pill ring.
United States Attorney William J. Ihlenfeld, II, announced that: MILLIE F. ROUPE was sentenced to 46 months imprisonment to be followed by three years of supervised release. ROUPE entered a plea of guilty on November 28, 2012, to “Conspiracy to Distribute Schedule II Controlled Substances” from March of 2012 to September 12, 2012, in Moundsville. ROUPE was remanded to the custody of the United States Marshal pending designation to a Federal institution.
In a joint investigation, involving the Marshall County Sheriff’s Department, the DEA, United State Postal Service, and the West Virginia State Police, beginning in the spring of
2012, agents received information that ROUPE’s apartment in Marshall County was being used to distribute pills being brought to West Virginia from Florida typically via rental vehicles. During the investigation, two traffic stops occurred during which $5,500 in drug proceeds were seized which will be forfeited to the United States as proceeds from the drug activity.This case was prosecuted by Assistant United States Attorney John C. ROBERT JOHN SUMMERVILLE, III, was resentenced to 120 months imprisonment to be followed by three years of supervised release. SUMMERVILLE entered a plea of guilty on March 22, 2012, to one count of possession of a firearm on November 7, 2010, in Jefferson County, after having previously been convicted of a crime punishable by imprisonment for a term exceeding one year. SUMMERVILLE was convicted on April 17, 2009, of burglary in Tarrant County, Texas; on February 8, 2005, of assault in the second degree in the Circuit Court of Allegheny County, Maryland; and, on June 15, 2004, of resisting arrest in the Circuit Court of Washington County, Maryland.
On July 5, 2012, SUMMERVILLE was sentenced to 262 months imprisonment, but case was remanded by the Fourth Circuit Court of Appeals for recalculation of SUMMERVILLE’s criminal history as his prior convictions did not make him an Armed Career Criminal.
SUMMERVILLE was remanded to the custody of the United States Marshal pending designation to a Federal institution.

ELKINS, WEST VIRGINIA — Nine individuals were named in seven Indictments returned by a federal grand jury sitting in Elkins, West Virginia, on April 16, 2013.
United States Attorney William J. Ihlenfeld, II, announced the following indictments: CHARLES ADKINS, age 53, of Erie, Pennsylvania, who was previously charged in a
one-count Indictment on March 5, 2013, was named in a three-count Superseding Indictment
charging him with “Failure to Update Sex Offender Registration”, “Attempting to Obstruction Justice,” and “False Declarations before Court.” Count One of the Superseding Indictment alleges that from November 3, 2012, to January 15, 2013, ADKINS knowingly failed to update a registration pursuant to the Sex Offender Notification Act. Counts Two and Four alleges that ADKINS attempted to obstruct justice by attempting to influence a potential witness in an official proceeding. Count Three alleges that ADKINS made false declarations to the Court during a February 28, 2013, hearing. This case was investigated by the United States Marshals Service.ANDRE ABRAM, age 32, of Pittsburgh, Pennsylvania, was named in a one-count Indictment charging him with “Possession with Intent to Distribute Heroin within 1,000 Feet of the Clarksburg Housing Authority” on March 28,2013. The Indictment also seeks the forfeiture of $3,376 in United States currency seized on March 28, 2013. If convicted, ABRAM faces 1 to 40 years imprisonment and a $2,000,000 fine. This case was investigated by the Greater Harrison County Drug Task Force, consisting of officers from the Bridgeport Police Department; Clarksburg Police Department; Drug Enforcement Administration; West Virginia State Police-Bureau of Criminal Investigations, Bureau of Alcohol, Tobacco, Firearms and Explosives, the United States Postal Inspection Service; and, the United States Marshals Service.
These two cases will be prosecuted by Criminal Chief Shawn A. Morgan.
GARY RUDOLPH LOY, age 30, of Belington, West Virginia, was named in a three- count Indictment. Counts One and Three charge LOY with “Possession of Material Used in the Manufacture of Methamphetamine” on July 8 and August 28, 2012. Count Two charges LOY with “Manufacturing Methamphetamine” on August 28, 2012. If convicted, LOY faces up to 10 years imprisonment and a $250,000 fine as to Counts One and Three and 20 years imprisonment and a $1,000,000 fine as to Count Two. This case was investigated by the West Virginia State Police.
ALAN LEE STANLEY, age 33, of Buckhannon, West Virginia, was named in a seven- count Indictment. Count One charges STANLEY with “Possession of Materials Used in the Manufacture of Methamphetamine” on October 26, 2012. Counts Two through Six charge STANLEYwith “Possession of Pseudoephedrine to be Used in the Manufacture of Methamphetamine” on September 11, September 18, October 1, October 12 and October 25,
2012. Count Seven charges STANLEYwith“Attempted Possession of Pseudoephedrine to be Used in the Manufacture of Methamphetamine” on October 1, 2012. The indictment also seeks the forfeiture of items seized from STANLEY’s residence on October 26, 2012. If convicted, STANLEY faces up to 10 years imprisonment and a $250,000 fine as to Count One and 20 years imprisonment and a $250,000 as to Counts Two through Seven. This case was investigated by the Buckhannon Police Department.TONYA RENEE HAYMOND, age 28, of Romney, West Virginia, was named in a three-count Indictment. Counts One and Two charge HAYMOND with the “Distribution of Heroin” on June 5 and 6, 2012. Count Three charges HAYMOND with “Possession with Intent to Distribute Heroin” on June 6, 2012. If convicted HAYMOND faces up to 20 years imprisonment and a $1,000,000 fine as to each of the three counts. This case was investigated by the Hardy County Sheriff’s Department and the Moorefield Police Department.
DONALD MARK TILLOTSON, age 36, of Burling, West Virginia, was named in a nine-count Indictment. United States Attorney William J. Ihlenfeld, II, announced that:
DAVID BOGGS, age 29, entered a plea of guilty to “Possession of a Prohibited Object” on July 12, 2012, when the staff at FCI Gilmer found suboxone strips hidden inside an envelope of mail sent to inmate BOGGS. BOGGS was sentenced to 12 months imprisonment to be served consecutively with his current 155-month sentence. This case was investigated by the Special Investigative Services Staff at FCI Gilmer.
DWAYNE GILMORE, age 37, entered a plea of guilty to “Fraud and Related Activity in Connection with Access Device” between December 1 and 31, 2011, when defendant participated in a scheme to defraud multiple Sears stores of merchandise. GILMORE was sentenced to 15 months imprisonment to be served concurrently with his currently 85-month sentence and ordered to make restitution of $11,276.15 to Sears. This case was investigated by the United States Secret Service and the Special Investigative Services Staff at FCI Gilmer.

United States Attorney William J. Ihlenfeld, II, announced that PHILLIP JAMES HAMILTON, JR., was sentenced to 12 months and 1 day imprisonment to be followed by three years of supervised release. HAMILTON entered a plea of guilty on October 11, 2012, to Conspiracy to Distribute a Synthetic Drug known as “Bath Salts”. The substances in this case contained the chemicals Methylenedioxypyrovalerone (MDPV) and N-methyl-N- ethylcathione (4-MEC). HAMILTON and his co-defendant Steven Kloh, who was sentenced in October of 2012 to 24 months imprisonment, obtained the “bath salts” in Columbus, Ohio, from a convenience store and then returned to rural Tyler County, West Virginia, where they repackaged them and resold them.
“Bath Salts”, which is how they are referred to among users and dealers, are synthetic chemical compounds created to simulate other controlled substances such as methamphetamine and ecstasy, and mimic their psychological and hallucinogenic effects. The substances are addictive and are often sold at gas stations, convenience stores, and over the internet.
HAMILTON also forfeited $608 in United States currency seized on September 6,
2011, in Tyler County, West Virginia, which is property derived from proceeds obtained directly or indirectly from the drug activity.HAMILTON was remanded to the custody of the United States Marshal pending designation to a Federal institution.

REBECCA POWELL, age 50, of West Milford, West Virginia, was sentenced to 33 months imprisonment to be followed by six years of supervised release. POWELL entered a plea of guilty on December 4, 2012 to “Distribution of Crack Cocaine within 1,000 Feet of Glen Elk City Park” on March 22, 2012. POWELL, who is free on bond, will self-report to the designated Federal institution on May 9, 2013.

DAVIS forfeited her interest in $1,220 in U.S. currency, firearms, ammunition, cell phones, digital scales, thumb drive and a television which were seized from her residence and which constitute proceeds from the drug activity. DAVIS was remanded to state custody pending a revocation hearing in Marion County.

22 Arrested in Early Morning Sweep of Chester & Newell;
17 Suspects Still WantedNEW CUMBERLAND, WV - Thirty-nine individuals involved in the trafficking of heroin, cocaine, and methamphetamine and other drugs in Hancock County have been charged in federal and state court, according to U.S. Attorney William Ihlenfeld, II, Hancock County Prosecutor James Davis, and Hancock County Sheriff Ralph Fletcher.
An early morning arrest operation took place today during which 22 defendants were taken into custody. The sweep was spearheaded by the Hancock-Brooke-Weirton Drug Task Force and was supported by the Ohio Valley Drug Task Force of Wheeling, the Marshall County Drug Task Force, the Mountaineer Highway Interdiction Team, the Greater Harrison County (W.Va.) Drug Task Force, and the United States Marshals Service.
During the sweep additional quantities of illegal drugs were recovered and additional charges may be filed as a result of those discoveries.
The arrests dealt a major blow to the drug activity that has plagued the areas of Chester and Newell for the past year, and this investigation is one that Sheriff Fletcher has been focused upon since he took office in January. The leading to the charges became operational in September of 2012 and included extensive surveillance and many controlled purchases of narcotics.
“We’re fortunate to have such a talented and hard-working drug task force to serve the citizens of Hancock County,” said Sheriff Fletcher. “These men worked long hours to help to make the streets of Newell, Chester, and other communities in this county a safer place for everyone.”
“Hancock County struggles with the fact that our boundaries to the North, East and West are the Commonwealth of Pennsylvania and the State of Ohio,” said Prosecuting Attorney Jim Davis. “This makes the transport of controlled substantives relatively easy from Pittsburgh, Youngstown, Columbus, Cleveland, Detroit and even the New Jersey area. That’s why it takes a cooperative effort, such as the one that occurred in this investigation, to make a significant impact.”
“The Drug Enforcement Administration, working in partnership with the Hancock- Brooke-Weirton HIDTA Drug Task Force has brought a significant heroin and crack cocaine trafficking organization; operating in Newell and Chester, West Virginia to justice,” stated DEA Special Agent in Charge Karl C. Colder of the Washington Division Office. “This investigation demonstrates the continued commitment by DEA and the HIDTA Drug Task Force to impact drug trafficking organizations at their highest level.”
Nineteen of those involved were charged by a federal grand jury in Wheeling which returned three separate indictments with a total of ninety-four counts related to the distribution of heroin, methamphetamine, powder cocaine, crack cocaine, marijuana, oxycodone in the Hancock County area.
Of the thirty-nine individuals charged, six are from Chester, ten are from Newell, eight are from East Liverpool, Ohio, four are from New Cumberland; three are from Weirton; two are from New Brighton, Pennsylvania, one is from Aliquippa, Pennsylvania, one is from Georgetown, Pennsylvania, two are from Mckees Rocks, Pennsylvania, one is from Wellsburg, one is from Colliers and one is from Wellsville, Ohio.

The following individuals were indicted by the Wheeling federal grand jury earlier this week:
MICHAEL OGDEN ALLEN, 22 years old of Chester, West Virginia, was charged with seven felony counts related to the distribution of heroin and methamphetamine in Hancock County.
EDWARD LEON CROW, JR., of Newell, West Virginia, was charged with eight felony counts related to the distribution of heroin, cocaine, cocaine base, oxycodone and marijuana in Hancock County.
BRIAN CUSTER, 30 years old of Newell, West Virginia, was charged with ten felony counts related to the distribution of heroin, cocaine, cocaine base, oxycodone and marijuana in Hancock County.
SHAWN LEE DANVER a/k/a “SHAWN D,” 29 years old of East Liverpool, Ohio, was charged with two felony counts related to the distribution of cocaine base in Hancock County.
BRANDON DUNN, 28 years old of Chester, West Virginia, was charged with nineteen felony counts related to the distribution of heroin, cocaine, cocaine base, oxycodone and marijuana in Hancock County.
JUSTIN GRAHAM, 30 years old of Newell, West Virginia, was charged with eight felony counts related to the distribution of heroin, cocaine, cocaine base, oxycodone and marijuana in Hancock County.
KAREN GRAHAM, 41 years old of Newell, West Virginia, was charged with three felony counts related to the distribution of heroin, cocaine, cocaine base, oxycodone and marijuana in Hancock County.
ANTONIO SCOTT FRAZIER a/k/a “ANTONIO SCOTT HARLIN” a/k/a “KOBE, 27 years old, was charged with six felony counts related to the distribution of cocaine base in Hancock County.
BRANDI LOU HISSOM, 37 years old of East Liverpool, Ohio, was charged with nine felony counts related to the distribution of cocaine base in Hancock County.
BRITTANY LUCINDA HISSOM, 18 years old of East Liverpool, Ohio, was charged with eight felony counts related to the distribution of cocaine base in Hancock County.
ANTONYO W. JOHNSON, 26 years old of East Liverpool, Ohio, was charged with eight felony counts related to the distribution of cocaine base in Hancock County.
NIKKI J. KOFFEL, 24 years old of East Liverpool, Ohio, was charged with five felony counts related to the distribution of cocaine base in Hancock County.

WHEELING, WEST VIRGINIA - A 24 year old Bellaire, Ohio, resident was sentenced on April 4, 2013, in United States District Court in Wheeling by Chief Judge John Preston Bailey.
United States Attorney William J. Ihlenfeld, II, announced that: CHAZ WILLIAM ERAZMUS, 24 years old of Bellaire, Ohio, was sentenced to 33 months imprisonment to be followed by three years of supervised release. ERAZMUS entered a plea of guilty on November 2, 2012, to “Conspiracy to Distribute Heroin” from April to June of 2012 in Wheeling. ERAZMUS, who is free on bond, will self-report to the designated Federal institution.

WHEELING, WEST VIRGINIA — A 32 year old Marianna, Pennsylvania, resident was sentenced on April 4, 2013, in United States District Court by Chief Judge John Preston Bailey.
United States Attorney William J. Ihlenfeld, II, announced that: JESSICA CRAWFORD was sentenced to 51 months imprisonment to be followed by five years of supervised release and ordered to make restitution in the amount of $31,846. CRAWFORD entered a plea of guilty on November
30, 2012, to “Bank Robbery” for her involvement in the robbery on December 3, 2010, of the
United Bank on Three Springs Drive in Weirton, West Virginia.CRAWFORD was charged for her involvement in this and 5 other bank robberies with her then boyfriend, Rudolph Todd Haladyna, formerly of Clarksville, Pennsylvania. Haladyna has already been sentenced to 20 years imprisonment for his involvement in these robberies. CRAWFORD was the get-a-way driver in most of the robberies, which included two robberies of the Charleroi Federal Savings Bank in Bentleyville, Pennsylvania, in September, 2010, two robberies of PNC Bank in Redstone Twp., Fayette County, Pennsylvania, in October 2010 and a robbery of Huntington Bank, Cheat Lake Branch, in Morgantown, West Virginia, in November 2010.
CRAWFORD was remanded to the custody of the United States Marshal pending designation to a Federal institution.

WHEELING, WEST VIRGINIA - A 25-year old Wheeling, West Virginia, resident entered a plea of guilty on March 25, 2013, in United States District Court in Wheeling before Judge Frederick P. Stamp, Jr.
United States Attorney William J. Ihlenfeld, II, announced that: JEFFREY JOSEPH OLIVER entered a plea of guilty to“Possession of Child Pornography” on June 12, 2012, in Wheeling. As part of his plea, OLIVER will forfeit the computer and all storage devices, including approximately 181 CDs and DVDs, a cell phone and a Playstation and memory card which were seized on June 12, 2012. OLIVER, who is free on bond, faces a maximum exposure of 10 years imprisonment and a fine of $250,000. This case was prosecuted by by Assistant United States Attorney Robert H. McWilliams, Jr. and was investigated by the West Virginia State Police-Bureau of Criminal Investigations and the Federal Bureau of Investigation.

RONALD JOHN LOUK, age 30, of Churchsville, Virginia, entered a plea of guilty to
“Failure to Update Sex Offender Registration.” During the period October 20 to November
21, 2012, LOUK, a person required to register under the Sex Offender Notification Act and who traveled in interstate commerce, did knowingly fail to update his registration. LOUK, who is in custody pending sentencing, faces up to 10 years imprisonment and a $250,000 fine. This case was prosecuted by Criminal Chief Shawn A. Morgan and was investigated by the United States Marshals Service and the West Virginia State Police.VELAIR VON COLLINS, II, age 42, of Elkins, West Virginia, entered a plea of guilty to the charge of “Felon in Possession of a Firearm.” COLLINS, having previously been convicted in the Circuit Court of Randolph County, West Virginia, of the felony offense of Driving Under the Influence-Third Offense, knowingly possessed a Harrington & Richardson shotgun and a Marlin rifle on September 4, 2012, in Elkins. COLLINS, who is on bond pending sentencing, faces up to 10 years imprisonment and a $250,000 fine. This case was prosecuted by Assistant United States Attorney Stephen D. Warner and was investigated by the Elkins Police Department and the West Virginia State Police.
JANEL PHILLIPS, age 44, of Belington, West Virginia, entered a plea of guilty to “Federal Program Fraud.” From January of 2007 to May of 2010, PHILLIPS, while working as a ombudsman for Legal Aid of West Virginia, submitted false mileage claims and time sheets to fraudulently obtain over $90,000 from the federally funded Long-Term Care Ombudsman Fund. PHILLIPS, who is free on bond pending sentencing, faces a maximum exposure of 10 years imprisonment and a fine of $250,000. This case was prosecuted by Assistant United States Attorney Andrew R. Cogar and investigated by the Department of Health and Human Services and the Legal Services Corporation-Office of Inspector General.

GLENN ALBERT STEWART, JR., of Follansbee, West Virginia, was sentenced to 40 months imprisonment for testing positive for the use of marijuana; failure to timely notify probation officer of citation received following a car accident; possession of drug paraphernalia; possession of edged weapon; a conviction in Hancock County for three counts of House Burglary; and, a conviction in Ohio County for Burglary. STEWART was originally sentenced on May 28, 1998, to 180 months imprisonment and 5 years of supervised release for possession of a firearm by a convicted felon. STEWART was remanded to the custody of the United States Marshal pending designation to a Federal institution.
JEFFREY A. LUCAS, age 44, of Moundsville, West Virginia, was sentenced to 24 months imprisonment for convictions in Brooke County on two counts of shoplifting and one count of conspiracy to commit shoplifting. LUCAS was originally sentenced on May 1, 2009, to 39 months imprisonment and three years of supervised release for conspiracy to distribute oxycodone. LUCAS was remanded to the custody of the United States Marshal pending designation to a Federal institution.
CHARLES WILLIS, age 37, of Clarksburg, West Virginia, was sentenced to 14 months imprisonment for use and possession of drugs; traveling outside the district without permission of his probation officer and fleeing the scene of an accident. WILLIS was originally sentenced on May 5, 2008, to 51 months imprisonment and 3 years of supervised release for distribution of cocaine hydrochloride. On February 22, 2012, WILLIS’ supervised release was revoked and he was sentenced to 10 months imprisonment and 26 months of supervised release. WILLIS was remanded to the custody of the United States Marshal pending designation to a Federal institution.
LYNNEIL LAWRENCE WILLIAMS, age 30, of Penn Hills, Pennsylvania, was sentenced to 12 months and 1 day imprisonment for possession and use of controlled substances; failure to report law enforcement contact to his probation officer; and, a conviction in the Western District of Pennsylvania for conspiracy to distribute heroin. WILLIAMS was originally sentenced on March 10, 2003, to 23 months imprisonment and 3 years of supervised release for interstate travel in aid of racketeering, distribution of heroin and false declaration before the court. WILLIAMS was remanded to the custody of the United States Marshal pending designation to a Federal institution.
WAYNE CASTO, age 43, of Weirton, West Virginia, was sentenced to 30 days imprisonment for two separate convictions in Hancock County for failure to register as a sex offender. CASTO was originally sentenced to 37 months imprisonment and 10 years of supervised release for possession of child pornography. CASTO, who is free on bond, will self- report to the designated federal institution.

MICHAEL IRVIN GIBBONS, age 41, of Lumberport, West Virginia, was sentenced to 24 months imprisonment for convictions in state court for the possession with intent to distribute marijuana and conspiracy to distribute marijuana; leaving the judicial district without permission of the Court or the probation office; submitting incomplete monthly report forms; failure to notify probation office of his contact with local law enforcement; and, failure to appear for random drug testing. GIBBONS was originally sentenced on March 1, 2005, to
64 months and 3 days imprisonment and 3 years of supervised release for the distribution of crack cocaine. In June of 2009, GIBBONS sentence was reduced to time served pursuant to the crack re-sentencing guidelines. GIBBONS was remanded to the custody of the United States Marshal pending designation to a Federal institution.MICHAEL BRIAN MATHENA, age 27 of Clarksburg, West Virginia, was sentenced to 14 months imprisonment for illegal use of controlled substances; failure to report for treatment and testing; failure to follow probation officer’s instructions; and, various state charges. MATHENA was originally sentenced on February 6, 2009, to 36 months imprisonment and 6 years of supervised release for the distribution of cocaine base within
1,000 feet of a protected location. On September 28, 2011, MATHENA’s supervised release was revoked for possession of hydrocodone and testing positive for the use of morphine and codeine. MATHENA was remanded to the custody of the United States Marshal pending designation to a Federal institution.FRANK JACKSON, age 50, of Fairmont, West Virginia, was sentenced to 12 months imprisonment for the unlawful use and possession of cocaine on three separate occasions. JACKSON was originally sentenced on May 28, 2009, to 51 months imprisonment and 3 years of supervised release for the distribution on of cocaine base. On July 24, 2012, JACKSON’s supervised release was revoked after testing positive for the use of cocaine and he was sentenced to 6 months imprisonment and 30 months of supervised release. JACKSON was remanded to the custody of the United States Marshal pending designation to a Federal institution.
RICHARD LEWIS COLEMAN, age 32, of Morgantown, West Virginia, was sentenced to 9 months imprisonment for possession and use of a controlled substance; failure to appear for drug testing; failure to follow probation officer’s instructions; failure to truthfully answer inquiries of probation officer; failure to notify probation officer of change in employment; failure to submit truthful and complete written monthly report; and, failure to report to the probation officer as instructed. COLEMAN was originally sentenced on June 22, 2004, to 77 months imprisonment and 3 years of supervised release for possession of a firearm by a convicted felon. COLEMAN was remanded to the custody of the United States Marshal pending designation to a Federal institution.
WARREN KIP HALL, age 44, of Clarksburg, West Virginia, was sentenced to 4 months imprisonment to be followed by two years of supervised release for testing positive for the use of suboxone; failing to appear for a drug screen; and, failing to attend substance abuse counseling. HALL was originally sentenced on November 8, 2007, to 30 months imprisonment and six years of supervised release for the distribution of cocaine base within 1,000 feet of a housing facility. HALL was remanded to the custody of the United States Marshal pending designation to a Federal institution.
TIMOTHY PAUL ROACH, age 46, of Rivesville, West Virginia, was sentenced to 30 days imprisonment for testing positive for the use of marijuana and a charge of disorder conduct by the Fairmont Police Department. ROACH was originally sentenced on June 28,
2005, to 51 months imprisonment and 3 years of supervised release for being a convicted felon in possession of a firearm. MARTINSBURG DIVISION REVOCATIONS (Judge Gina M. Groh)
ANTONIO DWAYNE HENDRICKS, age 33, of Martinsburg, West Virginia, was sentenced to 14 months imprisonment to be followed by 38 months of supervised release for failure to report for drug testing; associating with a person engaged in criminal activity; positive drug test for the use of cocaine and marijuana; frequenting places where illegal substances were being used; failure to be truthful with the probation officer; failure to comply with treatment schedule as directed; possession of marijuana and cocaine; excessive use of alcohol; and, submitting an untruthful monthly report form to the probation office. HENDRICKS was originally sentenced on September 23, 2005, to 120 months imprisonment and 5 years of supervised release. On September 25, 2007, HENRICKS’ sentence was reduced to 50 months imprisonment and 5 years of supervised release. On July 12, 2011, HENRICKS’ supervised release was revoked and he was sentenced to 8 months imprisonment and 52 months of supervised release. HENDRICKS was remanded to the custody of the United States Marshal pending designation to a Federal institution.HAROLD JACKSON-JONES a/k/a TERRELL SMITH, age 38, of Winchester, Virginia, was sentenced to 12 months imprisonment to be followed by 24 months of supervised release for simple assault; assault on law enforcement officer; and, resisting arrest. JACKSON-JONES was originally sentenced on June 16, 2006, to 64 months imprisonment and
3 years of supervised release for possession of a firearm by a convicted felon. JACKSON- JONES was remanded to the custody of the United States Marshal pending designation to a Federal institution.GENE FUHRMAN, age 36, of Clear Springs, Maryland, was sentenced to 12 months imprisonment to be followed by 24 months of supervised release for failure to make monthly restitution payments; failure to report to the probation office; failure to report police contact; failure to notify probation office of an address change; brandishing a deadly weapon; and, retaliation against a witness. FUHRMAN was originally sentenced on April 7, 2009, to 21 months imprisonment and 3 years of supervised release for manufacturing methamphetamine. FUHRMAN was remanded to the custody of the United States Marshal pending designation to a Federal institution.
GABRIEL CHRISTOPHER MCGUIRE a/k/a ZIGGY, age 26, of Martinsburg, West Virginia, was sentenced to 12 months imprisonment to be followed by 24 months of supervised release for failure to notify probation office of change of address; being in a residence where suspected heroin was being used; testing positive for the use of drugs; and, being untruthful with probation office on monthly reports. MCGUIRE was originally sentenced on December
10, 2009, to 70 months imprisonment and 3 years of supervised release for the distribution of heroin. On November 1, 2011, MCGUIRE’s sentence was reduced to 37 months imprisonment and 3 years of supervised release pursuant to the crack re-sentencing guidelines. MCGUIRE was remanded to the custody of the United States Marshal pending designation to a Federal institution.DEVONNIE JOSEPH COOPER, age 24, of Charles Town, West Virginia, was sentenced to 5 months imprisonment to be followed by 48 months of supervised release for use of marijuana and cocaine and attempts to alter/fake urine samples. COOPER was originally sentenced on January 29, 2008, to 60 months imprisonment and 48 months of supervised release for possession with intent to distribute cocaine base. COOPER was remanded to the custody of the United States Marshal pending designation to a Federal institution.
JUDY RAE SMITH, age 49, of Martinsburg, West Virginia, was sentenced to 4 months imprisonment to be followed by 18 months of supervised release for testing positive for the use of marijuana and oxycodone. SMITH was originally sentenced on July 15, 2009, to 30 months imprisonment and 3 years of supervised release for the distribution of cocaine base. SMITH, who is free on bond, will self-report to the designated federal institution.
WILLIAM TRAVIS TOLSON, age 31, of Martinsburg, West Virginia, was sentenced to 3 months imprisonment to be followed by 33 months of supervised release for failure to report to the probation office as directed and failure to follow instructions of the probation office. TOLSON was originally sentenced to 20 months imprisonment and 36 months of supervised release for retaliation against a witness. TOLSON was remanded to the custody of the United States Marshal pending designation to a Federal institution.

United States Attorney William J. Ihlenfeld, II, announced the following indictments: CHRISTOPHER WAYNE WILLIAMS, age 39, of Mill Creek, West Virginia, was
named in a two-count Indictment charging him with one count of “Felon in Possession of a Firearm” and one count of “Possession of Stolen Firearms.” If convicted, WILLIAMS faces up to 10 years imprisonment and a $250,000 fine on each count. This case will be prosecuted by Criminal Chief Shawn A. Morgan and was investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives.JASON S. SWISHER, age 30 and JENNIFER N. HILEMAN, age 29, of Bunker Hill, West Virginia, were named in a four-count Indictment. Count One charges SWISHER and HILEMAN with “Conspiracy to Distribute Heroin;” Count Two charges HILEMAN with “Distribution of Heroin;” Count Three charges SWISHER with “Distribution of Heroin;” and, Count Four charges HILEMAN with “Possession with Intent to Distribute Heroin.” If convicted, SWISHER and HILEMAN face up to 20 years imprisonment and a $1,000,000 fine on each count. This case was investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives, and will be prosecuted by Assistant United States Attorney Robert H. McWilliams, Jr.
FRANK K. BRINKMEYER, age 43; PATRICIA M. BRINKMEYER, age 66; CHARLOTTE M. JENKINS, age 38; and, MICHAEL B. SMITH, age 38, of Berkeley County, West Virginia, were named in a nine-count Indictment. FRANK BRINKMEYER is charged in Counts One, Three, Four, Five and Six with “Distribution of Heroin;” in Count Seven with “Possession with Intent to Distribute Heroin;” and, in Count Nine with “Conspiracy to Distribute Heroin and Oxycodone.” PATRICIA BRINKMEYER is charged in Count Two with “Distribution of Oxycodone;” in Counts Three and Four with “Distribution of Heroin;” and, in Count Nine with “Conspiracy to Distribute Heroin and Oxycodone.” JENKINS is charged in Count Two with “Distribution of Oxycodone,” in Counts Three, Four and Eight with “Distribution of Heroin;” and, in Count Nine with “Conspiracy to Distribute Heroin and Oxycodone.” SMITH is charged in Count Eight with “Distribution of Heroin” and, in Count Nine with “Conspiracy to Distribute Heroin and Oxycodone.” If convicted, each of the Defendants faces up to 20 years imprisonment and a $1,000,000 fine on each count. United States Attorney William J. Ihlenfeld, II, announced that JAMES W. RICHARD was sentenced to 25 months in federal prison to be followed by two years of supervised release as a result of his conviction for “Mailing Threatening Communications.” RICHARD admitted to sending letters from the Northern Regional Jail containing threats to harm a Wellsburg police officer as well as a Brooke County sheriff’s deputy. The officers he threatened were involved in the investigation of RICHARD for “Breaking and Entering”, “Domestic Assault”, and “Brandishing a Deadly Weapon.” RICHARD was later convicted of those charges and was serving time for those offenses when he mailed the letters.
“Whenever a law enforcement officer is threatened with bodily harm my office is going to do everything it can to make sure that those responsible for making the threats are held accountable,” said U.S. Attorney Ihlenfeld. “We must protect our police officers so that they can protect the communities that they bravely serve each day.”
RICHARD, who was sentenced to prison by Judge Frederick P. Stamp, Jr., was remanded to the custody of the United States Marshal pending designation to a Federal institution.
The case was prosecuted by Assistant United States Attorney Stephen L. Vogrin and was investigated by the United States Postal Inspection Service.

MASON entered a plea of guilty on October 24, 2012, to “Possession and Transfer of Stolen Firearms” on May 26, 2011, when MASON pawned two firearms and sold a firearm, all of which had been stolen. MASON was remanded to the custody of the United States Marshal pending designation to a Federal institution.
This was prosecuted by Assistant United States Attorney Robert H. McWilliams and investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives and the Jefferson County Sheriff’s Department.
JUAN MARRON-CERDA, age 32, was sentenced to 4 months and 9 days imprisonment. MARRON-CERDA entered a plea of guilty on February 15, 2013, to “Unlawful Reentry into the United States” without Consent from the Department of Homeland Security after having previously been deported. MARRON-CERDA was remanded to the custody of the United States Marshal pending deportation.

The trial lasted two days, concluding late afternoon Wednesday. Judge Gina M. Groh presided over the trial.
United States Attorney William J. Ihlenfeld, II, announced that: CHARLES PAGE HAINES, III was convicted on one count of “Conspiracy to Distribute Cocaine Base” from June 5 to June 28, 2012; four counts of “Distribution of Cocaine Base” on June 5, June 6 and twice on June 7, 2012; and one count of “Maintaining a Drug-Involved Premise” from June
5 to June 28, 2012, all in Keyser, Mineral County, West Virginia.Trial evidence indicated that HAINES was involved with co-defendants Loren Constantine Brown and Crystal Starr Metz in a conspiracy to distribute cocaine base and provided his residence as a place from which the crack was distributed.
HAINES, who is in custody pending sentencing, faces up to 20 years imprisonment and a $1,000,000 fine on each of the conspiracy and distribution counts and up to 20 years imprisonment and $500,000 fine on the maintaining a drug-involved premise count.

COOK then transported the stolen wire to Canonsburg, Pennsylvania, where he sold it to a scrap metal dealer. COOK, who is free on bond pending sentencing, faces up to 10 years imprisonment and a $250,000 fine.

2013, has been scientifically identified as that of Skylar Neese. Neese is the Star City, West Virginia, teenager who was reported missing by her parents in July of 2012. The testing of the body was conducted by the laboratory of the Federal Bureau of Investigation.The investigation into the disappearance of Neese and her subsequent death is ongoing.

TORRES, who is in custody pending sentencing, faces up to 10 years imprisonment and a $250,000 fine.
