Powell Man Indicted on 234 Counts of Health Care FraudRead the Press Release
CHEYENNE, Wy. – A federal grand jury returned an indictment on May 19th charging Powell psychologist Gibson Condie with 234 counts of health care fraud involving approximately $6.8 million in fraudulent bills submitted to Wyoming Medicaid, announced the U.S. Attorney’s Office for the District of Wyoming and the Federal Bureau of Investigation. This indictment was the result of an investigation by the FBI, the United States Department of Health and Human Services’ Office of Inspector General, and the Wyoming Medicaid Fraud Control Unit.
According to the indictment, Condie submitted bills for mental health services to Wyoming Medicaid through his business Big Horn Basin Mental Health Group, Inc. These bills routinely reported an inappropriate and baseless mental health diagnosis and falsely identified Condie as the treating provider even though the claimed mental health services had been provided by various other individuals, many of whom were not licensed or otherwise authorized by Medicaid to provide the claimed services. The indictment further alleges that Condie fraudulently overbilled Medicaid for clinical assessments, billed for services that were not provided, and billed for services that Medicaid did not cover. In total, Condie allegedly submitted fraudulent claims for approximately $6,848,808 between June 2012 and February 2016.
An indictment is not a finding of guilt. Individuals charged in indictments are presumed innocent until proven guilty beyond a reasonable doubt.
If convicted, Condie faces a statutory maximum sentence of 10 years on each count of health care fraud.If convicted on more than one count, the sentences could be imposed consecutively.

He received 120 months of imprisonment, to be followed by five years of supervised release, and was ordered to pay a $100.00 special assessment and $2,400.00 in restitution. Carl Vannatter, 30, of Bismarck, North Dakota, was sentenced by Federal District Court Judge Alan B. Lee received 57 months of imprisonment, to be followed by five years of supervised release, and was ordered to pay a $100.00 special assessment and $500.00 in restitution. Wind River Indian Reservation Resident Sentenced to 108 YearsRead the Press Release
LANDER – Acting United States Attorney John R. Green, Federal Bureau of Investigation Special Agent in Charge Calvin Shivers, and Bureau of Indian Affairs Special Agent in Charge Doug Noseep announced that on March 28, 2017 Winder River Indian Reservation Resident Marvin "Muff" Magnan, age 63, of Lander, Wyoming was sentenced to 108 years in a federal penitentiary. A jury found Magnan unanimously guilty on 12 counts of sexual assault on September 22, 2016. The guilty verdicts were the result of a 4 day trial before U.S. District Court Judge Scott W. Skavdahl. The jury deliberated for less than one day before reaching their verdict. Magnan, who was indicted by a federal grand jury in Casper, Wyoming on May 18, 2016, was detained after his arrest and through trial. He was sentenced by Judge Skavdahl on March 28, 2017.
According to the indictment and evidence presented at trial, Magnan sexually assaulted six child victims, all but one victim related to Magnan. Each victim testified at trial and each described multiple, repeated incidents where Magnan unlawfully touched them in a sexual manner. Many of these incidents happened while the minor children were entrusted to Magnan’s care and while Magnan was allegedly teaching horsemanship to his victims. Other incidents occurred at his house or other properties on the Wind River Indian Reservation. One incident against a victim occurred in Salt Lake City, Utah. This case was successfully prosecuted and justice given to the victims because of their perseverance under tough circumstances and the lengthy, complex investigation conducted FBI Agent Paul Swenson.
"Magnan’s sentence illustrates the FBI’s commitment to protect our most vulnerable citizens, our children," said FBI Denver Special Agent in Charge Calvin Shivers. "The FBI will continue to work diligently with our law enforcement partners and the United States Attorney’s Office to rigorously investigate and prosecute cases involving the sexual victimization of children."

Marvin Wayne Magnan, 63, of Ethete, Wyoming, was sentenced by Federal District Court Judge Scott W. Skavdahl on March 28, 2017, on two counts of aggravated sexual abuse; six counts of abusive sexual contact; two counts of sexual abuse of a minor; one count of sexual abuse; and one count of simple assault. Magnan was arrested in Ethete, Wyoming. He received 108 years of imprisonment, to be followed by a life-term of supervised release, and was ordered to pay a special assessment of $1,125.00. This case was investigated by the Federal Bureau of Investigation.
Daniel Lee Evans, 35, of Casper, Wyoming, was sentenced by Federal District Court Judge Scott W. Skavdahl on March 27, 2017, for possession with intent to distribute methamphetamine. Evans was arrested in Casper, Wyoming. He received 120 months of imprisonment, to be followed by five years of supervised release, and was ordered to pay a $100.00 special assessment and $400.00 in restitution. This case was investigated by the Wyoming Division of Criminal Investigation.
Lance Sterling Addison, 36, of Arapahoe, Wyoming, was sentenced by Federal District Court Judge Scott W. Skavdahl on March 27, 2017, for failure to register as a sex offender. Addison was arrested in Riverton, Wyoming. He received 24 months of imprisonment, to be followed by five years of supervised release, and was ordered to pay a $100.00 special assessment. This case was investigated by the U.S. Marshals Service.
Mitchell Wayne Mosqueda, 24, of Riverton, Wyoming, was sentenced by Federal District Court Judge Scott W. Skavdahl on March 27, 2017, for assault with a dangerous weapon with intent to do bodily harm. Mosqueda was arrested in Riverton, Wyoming. He received 15 months of imprisonment, to be followed by three years of supervised release, and was ordered to pay a $100.00 special assessment and $5,298.12 in restitution. Gerald Paul Headley, Jr., a/k/a Percy Headley, 43, of Fort Washakie, Wyoming, was sentenced by Federal District Court Judge Scott W. Skavdahl on March 27, 2017, on two counts of abusive sexual contact. Headley was arrested in Lander, Wyoming. He received 180 months of imprisonment, to be followed by a life-term of supervised release, and was ordered to pay a $200.00 special assessment and $1,194.80 in restitution. Jonathan Marino Guerrero-Santana, 25, of Snellville, Georgia, was sentenced by Chief Federal District Court Judge Nancy D. Freudenthal on March 27, 2017, for use of unauthorized access devices to obtain $1,000 or more and aiding and abetting. Guerrero-Santana was arrested in Laramie, Wyoming. He received four years of probation and was ordered to pay a $100.00 special assessment and a $900.00 fine. Leif Bjorn Jourgensen, 31, of Mancos, Colorado, was sentenced by Federal District Court Judge Alan B. Johnson on March 9, 2017, for travel with intent to engage in illicit sexual conduct. Harold Giberson, 63, of Rock Springs, Wyoming, was sentenced by Chief Federal District Court Judge Nancy D. Freudenthal on February 7, 2017, for theft of labor union funds. Giberson was the long time president of the Utility Workers Union of America Local 127. From 2011 through January 2015, he embezzled over $150,000 from the local union by using the union’s credit card for personal expenses and by claiming unauthorized travel reimbursements. Local union trustees discovered the embezzlement and Giberson resigned from the union in February 2015. Giberson, who is in poor health and appeared in court on oxygen, received five years of probation with the first six months in home confinement. Giberson was also ordered to pay a $100.00 special assessment and $158,953.28 in restitution. Giberson is also prohibited by federal law from serving as a union official for 13 years. This case was investigated by the U.S. Department of Labor, Office of Labor-Management Standards.
Justin Jamar Smith, 27, of Cheyenne, Wyoming, was sentenced by Federal District Court Judge Alan B. Johnson on February 7, 2017, for interference with commerce by robbery. Smith was arrested in Cheyenne, Wyoming. He received 70 months of imprisonment, to be followed by three years of supervised release, and was ordered to pay a $100.00 special assessment, a $300.00 fine and $844.00 in restitution. Wyoming U.S. Attorney's Office Collects $1,802,203 in Civil and Criminal Actions for U.S. Taxpayers in Fiscal Year 2016Read the Press Release
Cheyenne – U.S. Attorney Christopher A. "Kip" Crofts announced today that the District of Wyoming US Attorney’s Office collected $1,802,203 in criminal and civil actions in Fiscal Year 2016. Of this amount, $1,468,146 was collected in criminal actions and $334,057 was collected in civil actions.
Additionally, the District of Wyoming worked with other U.S. Attorney’s Offices and components of the Department of Justice to collect $89,056 in cases pursued jointly with these offices.
Attorney General Loretta Lynch announced on December 14th that the Justice Department collected $15.3 billion in civil and criminal actions in the fiscal year ending Sept. 30, 2016.
The more than $15 billion in collections in FY 2016 represents nearly five times the appropriated $3 billion budget for the 94 U.S. Attorney’s offices and the main litigating divisions in that same period.
"Every day, the men and women of the Department of Justice work tirelessly to enforce our laws, ensuring that taxpayer dollars are used properly and that the American people are protected from exploitation and abuse," said Attorney General Lynch. "Today’s announcement is a testament to that work, and it makes clear that our actions deliver a significant return on public investment. The U.S. Attorneys’ Offices, along with the department’s litigating divisions, are responsible for enforcing and collecting civil and criminal debts owed to the U.S. and criminal debts owed to federal crime victims. The law requires defendants to pay restitution to victims of certain federal crimes who have suffered a physical injury or financial loss. While restitution is paid to the victim, criminal fines and felony assessments are paid to the department’s Crime Victims’ Fund, which distributes the funds to state victim compensation and victim assistance programs.
The largest civil collections were from affirmative civil enforcement cases, in which the United States recovered government money lost to fraud or other misconduct or collected fines imposed on individuals and/or corporations for violations of federal financial, health, safety, civil rights and environmental laws. In addition, civil debts were collected on behalf of several federal agencies, including the U.S. Department of Housing and Urban Development, Health and Human Services, Internal Revenue Service, Small Business Administration and Department of Education.
The total includes all monies collected as a result of Justice Department-led enforcement actions and negotiated civil settlements. It includes more than $12 billion in payments made directly to the Justice Department and more than $3.3 billion in indirect payments made to other federal agencies, states and other designated recipients.

United States Settles Civil Forfeiture ActionRead the Press Release
U.S. Attorney Christopher "Kip" Crofts announced today that Scott Lewis of Englewood, Colorado, has agreed to forfeit $234,717 to the United States to settle a civil forfeiture action where the United States alleged that the money was drug money earned from the illegal sale of drugs or intended to illegally purchase drugs. As part of the settlement, Lewis did not dispute that the United States had reasonable cause to seize the money. The United States agreed to return $25,000 to Lewis. On November 28, 2016, United States District Court Judge Alan Johnson issued a judgement of forfeiture based on the settlement agreement.
The money and a Cessna airplane were seized from Lewis and Gilbert Wiles, Jr., in Cody, Wyoming, on February 28, 2014, following an investigation of suspected drug trafficking by the Cody Police Department with assistance from the Powell Police Department and the Wyoming Division of Criminal Investigation. The seizures were made under authority of search warrants issued by a Wyoming state court judge.
Following additional investigation by the U.S. Department of Homeland Security and the Drug Enforcement Administration, the United States filed a civil forfeiture complaint on August 1, 2014. The complaint alleged that Wiles and Lewis had purchased the airplane in May 2013 for $130,000 in cash. On February 27, 2014, Lewis and Wiles landed the plane at Yellowstone Regional Airport. After landing, Lewis and Wiles covered the plane’s windows to conceal its interior, paid for fuel and other services with cash, and used a phony name at the airport and to check-in at a local Holiday Inn. As part of the police investigation, a drug detection canine alerted to the odor of controlled substances emanating from the plane. During the later search of the hotel room, police found a blue duffel bag containing $258,520 packaged in 12 vacuum-sealed bags. Officers also found $1,467 in cash in a jacket lying on a dresser. In addition to the money, officers found a number of fake driver’s licenses bearing Lewis’s picture. A review of Lewis’s criminal history showed that he had been convicted of a misdemeanor drug violation in November 2010 in California after Lewis was arrested outside a residence containing 185 pounds of marijuana and over $250,000 in cash. Lewis, who was represented by an attorney from California, responded to the civil forfeiture complaint by filing claims to the plane and money.
The federal investigation also revealed that the airplane had not been registered with the Federal Aviation Administration as required by law following its purchase by Wiles and Lewis in 2013. In a separate criminal prosecution, on January 14, 2016, the grand jury for the District of Wyoming indicted Lewis and Wiles for conspiracy and operating an unregistered aircraft in violation of federal law. Lewis and Wiles pled guilty to the felony crime of operating an unregistered aircraft and were sentenced to probation in June, 2016. As part of these sentences, the district court forfeited the Cessna airplane to the United States. The airplane was then dismissed from the civil forfeiture action.
The settlement agreement which resulted in the forfeiture of $234,717 in drug money ended the civil forfeiture.

Antonio Garcia-Bautista, 36, of Mexico, was sentenced by Federal District Court Judge Alan B. Johnson on November 30, 2016, for illegal re-entry of a previously deported alien into the United States. U.S. Attorney Christopher A. Crofts announced today that former Cheyenne resident Scott Leslie Glover has been convicted in federal court. A jury found Glover guilty of conspiracy to distribute methamphetamine after a three-day jury trial in the United States District Court in Cheyenne. Glover is scheduled to be sentenced on January 31, 2017.

United States Attorney Christopher A. Crofts announced today that Assistant United States Attorney (AUSA) Stephanie I. Sprecher will lead the efforts of his Office in connection with the Justice Department’s nationwide Election Day Program for the upcoming November 8, 2016, general elections. AUSA Sprecher has been appointed to serve as the District Election Officer (DEO) for the District of Wyoming and in that capacity is responsible for overseeing the District’s handling of complaints of election fraud and voting rights abuses in consultation with Justice Department Headquarters in Washington.
United States Attorney Crofts said, "Every citizen must be able to vote without interference or discrimination and to have that vote counted without it being stolen because of fraud. The Department of Justice will act promptly and aggressively to protect the integrity of the election process."
The Department of Justice has an important role in deterring election fraud and discrimination at the polls, and combating these violations whenever and wherever they occur. The Department’s long-standing Election Day Program furthers these goals, and also seeks to ensure public confidence in the integrity of the election process by providing local points of contact within the Department for the public to report possible election fraud and voting rights violations while the polls are open on election day.
Federal law protects against such crimes as intimidating or bribing voters, buying and selling votes, impersonating voters, altering vote tallies, stuffing ballot boxes, and marking ballots for voters against their wishes or without their input. It also contains special protections for the rights of voters and provides that they can vote free from acts that intimidate or harass them. For example, actions of persons designed to interrupt or intimidate voters at polling places by questioning or challenging them, or by photographing or videotaping them, under the pretext that these are actions to uncover illegal voting may violate federal voting rights law. Further, federal law protects the right of voters to mark their own ballot or to be assisted by a person of their choice.
The franchise is the cornerstone of American democracy. We all must ensure that those who are entitled to the franchise exercise it if they choose, and that those who seek to corrupt it are brought to justice. In order to respond to complaints of election fraud or voting rights abuses on November 8, 2016, and to ensure that such complaints are directed to the appropriate authorities, United States Attorney Crofts stated that AUSA/DEO Sprecher will be on duty in this District while the polls are open. Jaime Nieto, 53, of Rock Springs, Wyoming, was sentenced by Chief Federal District Court Judge Nancy D. Freudenthal on September 7, 2016, for tax evasion and misuse of a social security number. He received 21 months imprisonment, to be followed by three years of supervised release, and was ordered to pay a $200.00 special assessment and $143,243.73 in restitution for unpaid taxes and interest.
In June, a jury convicted Mr. Nieto. The evidence at trial showed that the Mr. Nieto filed income tax returns for tax years 2007-2011 which reported taxes due. Mr. Nieto made some tax payments but never paid all of his income taxes for any of these tax years. When the Internal Revenue Service attempted to collect the unpaid income taxes, Jaime Nieto unlawfully concealed assets available to pay the tax debt by opening and maintaining bank accounts using a social security number which did not belong to him and by using his business checking account, which the IRS could not levy to collect his personal tax debt, for all of his personal expenses. The case was investigated by Internal Revenue Service, Criminal Investigations.
Ginger Eva Ephrim, 20, was sentenced by Federal District Court Judge Scott W. Skavdahl on September 6, 2016, for conspiracy to transport stolen property through interstate commerce. Ephrim was arrested in Phoenix, Arizona. She received 12 months and 1 day imprisonment, to be followed by two years of supervised release, and was ordered to pay a $100.00 special assessment and $21,012.00 in restitution. This case was investigated by the Federal Bureau of Investigation.
Timothy Mulford, 31, and Maria Tillman, 27, both from Lander, Wyoming, were sentenced on September 6, 2016, by Federal District Court Judge Scott W. Tilghman was arrested in Riverton, Wyoming. He received 60 months imprisonment, with the first six months to be served concurrently with his undischarged sentence in a state criminal action. Stacey Irene Rodgers, 38, of Rock Springs, Wyoming, was sentenced by Federal District Court Judge Scott W. Skavdahl on September 6, 2016, for wrongful conversion of social security income. During the months of June 2014 through March 2015, the Social Security Administration (SSA) sent regular monthly payments Ms. Rodgers despite the fact that her son was then living with his father. Ms. Rodgers failed to report this change of circumstances to the SSA and knowingly converted those monies to her own use. Rodgers received three years of supervised release and was ordered to pay a $100.00 special assessment and $13,083.00 in restitution. This case was investigated by the Social Security Administration.

Cheyenne, Wyoming Resident Richard Patrick Person Sentenced for Possession of Largest Collection of Child Pornography in the United StatesRead the Press Release
Cheyenne – U.S. Attorney Christopher A. Crofts announced today that sixty-three year old Cheyenne, Wyoming resident Richard Patrick Person was sentenced by Chief United States District Court Judge Nancy D. Freudenthal on August 2, 2016, to 235 months of imprisonment, to be followed by ten years of supervised release and was ordered to pay $5,000 in restitution for possession of child pornography.
The Wyoming Internet Crimes Against Children Task Force (ICAC), using state of the art investigative techniques discovered that Person was using a sophisticated file sharing program to seek out and possess child pornography. They executed a search warrant at his residence located in South Cheyenne and seized several computers and numerous electronic storage devices. The computing devices seized from Person had approximately 47 TERABYTES of storage capacity. To put that in perspective, 1 terabyte holds approximately 1000 hours of standard definition video – or approximately 310,000 photos.
Wyoming Division of Criminal Investigation Special Agent Mark Timmons, the lead investigator on the case, has expended over 400 hours analyzing the child pornography possessed by Person.
Agent Timmons has submitted to the National Center for Missing & Exploited Children (NCMEC) approximately 10 million files he believes depict children engaged in sexually explicit conduct. He has an additional 7 million files that he is getting ready to ship off for analysis. The pornographic files possessed by Person include both movies and still images.
According to NCMEC and the National ICAC association this is the largest cache of child pornography ever seized in the United States.
Person has a prior conviction for sexual assault on a child.

Nieto faces a maximum penalty for misuse of a social security number of five years in prison and a $250,000 fine.
The case was investigated by special agents from the Cheyenne office of IRS Criminal Investigation and prosecuted by the United States Attorney’s Office for the District of Wyoming.
Wyoming Man Convicted of Being a Felon and Unlawful User of a Controlled Substance in Possession of Firearms and Possession of Equipment Used to Manufacture Controlled SubstancesRead the Press Release
U.S. Attorney for the District of Wyoming Christopher A. Crofts announced today that on June 23, 2016, Brad Calvin Titchener, 48, was convicted following a two-day jury trial in United States District Court in Cheyenne, Wyoming, of being felon and unlawful user of a controlled substance in possession of firearms and possession of equipment used to manufacture controlled substances. The investigation conducted by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATFE), the Wyoming Division of Criminal Investigation (DCI) and the Laramie County Sheriff’s Office (LCSO) resulted in the discovery of the firearms and equipment used to manufacture methamphetamine at Titchener’s residence on November 15, 2015, in Cheyenne, Wyoming. Sentencing has been set for August 30, 2016, at 9:30 a.m. before United States District Judge Alan B. Johnson in Cheyenne, Wyoming. Titchener faces up to 14 years in prison.
